Arcadia City Council Chambers Conference Room There is a five working day appeal period. Appeals are to be filed by January 29, 2006. ROLL CALL: Olson, Kelly, Penman 1. PUBLIC HEARING MC 07-03 245 W. Le Roy Avenue Diane Bade Approved subject to the following conditions: A. The Le Roy Avenue side of the property is to be treated as the front yard as long as the pool, spa and/or wall over 3'-0" high remain in the defined front yard. B. The wall shall comply with the City's vehicular visibility standards. Modifications for a new swimming pool and spa: A. A 5'-0" setback from the Ewell Avenue property line in lieu of the required 25'-0". B. A 5'-0" high wall in lieu of the maximum 3'-0" height allowed along the Ewell Avenue side of the property. C. A 5'-0" northerly side yard setback in lieu of 11'-3" for the pool and spa equipment. NOTE: These Modifications are requested because the Arcadia Municipal Code, in Section 9220.42, defines the Ewell Avenue side of the property as the front yard, even though the house faces Le Roy Avenue.
