D'L.M 4-- ~ j tJrflJ- /-1&-" !' THE CITY COUNCIL OF THE CITY OF ARCADIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Planning Department is studying and the City Planning Commission has already fixed December 12, 1967 as the date of a public hearing concerning a zoning proposal to re- define or to further define restaurants and drive-in businesses and amend or impose additional regulations or restrictions on restaurants as presently permitted by the City Zoning Ordinance. SECTION 2. That from and after the effective date of this Ordinance and for a period of ninety (90) days thereafter no building shall be erected, altered or moved into the City nor shall any occu- pancy of any such building be commenced for the purpose of a restau- rant. This Ordinance shall not apply to any premises with respect to which plans have already been submitted to the City and applica- ~ tion made for a building permit, provided that such plans comply with the present regulations applicable to restaurants. SECTION 3. This Ordinance is hereby declared by the City Council to be necessary as an emergency measure for preserving the public peace, health. and safety, is adopted pursuant to and under authority of Section 65858 of the California Government Code, and shall take effect immediately upon its adoption. A statement for its urgency is as follows: Provisions of the City Zoning Ordinance intended to distinguish between and regulate the respective problems -1- 1369 of drive-in food establishments, establishments where food is served for consumption on the premises within an enclosed building, and establishments where food is served for consumption anywhere on the premises, are being evaded through technicalities not apparent to the Planning Commission or the City Council at the time of the adop- tion of the present regulations. That to prevent further evasion of the intent of the City Zoning Ordinance and the regulations applicable to food establishments, it is necessary that this Ordinance take effect immediately upon its adoption. SECTION 4. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published once forth- with in the official newspaper.
