ORDINANCE NO. 1349
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
AMENDING THE ARCADIA MUNICIPAL CODE
BY REPEALING SECTION 7306 THEREOF,
AMENDING SECTIONS 7301.1, 7301.2,
7304 AND 7305 THEREOF, AND ADDING
THERETO NEW SECTIONS 7300.1, 7301.3
AND 7301.4 CONCERNING EXCAVATION FEES.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNI~DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. That the Arcadia Municipal Code is hereby
amended by repealing Section 7306 thereof.
SECTION 2. That the Arcadia Municipal Code is hereby
, amended by amending Sections 7301.l, 7301.2, 7304 and 7305 thereof,
the same to read respectively as follows:
730l.1. EXCAVATION FEES. Any person intending to make
an excavation for any purpose in any street, alley, parkway, public
easement or other public place shall deposit with the City an in-
spection fee of Ten dollars ($lO.OO).

ing to make an excavation in any street or alley shall deposit with
the City a sum equal to Two dollars ($2.00) per square foot of sur-
face of each such excavation to be made in any street, alley or
other public place which is paved with concrete, or a sum equal to
One dollar and fi,fty cents ($1.50) per square foot of surface of
each such excavation to be made in any street, alley or other pub-
lic place which has been macadamized or paved with asphalt.
7304. REPLACEMENT OF SURFACE. Upon the refilling and
temporary patching of an excavation in the manner and within the
time specified in the excavation permit, the surface torn up or
damaged by such excavation shall be replaced either by the Super-
intendent of Streets or under his direct inspection by the permittee

in accordance with the specifications then in use by the City for
the laying of pavement of the character of that which has been re-
moved.
7305. REFUND OF REPLACEMENT DEPOSIT. Upon certification
by the Superintendent of Streets that the street surface which was
removed or damaged by an excavation has been replaced or repaired
by the permitteE! in accordance with City's specifications, the City
shall refund the deposit made pursuant to Section 7301.2 to the per-
son who made such deposit. If the street surface which was removed
or damaged by an excavation was replaced or repaired by the City,
all deposits made pursuant to Section 7301.2 shall be retained by
the City.
SECTION 3. That the Arcadia Municipal Code is hereby
amended by adding new Sections 7300.1, 730l.3 and 7301.4 thereto,
the same to read respectively as follows:
7300.1. PERMIT FEE. Before any permit is issued pur-
suant to this Chapter, the applicant shall pay to the City a per-
mit fee of Five dollars ($5.00) which is in addition to all other
fees and deposits required by this Chapter.
7301.3. PUBLIC UTILITIES. Public utility companies may
obtain an annual blanket permit at a cost of One hundred dollars
($100.00) or they shall be required to obtain an excavation permit
for each street cut in accordance with the above provisions. In-
spection fees shall be billed to the utility companies, on actual
cost basis at the discretion of the Superintendent of Streets.
7301.4. SOIL TESTS. Any person making an excavation for
which a permit is required by this Chapter shall pay to the City
the sum of Fifteen dollars ($15.00) for each soil density test
deemed necessary by the Director of Public Works and to be taken
by City personnel.

SECTION 4. The City Clerk shall certify to the adoption
of this ordinance.
