'I. ..... ~ ,.. ,";J.V. . -, ORDINANCE NO. 1254 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING DIVISION 6 OF PART 6 OF CHAPTER 2 OF ARTICLE IX OF THE ARCADIA MUNICIPAL CODE (M-l PLANNED INDUSTRIAL DISTRICT). THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That the title of Division 6 of Part 6 of Chap- ter 2 of Article IX of the Arcadia Municipal Code is amended to read as follows: DIVISION 6. M-l PLANNED INDUSTRIAL DISTRICT. SECTION 2. That Sections 9266.1.11 through 9266.1.24 of the Arcadia Municipal Code are hereby repealed. SECTION 3. That Sections 9266.l.l, 9266.l.2, 9266.1.3, 9266.1.4, 9266.l.5, 9266.1.6, 9266.l.7, 9266.1.8, 9266.l.~, 92?6.l.10, 9266.2.1, 9266.2.2, 9266.2.3, 9266.2.4 and 9266.2.5 of the Arcadia Municipal Code are amended to read respectively as follows: 9266.1.1. SAME. Architects and Engineers. 9266.1.2. SAME. Emergency Hospitals, Clinics. 9266.1.3. SAME. Service Stations. 9266.1.4. SAME. Repair Garages operated or conducted wholly within a building arranged in such a manner as to screen all operations from the street. ~'1~~ -7'9266.1.5. Ql., ,_ tU , 9266.1.6. SAME. Any business engaged in processing, assem- blying, manufacturing, warehousing or storing of products or merchan- dise which complies with the regulations and performance standards of this Division in addition to all regulations and performance standards -1- 1254 ~ , __ r .". ,-If,. ... -- that may be specified for another Zone in which such use is specifically permitted by this Article. In cases of duplication of regulations or performance standards, the more restrictive regulation or standard shall apply. 9266.1.9. ACCESSORY BUILDINGS. Accessory buildings and uses customarily included within any of the uses specified in this Part when located on the same site. 9266.1.10. PROHIBITED USES. No use specified in Section 9267.1.2 through 9267.1.59 shall be permitted. 9266.2. REGULATIONS. The regulations set forth in this Title shall apply in the M-l Planned Industrial District unless other- wise specifically provided in this Chapter. 9266.2.1. BUILDING HEIGHT. No building hereafter erected, constructed or established shall exceed two (2) stories or thirty- five (35) feet in height, except as provided in Division 6 of Part 7 or in Division 2 of Part 8, of this Chapter. 9266.2.2. YARD REQUIREMENTS. FRONT YARD. There shall be a front yard of not less than ten (lO) feet. 9266.2.3. LOT AREA. Every industrial site, shall have a lot area of not less than fifteen thousand (15,000) square feet. 9266.2.4. LOT COVERAGE. Building coverage shall not ex- ceed sixty per cent (60%) of the total lot area. 9266.2.5. PARKING. For manufacturing and warehousing one (1) parking space for each five hundred (500) square feet of building area shall be provided and maintained. For all other uses, parking space shall be provided as required by Division 4 of Part 8 of this Chapter. No driveway shall be less than twenty (20) feet wide. -2- 1254 -. ~., .- ,- ."" .... ~ SECTION 4. That new Sections 9266, 9266.2.2.1 and 9266.2.2.2 and Sections 9266.2.6 through 9266.2.12 are hereby added to the Arcadia Municipal Code, the same to read respectively as follows: 9266" LESIGLATIVE INTENT. The purpose of the Planned In- dustrial District is to provide sites for light industrial and manu- facturing firms processing, assemblying, manufacturing and distribu- ting products, sites for'warehousing and storage, and sites for essen- tial service facilities such as restaurants, service stations and public utilities. 9266.2.2.1. SAME. SIDE YARD. There shall be a side yard on each side of every building of a width not less than five (5) feet; provided further, (a) That the side yard on the street side of a corner lot shall be ten (10) feet wide; and (b) That one (1) side yard on an interior lot may be elimi- nated if in lieu thereof a yard ten (10) feet wide is provided for a depth of thirty (30) feet from the front property line and a solid decorative masonry wall at least six (6) feet high or the wall of a building is erected across the rear of such yard. 9266.2.2.2. SAME. REAR YARD. No rear yard shall be re- quired except when adjacent to a residentially zoned area, in which event a rear yard of twenty-five (25) feet shall be required. 9266.2.6. OFF-STREET LOADING REQUIREMENT. Every main building hereafter erected, constructed or established shall be prOVided with a minimum off-street or off-alley loading space of one (1) loading space for each seven thousand five hundred (7500) square feet of gross floor area. Not more than two (2) such spaces shall be required unless the building on such lot has a gross floor area in excess of twenty thousand (20,000) square feet, in which case there shall be one (1) additional loading space for each addi- tional ten thousand (10,000) square feet or major fraction thereof -3- 1254 -' ....... ~ ~ 0" ~ ... .. ~ in excess of twenty thousand (20,000) square feet. Each such loading space shall not be less than ten (lO) feet wide by thirty (30) feet long with adequate provision for egress and ingress. 9266.2.7. OUTSIDE USAGE. Property outside a building may be used for parking, loading and storage areas, provided that all such storage activities conducted thereon are screened from view from adjoining properties and public rights-of-way. 9266.2.8. SIGNS. One (1) square foot of sign area may be used for each two (2) lineal feet of building frontage. Every sign shall be located flat against the facade of the building. No sign shall have any flashing or moving parts. No sign shall be erected or maintained on any roof or exceed the height of the roof. Identification walls shall be permitted in the front yard areas pro- vided they do not exceed a height of four (4) feet and a length of ten (10) feet. 9266.2.9. LANDSCAPING. A permanent irrigation system shall be installed and maintained in every required front and side yard. Every front and side yard shall be landscaped in accordance with the landscaping details shown on the approved site plan and all such landscaping shall thereafter be maintained substantially as shown on such approved site plan. 9266.2.10. LIGHTING. No outside lighting fixture on a site next to residentially zoned property shall exceed ten (lO) feet in height. All exterior lighting fixtures shall be erected or shielded in such a manner that no light rays may emanate therefrom directly to adjacent properties or public rights-of-way. 9266.2.11. PLAN AND PROCESS APPROVAL. To insure com- pliance with the provisions of this Division preliminary plot plans shall be submitted to the Planning Department prior to the issuance of a building permit. The preliminary plot plans shall include the size, shape and location of all proposed improvements, including -4- 1254 ------;:'"" " <'. --~-- _r------... - ____ buildings, parking and loading areas, walls, landscape areas, outdoor lighting fixtures and signs. In addition, preliminary elevation plans of all four sides of any proposed buildings shall be clearly shown The final working drawings shall be in substantial compliance with the approved preliminary plans. Sufficient equipment and process informa- tion shall be submitted therewith as to demonstrate compliance of the proposed use of the property with the performance standards applicable thereto. 9266.2.12. UTILITIES. All utilities on the site for direct service to the use thereon shall be installed underground except as otherwise approved by the Council by precise plan of design. The owner or developer is responsible for complying with the require- ments of ,this Section and shall make the necessary arrangements as required by the serving utility companies for the installation of such facilities. SECTION 5. That a new Title 3 entitled "Performance Standards" containing Sections 9266.3 through 9266.3.12 is hereby added to Division 6 of Part 6 of Chapter 2 of Article IX of the Arcadia Municipal Code, the same to read as follows: ARTICLE IX. CHAPTER 2. PART 6. DIVISION 6. TITLE 3. DIVISION AND USE OF LAND ZONING REGULATIONS COMMERCIAL AND INDUSTRIAL ZONES M-l PLANNED INDUSTRIAL DISTRICT PERFORMANCE STANDARDS 9266.3. PERFORMANCE STANDARDS. The performance stan- dards as set forth in the following subsections shall apply to and be complied with by every business or occupation conducted on any property within the M-I Planned Industrial District. 9266.3.1. METHOD OF MEASUREMENTS. In order to determine compliance with the requirements of this Title the standard instruments listed in this Section shall be used, except that suitable substi- tutes as determined by the Planning Commission may also be used. The initials listed before the particular instruments are symbols which -5- 1254 , . - -~ ~ will be used elsewhere in these regulations. The following devices and instruments designed to meet American Standards Association specifications shall be used: S.L.M. V.M. Sound Level Meter manufactured by general Radio Company Vibration Meter manufactured by General Radio Company 9266.3.2. MAXIMUM NOISE. The noise level from any activity shall not exceed at any point on or beyond any property line a maximum level of seventy decibels (70 db). No impact type sound shall exceed this value by an amount greater than ten decibels (10 db). If the M-l Planned Industrial District adjoins a resi- dentially zoned district, the maximum level at any point on or beyond the M-l P.I.D, boundary shall be reduced by ten decibels (10 db) from the value specified. In the determination of the meter reading the instan- taneous deflections at three to five (3 - 5) second intervals shall be read until a total of fifty (50) readings have been obtained. These fifty (50) readings shall be averaged to obtain the result. The readings shall be taken at the A, B, and C weighting positions. The reading falling within the range specified for the weighting network shall be used. If the noise is not smooth and continuous, the correc- tions in the following table shall be applied: CORRECTIONAL FACTORS Type of Operation or Character of Noise Correction in Decibels 1. Noise source operates less than 20% of anyone-hour period. 2. Noise of periodic character such as humming or screeching. 3. Nighttime operation between 8 p.m. and 7 a.m. plus 5 minus 5 minus 10 -6- 1254 T, . .. 9266.3.3. HUMIDITY. Every existing or proposed use, ac~ tivity or process or portion thereof producing humidity in the form of steam or moist air shall be carried on in such a manner that the humidity caused thereby is not perceptible at or beyond any property line. The presence of humidity in the form of steam or moist air within the boundaries of a property shall not in itself constitute a violation of this Section. 9266.3.4. HEAT. Every existing or proposed use, activity or process or portion thereof producing heat shall be carried on in such a manner that the heat caused thereby is not perceptible at or beyond any property line. The presence of heat as in the form of of heat waves within the boundaries of a property shall not in itself constitute a violation of this Section. 9266.3.5. GLARE. Every existing or proposed use, activity or process or portion thereof producing glare shall be shielded in such a manner that the glare is not perceptible at or beyond any property line. 9266.3.6. SMOKE. No existing or proposed use, activity or process or portion thereof shall from any source whatsoever dis- charge smoke or other particulate matter into the atmosphere. 9266.3.7. ODOR. No existing or proposed use, activity or process or portion thereof shall discharge from any source what- soever such quantities of odorous gases or other odorous matter which cause injury to the public or which endanger the comfort, re- pose, health and safety of any persons or which cause or have a natural tendency to cause injury or damage to business or property. No odor shall be permitted at or beyond any property line exceeding the lowest amount set forth in Table III "Odor Thresholds" and Table V of Chapter 13 of the Air Pollution Control Manual. For compounds not described in the Table, odor thresholds shall be es- tablished as described in Chapter 13 of the Air Pollution Control Manual, and no odor shall be permitted at or beyond any property line exceeding the amount determined by such method. -7- 1254 ,', , . 9266.3.8. DUST AND DIRT. No existing or proposed use, ac- tivity or process or portion thereof shall from any single or combined source of emission whatsoever discharge into the atmosphere dust, dirt or ash. 9266.3.9. VIBRATION. No existing or proposed use, activity or process or portion thereof shall cause or create a steady state or impact vibration on or beyond any property line with a vibration dis- placement by frequency bands in excess of that indicated in the Table below as measured by the V. M. ELECTRO-MAGNETIC DISTURBANCES. RADIATION. No existing or proposed use, activity or process or portion thereof shall produce electro-magnetic disturbances or radio-active emanations which interfere with normal radio or television reception in residential or commercial zones or which constitute a nuisance or hazard to adjacent properties. 9266.3.11. TOXIC OR NOXIOUS MATTER. No existing or pro- posed use, activity or process or portion thereof shall discharge from any source whatsoever such quantities of odorous gases or other odorous matter which would cause injury to the public or endanger the comfort, repose, health and safety of any persons or would cause or have a natural tendency to cause injury or damage to business or property. 9266.3.12. STATE PREEMPTION. If any superior law or regu- lation is expressly declared or judicially determined to have pre- empted the field of regulation or is stricter than any provision of this Division, such other superior law or regulation shall be con- trolling. -8- 1254 ~ SECTION 6. The City Clerk shall certify to the adoption of this ordinance.
