HomeMy WebLinkAbout1306 ORDINANCE NO. 1306 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF" ARCADIA, CALIFORNIA, REPEALING CHAPTER 3 ENTITLED "BICYCLES" OF ARTICLE III OF THE ARCADIA MUNICIPAL CODE AND ADDING THERETO A NEW CHAPTER 3 ENTITLED "BICYCLES AND WHEELED TOYS", THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That Chapter 3 entitled "Bicycles" of Article III of the Arcadia Municipal Code and Sections 3301, 3302 and 3302.1 thereof are hereby repealed. SECTION 2. That a new Chapter 3 entitled "Bicycles and Wheeled Toys", consisting of Part 1 entitled "Definitions" containing Sections 3310 through 3315, Part 2 entitled "Regulations" containing Sections 3320 through 3324, and Part 3 entitled "Bicycle Registration" containing Sections 3330 through 3332, is hereby added to Article III of the Arcadia Municipal Code, the same to read as follows: ARTICLE III. CHAPTER 3. PART 1. PUBLIC SAFETY BICYCLES AND WHEELED TOYS DEFINITIONS. 3310. DEFINITIONS. For the purpose of this Chapter certain words and terms are hereinafter defined and shall have the meaning thus ascribed. 3311. SAME. BICYCLE. "Bicycle" includes every device pro- pelled in whole or in part by human power upon which a person may ride, having WI 0 or more tandem wheels anyone of which is over fourteen (14) inches in diameter. -1- 1306 3312. SAME. WHEELED TOY. "Wheeled Toy" includes all other wheeled objects, regardless of motive power, not classified as bicycles in this Code nor as vehicles in the Vehicle Code of the State, and specifically includes, but without limitation, roller skates, skate- boards, coasters, scooters and toy vehicles. 3313. SAME. BUSINESS DISTRICT. "Business District" shall be that defined by the Vehicle Code of the State. 33l4. SAME. PLACE OF PUBLIC ASSEMBLY. "Place of Public Assembly" includes all buildings or areas where persons congregate from time to time, exclusive of those within business districts as herein defined. 3315. SAME. SIDEWALK. "Sidewalk" shall mean that area ad- jacent to a travelled roadway, whether hard surfaced or not, upon which the public is customarily invited or permitted to walk or otherwise use. PART 2. REGULATIONS. 3320. BUSINESS SIDEWALK OPERATION. No person shall use or operate any bicycle or wheeled toy upon any sidewalk in a business district or adjacent to any place of public assembly. 3321. WHEELED TOYS PROHIBITED ON STREETS. No person shall use, operate, park or leave any wheeled toy upon the travelled way of any publiC street or alley. 3322. PARKING RESTRICTIONS. No person shall park or leave any bicycle or wheeled toy upon any street or alley, nor upon any side- walk in any business district or adjacent to any place of public assembly in such manner as to obstruct or hinder the free passage of pedestrians or other vehicles or devices permitted to use the same. Any bicycle or wheeled toy found in violation of this Section may be impounded by the Police Department and returned to the owner under such reasonable conditions as may be established by the Chief of Police. (a) -2- 1306 3323. EXCEPTION. Devices designed, intended and used solely invalids, or incapacitated persons, for the transportation of infants/or devices designed, intended and used for the tr~lsportation of merchandise to or from the place of pur- chase, and other wheeled devices when being used for either of said purposes, shall be exempted from the regulations imposed by this Chapter. Likewise the regulations specified in this Chapter shall not apply to a place of public assembly when it is not open or in use, nor shall they apply if the person in charge of such place of public assembly expressly waives the same. 3324. POSTING AUTHORIZED. The City Trafric Engineer is authorized and d:l.rected to erect such signs and other notices as he deems advisable under this Chapter. PART 3. BICYCLE REGISTRATION. 3330, REGISTRATION. Any bicycle owned by a person residing in the City maybe registered with the Police Department upon the fill- ing out by owner thereof of an application form giving the owner's name and address, the name and serial number of the bicycle, and such other information as the Police Department may require. 3331. IDENTIFICATION. Upon the receipt of such completed application, the POlice Department shall issue a decal or other means of identification bearing the registration number issued by said Police Department for the bicycle described in such application. Such registration shall be for an indefinite period, and shall not be trans- ferable to any new owner of the bicycle thereby identified. , -3- 1306 ~ . 3332, SAME. REMOVAL PROHIBITED. No person shall willfully or maliciously renlove, destroy, mutilate or alter the serial number stamped upon or affixed to any bicycle frame by the manufacturer thereof. No person shall, without the consent of the owner of the bicycle iden- tified thereby, alter or remove any identification device issued by the Police Department and affixed to the bicycle identified thereby. SECTION 3. The City Clerk shall certify to the adoption of this Ordinance.
