SUBJECT: ACCEPT A COMMUNICATIONS SITE LEASE AGREEMENT BETWEEN
THE CITY AND VERIZON WIRELESS FOR A WIRELESS
COMMUNICATION FACILITY AT CAMINO GROVE PARK — 1410
SOUTH SIXTH AVENUE
Recommendation: Approve
SUMMARY
On April 12, 2011, the Arcadia Planning Commission granted a Conditional Use Permit
and Architectural Design Review for a wireless telecommunication facility to be installed
by Core Development Services on behalf of Verizon Wireless. Staff recommends that
the City Council accept the communication site lease Agreement between the City and .
Verizon Wireless for a wireless communication facility at Camino Grove Park - 1410 S.
Sixth Avenue.
DISCUSSION
Installation of a cell tower on City -owned property requires a Conditional Use Permit
(CUP). The Development Services Department (DSD) is responsible for processing
CUPs, writing the staff report, mailing the notice, and giving a staff presentation at a
Planning Commission hearing for each application to install a wireless facility on City or
private property.
Camino Grove Park has a portion of land that can be utilized by Verizon Wireless for a
wireless telecommunication facility. Verizon Wireless will lease approximately 745
square feet at Camino Grove Park (see attachment), which includes a 55 foot high cell
tower camouflaged as a mono -pine to be located at the southeast corner of the park.
This area has several mature trees which would allow the mono -pine to blend into the
surroundings. On April 12, 2011, the Arcadia Planning Commission adopted a
Resolution approving the CUP and architectural design review of the wireless
communications facility at Camino Grove Park.

In the case of city -owned property such as a park, the Public Works Services
Department (PWSD) is responsible for site location, coordination with the carrier,
negotiating terms of a lease, and other logistics. The City's regulation does not extend
to questioning the "need" for a facility. Each individual telecommunications provider
determines the need for a specific facility in a certain geographic area based on
customer base and usage levels, coverage pattern (based on radio frequency maps),
and other internal criteria. PWSD staff met with the applicant (Verizon Wireless) to
discuss the scope of the project and also worked with the City Attorney and with Verizon
Wireless' legal representative in negotiating the lease Agreement for this facility.
The following are deal points of the agreement that were agreed upon by the City and
Verizon Wireless.
1. Term: The term of the lease is for sixty (60) calendar months commencing upon
the first day of the second month following the execution date. Lessee has the
option to renew the Agreement for four (4) additional terms (Term consists of five
(5) years).
2. Consideration: Lessee shall pay the City monthly installments of Two Thousand
Two Hundred Eighty -Five Dollars ($2,285) each month with a three percent (3 %)
annual escalator.
3. Removal of Improvements: The City agreed to cap liquidated damages not to
exceed Seventy -Seven Thousand Dollars (77,000) should the Lessee fail to
restore the City's property to its original condition.
4. Hazardous Substances: Lessee shall not be permitted to install permanent
underground storage tanks on the Leased Area or City's property and any
Hazardous Substances used by lessee on the City's property shall be used in
compliance with all applicable law, rules and regulations.
Staff negotiated the price based on survey of wireless communication leases with
surrounding cities. This will be the seventh (7) cell tower to be installed on City -owned
property.
Therefore staff recommends that the City Council accept the communication site lease
Agreement between the City and Verizon Wireless for a wireless communication facility
at Camino Grove Park — 1410 South Sixth Avenue.
FISCAL IMPACT
This lease of a portion of Orange Grove Park to T- Mobile for a wireless
telecommunication facility will generate $27,420 annually in revenue for the City with
three percent (3 %) increases each year thereafter.

RECOMMENDATIONS
1. Accept the communication site lease agreement between the City and
Verizon Wireless for a wireless communication facility at Camino Grove
Park — 1410 South Sixth Avenue
2. Authorize the City Manager to execute a contract in a form approved by the
City Attorney.
