HomeMy WebLinkAbout1322 ORDINANCE NO. 1322 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, VACATING AND ABANDONING A PORTION OF BALDWIN AVENUE IN SAID CITY. THE CUY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND ORDAIN AS FOLLOWS: SECTION 1. That Resolution No. 3854 entitled "A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DE- CLARING ITS INTENTION TO VACATE AND ABANDON A PORTION OF BALDWIN AVENUE AND FIXING A TIME AND PLACE FOR THE HEARING OF OBJECTIONS TO SUCH PROPOSED VACATION AND ABANDONMENT", was duly and regularly adopted by the City Council of the City of Arcadia on March 1, 1966; that said Resolution, among other things fixed the hour of 8:00 o'clock p.m. on the 5th day of April, 1966, in the Council Chamber of the Arcadia City Hall, 240 West Huntington Drive, Arcadia, California, as the time and place for hearing all persons interested in or objecting to the proposed vacation as therein outlined; that a copy thereof was duly and regularly published in the Arcadia Tri- bune, a newspaper of general circulation published and circulated in said City, as required by the Streets and Highways Code of the State of California, and that the property hereinafter described and proposed to be vacated was duly and regularly posted as required by the Streets and Highways Code of the State of California; that the affidavits of said publication and of said posting were duly filed with and are now on file with the City Clerk of the City of Arcadia; that on the 5th day of April, 1966, at the hour of 8:00 o'clock p.m., in the Council Chamber of the Arcadia City Hall, 240 West Huntington Drive, Arcadia, California, the City Council of the City of Arcadia did accept and receive all testimony offered in support of or in objection to the said proposed vacation; that -1- 1322 thereupon the said City Council found from evidence submitted that the property hereinbefore used for street purposes, and hereinafter particularly described is unnecessary for present or prospective street purposes, and that the public welfare, convenience, necessity and safety require and will be better served by the vacation thereof as a public street in said City. SECTION 2. That the City of Arcadia does therefore hereby order the vacation and abandonment of that property, heretofore a part of Baldwin Avenue, in the City of Arcadia, County of Los Ange- les, State of California, specifically described as follows: Those portions of that 20 foot parcel shown as Baldwin Avenue on map of Tract 19681 recorded in Book 511, pages 26 and 27, of Maps in,,the office of the Recorder of said County, described as follows: Parcell: Beginning at the northwesterly corner of said parcel; thence South 9028'25" East 75.01 feet along the westerly line of said Baldwin Avenue to the beginning of a tangent curve concave to the northwest and having a radius of 25 feet; thence southwesterly along said curve 39.26 feet to a point of tangency with the northerly line of Callita Street as shown on said map; thence North 80030'27" East 8.00 feet to the beginning of a tangent curve concave to the northwest and having a radius of 25 feet; thence northeasterly along said curve 39.26 feet to a point of tangency with a line that is parallel with and distant easterly 8.00 feet from the westerly line of said Avenue; thence North 9028'25" West 75.01 feet to the northerly line of said parcel; thence South 80030'27" West 8.00 feet to the point of beginning; Parcel 2: Beginning at the southwesterly corner of said parcel; thence North 9028'25" West 111.44 feet along the westerly line of said Baldwin Avenue to the beginning of a tangent curve concave to the southwest and having a radius of 25 feet; thence northwesterly along said curve 39.28 feet to a point of tangency with the southerly line of Ca.llita Street as shown on said map; thence North 80030'27" East 8.00 feet to the beginning of a tangent curve concave to the southwest and having a radius of 25 feet; thence southeasterly along said curve 39.28 feet to a point of tangency with a line that is parallel with and distant easterly 8.00 feet from the westerly line of said Avenue; thence South 9028'25" East 111.44 feet to the southerly line of said parcel; thence South 80030'27" West 8.00 feet to the point of beginning. SECTION 3.
