ORDINANCE NO. 1354
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA
AMENDING CHAPTER 2 OF ARTICLE VI
OF THE ARCADIA MUNICIPAL CODE CONCERNING
BUSINESS LICENSE FEES.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. That Chapter 2 of Article VI of the Arcadia
Municipal Code is hereby amended by amending the following sections
to read as follows:
6212.4. VEHICLE LICENSES. Every person operating any
wheeled vehicle for which a license is required shall procure from
the License Officer, in addition to such license certificate, a
license decal upon which the License Officer shall impress a serial
number to be designated by him. The License Officer shall make a
charge of fifty cents (50 cents) for each license decal issued under
the provisions of this section, which shall be paid by the licensee
before the issuance thereof.
6212.6. SAME. AMENDMENT. Where a license is issued
authorizing a person to conduct a business at a particular place,
such licensee may, upon application therefor and paying a fee of
Two Dollars ($2.00), have the license previously issued amended so
as to authorize the conduct of such business at some other location.
6212.7. SAME. DUPLICATE. The License Officer shall make
a charge of Two dollars ($2.00) for each duplicate license and
fifty cents (50 cents) for each duplicate license decal issued under
the provisions of this Chapter which has been lost or destroyed.
6214.3. SAME. PENALTY. The License Officer shall, on

every 30th day following the due date thereof, add a penalty of
ten percent (10%) for failure to pay an annual, semiannual or

quarterly license fee when due; provided, however, that the total
penalties thus added shall not exceed fifty percent (50%) of the
license fee itself; and for failure tolpay a monthly, weekly or

daily license fee when due, the License, Officer shall add a penalty
of ten percent (10%) of said licens~ fee on the day following the
due date thereof; an additional penalty of ten percent (10%) shall
be added each month, week or day, respectively, that any such
license fee remains delinquent; provid~d, however, that the total
penalties thus added shall not exceed fifty percent (50%) of any
such respective license fee.
6214.5.2. SAME. APARTMENTS. Upon a surrender. to the

License Officer of a license issued pur"suant to Section 6220.5,
accompanied by proof of the sale of the bus iness thus licensed

and the name and address of the new owner thereof, the City shall
refund to the former licensee seventy-five percent (75%) of the
unused portion of the license fee if the total amount of such
unused portion exceeds Twenty dollars ($20.00).
6214.5.3. SAME. COUNCIL AC~~ON. No other refund of
any license fee collected by the City under this Chapter shall be
made, except that in the case of written claims for refunds the
Council shall have the discretionary power to refund not to exceed

seventy-five percent (75%) of the unused portion of any fee paid
when the total amount of the unused por:tion exceeds Twenty-five
dollars ($25.00). Said discretionary power shall only be exercised
in the interest of justice and to prevent extreme hardship.
6216.3. SAME. VEHICLE LICENpE DECAL. Every person
operating any wheeled vehicle for which a license is required
shall procure from the License Officer" in addition to such license
certificate, a license decal in accordance with subsection 6212.4.
Such license decal shall at all times be located in a conspicuous
place on said vehicle to which the same has been issued, in such
a manner that said license decal shall he plainly visible.

6216.4. MISUSE OR REMOVAL OF LICENSE DECAL.. No person
shall place or keep any license decal issued pursuant to sub-
section 6212.4 on any vehicle after the expiration of the term
for which the license is granted. No person except the licensee,
his authorized agent, or any police officer of the City, shall
take or remove any such license decal
from such vehicle to which

the same has been attached.'
6220.1.1. ADVERTISING BENCH. For every person maintain-
ing any advertising bench, as defiQed by S~ction 6101, on any street
or other public property, Fifty dollars ($50.00) per year for the
first ten (10) benches or less, and Five dollars ($5.00) per year
for each bench in excess of ten (10).
6220.2. ADVERTISING SOLICITATION. For every person
engaged in soliciting advertising where no regularly established
place of business is maintained in the City, Fifty dollars ($50.00)
per year or fraction thereof, and for every such person who has a
regularly established place of business!', Twenty-five dollars ($25.00)

per year plus Five dollars ($5.00) per year for each employee.
6220.4. AMUSEMENT AND GAME MACHINES. For every person
renting, leasing, owning or maintaining, as a business or in con-
nection with any business, any amusement or game machine or device,
any juke box, any device for the playing of records or music auto-
matically upon deposit of a coin, slug or other device, any pinball
machine, or any other or similar instrument, machine or device of
like character not prohibited by law, where any sum is charged by
means of a coin, slot or otherwise, Thi~ty dollars ($30.00) per
year or fraction thereof for each such ~achine or device.
6220.5. APARTMENTS. For every person engaged in the
business or occupation of conducting an apartment house or a
bungalow court, Twenty dollars ($20.00) per year for the first

four (4) rental units plus Five dollars ($5.00) for each additional
rental unit.
6220.5.1. LODGINGS. For every person engaged in the
business or occupation of conducting a motel, motor court, auto
camp, hotel, rooming house or lodging house, TWenty dollars ($20.00)
per year for the first four (4) rental 'units plus Three dollars

($3.00) for each additional rental unit.

6220.5.2. COMPurATION. For 'the purpose of computing
the fee applicable under Section 6220.~ or Section 6220.5.1, any
portion of the premises occupied by the manager or owner thereof
or any other person shall be deemed a rental unit if such portion
contains dwelling or sleeping facilities.
6220.8. BARBER SHOP. For every barber shop, ,
TWenty-five dollars ($25.00) per year, plus Five
dollars ($5.00) per year for each employee. For every manicurist,

and for every person shining or polishing shoes employed in

connection with or operating in any barber shop there shall be

paid an additional license of Five dollars ($5.00) per year for
each person so employed.
6220.9. BEAury PARLOR. For every beauty parlor, Twenty-
five dollars ($.25.00) per year, plus Five dollars ($5.00) per year
for each employee.
6220.10. BILLBOARDS. For every person conducting or
managing the business of advertising by means of billboards, bulletins,
sea~chlights or other media on private ';property. One Hundred dollars

($100.00) per year, plus Five dollars ($5.00) per billboard.

6220.11. BOWLING ALLEYS OR BILLIARDS, ETC. For every
place where billiards or pool are played, or bowling or tenpin
alleys, shuffleboard, table shuffleboard, skee-ball or other similar
device, Fifty dollars ($50.00) per year, plus Five dollars ($5.00)
per year for each table or alley or device.

6220.13. CHARTER BUSSES. For every person operating
a charter bus business, Twenty-five dollars ($25.00) per year,
plus Five dollars ($5.00) for each employee.

6220.13.1. CHRISTMAS TREES. ' For every person selling
Christmas trees. other than as a part of and at the same location
as a business then and theretofore licensed on an annual basis
pursuant to Section 6220.46, Thirty dollars ($30.00) per month

6220.15. CONTRACTORS. GENERAL. For every general
engineering contractor or geneJ;al buildrng contractor Seventy-five

dollars ($75.00) per year.
6220.16. DANCE HALL. PUBLIC. For every person conduct-
ing, managing or carrying on any public dance hall, dance floor or
ballrrom open to the public, Fifty dollars ($50.00) per year.
6220.18. FUMIGATING AND SPRAYING. For every person
engaged in the business of fumigating, spraying or dusting fruit
trees, plants, vines or orchards, Twenty~five dollars ($25.00) per
year or fraction thereof, plus Five dollars ($5.00) for each employee.

6220.22. HOSPITAL. For every hospital, nursing home,
convalescent home or maternity home, Twenty-five dollars ($25.00)
per year plus Five do llar s ($5.00) for each employee.
6220.23. HOUSE MOVER. For e~ery person engaged in the

of moving houses, Sixty dollars. per year.
6220.24. JUNK DEALER. For ev:ery person engaged in the
business of collecting, purchasing, selling or dealing in junk,
Fifty dollars ($50.00) per year.
6220.25. KENNELS. For every "person conducting a kennel
or a place where dogs or cats are cared for or bred, Twenty-five
dollars ($25.00) per year plus Five dollars ($5.00) per year for
each employee.
6220.26. LAUNDRY. For every1laundry in the City,
Twenty-five dollars ($25.00) per year pius Five dollars ($5.00) for
each employee.
6220.27. LAUNDROMAT. For ea~h self-service laundry,
laundromat, or launderette, Ten dollars;; ($10.00) per year plus
fifty cents (50(:) per year for each washing machine upon the premises
of such laundry, laundromat or launderette.
6220.28. LAUNDRY COLLECTIONS. For every business oper-

ating any vehicle gathering, securing oJ; a~cumulating soiled articles

of clothing, bedding or any other article or articles in the City
for the purpose of carrying, hauling o~ transporting the same to
any laundry located outside of the City, Thirty dollars ($30.00)
per year or fraction thereof per vehicle.
6220.33. MOTION PICTURES. For every person engaged in

the business of taking motion pictures :'or photoplays, One Hundred
dollars ($100.00) per day or any portion of such day.
6220.35. PATROLS. PRIVATE. For every person engaging
in the business of a private patrol, One Hundred dollars ($100.00)
per year.

6220.37. PEDDLERS AND SOLICITORS. TRANSIENT. For every
peddler or solicitor having no established place of business in the
City, Twenty dollars ($20.00) .per month per peddler or solicitor.
BUSINESS.
6220.37.1. SAME. ESTABDrS~~/ For every peddler or

solicitor having an established place o'f business in the City,
One Hundred dollars ($100.00) per year for a master license and
an additional fee of Five dollars ($5.00) per peddler or solicitor
per year for each individual peddler or solicitor.

6220.39. PHOTOGRAPH STUDIO. For every person conducting
the business of a photograph studio, Twenty-five dollars ~25.00)
plus Five dollars ($5.00) for each employee.
6220.40. PHOTOGRAPHER. TRAN$IENT. For every person not

having a regularly established place of business in the City and
engaged in making photographic exposures for sale within the City,
Sixty dollars ($60.00) per year or fraction thereof.
6220.41. PHOTOGRAPHY LABORATORY. For every film deve10p-

ing or printing laboratory, not connected with a ,licensed photograph
studio or photographic supply shop, Twenty-five dollars ($25.00)
plus Five.do11ars ($5.00) for each employee.
6220.42. . POULTRY, ANIMALS AND PRODUCTS. For every person

conducting, managing or carrying on a business of hatching, raising

breeding or selling birds, fowl, poultry, rabbits or animals, other
than horses, or the business of selling any of the foregoing or the
offspring, products or by-products of any of the foregoing, Twenty-
"
five dollars ($25.00) plus Five dollars' ($5.00) for each employee.
6220.43. PROFESSIONAL SERVICES. For every person engaged

in any professional occupation or semi-professional occupation
which is regulated by .the State of California, either as an indiv-
idual, partner, associate or otherwise than as an employee, Twenty-
five dollars ($25.00) per year, plus Te'n dollars ($10.00) per year
for each employee required by the State of California to be licensed,
plus Five dollars ($5.00) per year for each other employee.
6220.44. REAL ESTATE BROKER. For every person engaged
in business as a real estate broker, Twenty-five dollars ($25.00)
per year plus Five dollars ($5.00) per :year for each salesman and
employee.
6220.45. RESTAURANT. For every person engaging in the
cafe or restaurant business or as a retailer of cooked foods or
delicatessen foods, Twenty-five dollars' ($25.00) per year, which
shall include the owner;. for each additional employee, Five dollars
($5.00) per year per employee.
6220.46. RETAIL OUTLETS. For every person engaged in

the business of selling to the general public at retail, goods,
wares, merchandise or commodities, including restaurants and other
food dispensers, unless otherwise in tl\is Part expressly provided,
an annual license tax computed as follows: 1'Iventy-five dollars
($25.00) plus Five dollars ($5. 00) for~ach employee.
6220.47. SCHOOLS; For every private school or college
where tuition is charged, dance school,': swim school or music school,
Twenty-five dollars ($25.00) plus Five dollars ($5.00) for each
employee.
6220.53. TAXI. For every person operating a taxicab
business, Twenty-five dollars ($25.00) per year for each taxi or
taxicab.

6220.54. THEATRES AND SHOWS.: For every person engaged
in the business of conducting a theatre or moving picture show,
either at an established place of business or by means of a mobile
unit, One Hundred dollars ($100.00) per year.
6220.56. TIP SHEETS. For every person who by any means
engages in the bus iness or practice of "disseminating, dis tr ibuting,

passing out, giving away, handing out, selling, offering for sale,
or soliciting for the sale of any sheet, dodger, handbill, circular,
letter, booklet, or any other printed, iitypewritten, mimeographed
or wr itten matter of any kind, other than a newspaper, per taining
to any horse race, choice of a horse or. horses, recommending any
horse or horses, or giving or conveying any information about any
horse, .horse rac;e or contest of endurance or speed between horses
or beasts, if upon property owned and controlled by any racing
association duly licensed by the State .to conduct horse racing
under and in accordance with the laws of the State relating to such
matters and in conjunction with vlhich such property is used by such
racing associ~tion, One Hundred Fifty dollars ($150.00) for a
twelve (12) months period commencing,December 1 and ending November
30; if upon any other privately owned property, Six Hundred Dollars

($600.00) for such twelve (12) months period. The number of persons
allowed to distribute such material under anyone license shall not
exceed the number specified in Section 6426. (Amended by Ord. 1104

6220.57. VENDING AND WEIGHING MACHINES OR DEVICES. For
every person engaged in the business of renting, leasing, operating

or maintaining any vending, weighing, or merchandise machine or
device or any other such similar or like machine or device, not
otherwise licensed under this Part and not prohibited by law, wherein
the sum of one cent (l~) or less than five cents (5~) is charged,or
collected for such machine or device by means of a coin slot or

othenlise, 1'\-10 dollars ($2.00) per year, or fraction thereof for each
such machine or device; where the sum is from five cents (5~) to
ten cents (1O~) incLusive, charged by means of a coin or token slot
or otherwise, Four dollars ($4.00) per year or fraction thereof for
"
each such machine or device; and where a sum over ten cents (10~)
is charged by means of a coin or token slot'or otherwise, Six
dollars ($6.00) per year or fraction'thereof for each such machine
or device.
6220.58. WHEELED VEHICLES. :Every person who, in conjunc-

tion with the business in which such person is engaged, runs,
drives or operates, and every person engaged in the business of
running, dr iving or operating, for hire or othen~ise, any wheeled
vehicle for the purpose of hauling, dis,tributing, selling, receiv-
ing or delivering, and who actually ha~ls, distributes, sells,
receives or delivers within the City for resale or otherwise,
personal proper ty of any kind, nature qr descr iption, unless other-
vlise provided in this Par t, 1'\venty-five dollars ($25.00) per year
for each such wheeled vehicle so run, driven or operated. The
provisions of this Part, unless otherwise in this Chapter provided,
shall not apply to any person having a fixed place of business
within the City which has been licensed under this Chapter and who
in the usual course of business uses a wheeled vehicle or vehicles
for the delivery of personal property which has been sold from said
place of bus iness.
6220.59. SA}$. FLEET LICENSE. Every person who, in
conjunction with the business in \vhich :,such person is engaged,
uses, drives or operates a fleet of five or more wheeled vehicles
for any of the purposes stated in subsection 6220.58, and no more
than five wheeled vehicles are used by .such person in the City in
,
anyone day in connection with the business in which such person
is engaged, shall be deemed to have co~plied with the license require-

ments for all such wheeled vehicles of 'such fleet, upon payment
of a license of One Hundred Twenty-five dollars ($125.00) per year
and the compliance with the provisions .of subsection 6212.4 as to
license ~a~~~~ for each wheeled vehicle of such fleet. The license
provided for in this section shall be known as a ''Fleet License. II
6220.60. SANE.. LOCAL VENDORS. For every person,
including persons having a fixed place of business in the City,
engaged in the business of selling at rrtail foodstuffs for human
,
consumption from a wheeled vehicle upon,; the streets, over a fixed
route from door to door or otherwise, except retail milk delivery
or retail ice delivery, and unless otherwise provided in this Part,
"
Fifty dollars ($50.00) per year for each vehicle so used.
6220.61. IYHOLESALERS. For every person engaged in the
business of selling goods, wares or merchandise at wholesale and
for every person engaged in the busines~ of manufacturing, process-

ing or fabr icating goods, wares or merchandise, unless otherwise
in this Part expressly provided, an annual license fee computed
as fol1m~s: Twenty-five dollars ($25.00) plus Five dollars ($5.00)
for each employee of said person actually employed in said business

within the City.
SECTION 2. That Chapter 2 of Article VI of the Arcadia
Hunicipal Code is amended by adding thereto new Sections 6220.15.1

and 6220.43.1, the same to read respectively as follows:
6220.15.1. CONTRACTORS. SPECIALTY. For every contractor
as defined in Section 6109, other than a general engineering con-
tractor or a general building contractor required to be licensed

under the preceding Section, Sixty dollars ($60.00) per year. A

separate license shall be required by this Section for an electrical
contractor or a plumbing contractor even though licensed under the
preceding Section as a general contract~r.

6220.43.1. TRADE SERVICES. For every person engaged in

any occupation, trade or craft for which no license is herein
otherwise specified, and persons primar,ily engaged in selling,

performing or furnishing services other, than commodities, includ-
ing trades and crafts, and all other persons engaged in a business
for which no license is herein otherwise specified, an annual
license tax computed as follows: Twenty-five dollars ($25.00)

plus Five dollars ($5.00) for each employee employed in such
business. Employees engaged solely in rendering services to the

City, either under contract or as employees, shall be excluded
in computing the amount of fee due under this Section.
6411.2. TRANSFER FEE. Any machine or device licensed
,
under subsection 6220.4 may be removed ;'from the place of operation
for which it has been licensed and replaced with a like or similar
machine or device at any time during t~e term of the license issued
therefor upon the payment to the License Officer of a transfer fee
in the amount of Two dollars ($2.00) and upon the submission in
writing to such Officer of all the information concerning such
replacement machine or device as is required in an initial appli-
cation for any such machine or device.,
6428.2. FILING AND FEE. Each application for a permit
under this Division shall be filed with the License Officer,

accompanied by the payment of the sum of Two dollars ($2.00)
for each bench specified in the application, to cover in part
"
the cost of inspecting the benches and the proposed locations.
Said fee shall in no event be refunded~

6429.2.2. VEHICLE SUBSTITUTION. The holder of an
owner's permit may substitute one automobile in the place and
stead of each licensed automobile the use of which has been dis-
continued, by making application to do so and securing the approval

of the Council. Before granting such approval the applicant shall
fully comply with the provisions of subsections 6429.2.1.3 and
6429.2.1.4. Upon the granting of such application, the Clerk
shall endorse a memorandum of each substitution upon the original
owner's permit, and also upon the license issued to the automobile
the use of which has been discontinued, and shall notify the
License Officer of such substitution and endorsement. For each
such substitution such permit holder shall pay to the City a
fee of Two dollars ($2.00).

SECTION 3. The City Clerk shall certify to the adoption
of this ordinance.
