HomeMy WebLinkAbout1256 ~ ORDINANCE NO. 1256 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CAUFORNIA, AMENDING THE ARCADIA MUNICIPAL CODE BY AMENDING SECTIONS 51l0.l, 51l0.2, 5110.3, 5l20.l.1, 5120.2.1, 5120.2.2, 5120.3, 5120.6, 6220.43, 6324.17, 6434 AND 6434.1 THEREOF, BY ADDING TO CHAPTER 1 OF ARTICLE V NEW SECTIONS 5l10.1.1 AND 5l10.4, AND BY ADDING TO CHAPTER 4 OF ARTICLE VI A NEW SECTION 6434.2. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That Sections 5110.1, 5110.2, 5110.3, 5120.1.1, 5120.2.1, 5120.2.2, 5120.3, 5120.6,6220.43, 6324.l7, 6434and,6434.1 of the Arcadia Municipal Code are hereby amended to read respectively as follows: 5110.1. SAME. GARBAGE. Garbage shall mean and include every refuse accumulation of animal, fruit or vegetable matter that attends 'I the preparation, consumption, decay, dealing in or storage of meats, fish, fowls, fruits or vegetables, other than dry garbage. 5110.2. SAME. RESIDENTIAL COMBUSTIBLE REFUSE. Residential , ' combustible refuse shall mean and include all things capable of being burned, except garbage as hereinbefore defined but including wrapped garbage, which normally result from the possession, use or occupancy of residential establishments or premises, except furniture. Wrapped garbage shall mean garbage that is wrapped with paper of sufficient thickness and absorbency as to prevent leakage and with paper or dis- posable container of sufficient durability tied with string or wire of sufficient strength as to prevent spillage. 5110.3. SAME. RESIDENTIAL NONCOMBUSTIBLE REFUSE. ,Residential noncombustible refuse shall include tin cans, bottles, ashes and similar articles normally resulting from the use or occupancy of residential es- tablishments but shall not include building materials, rock, brick, stone, -1- 1256 ~ cement, plaster, soil, sod. automobile bodies and car parts, stoves, water heaters, washing machines, clothes dryers and other mechanical equipment. 5120.1.1. SAME. SAME. RESIDENCES. Weekly, at regular in- tervals, from any private dwelling house or residence and apartment houses containing less than ten (10) dwelling units, and semi-weekly from apartment houses containing ten (10) or more dwelling units. 5120.2.1. SAME. PLACE FOR COLLECTION. Every person desiring to have garbage collected from any hotel or place of business shall place such garbage vessel, can or receptacle within five (5) feet of the alley in the rear of such premises where there is an alley other than a blind alley; and if there be no alley other than a blind alley in the rear of such premises, then such vessel, can or receptacle shall be placed at some convenient location on the premises, to be designated by the collector. All garbage to be collected as provided in this Part shall be placed at the locations designated herein prior to the hours fixed for the collection of garbage. 5120.2.2. SAME. SIZE. Garbage vessels, cans or receptacles from which garbage is collected at any hotel or place of business shall be so constructed as to contain not less than three (3) nor more than thirty (30) gallons. 5l20.3. SEGREGATION. To be collected by the City or by any person under contract with the City, residential refuse shall be placed " in sturdy containers not exceeding a gross weight of sixty (60) pounds; provided, however, that shrubbery and tree trimmings may be securely tied in bundles not exceeding four (4) feet in length, sixty (60) pounds in weight and a cubic yard in content. 5120.6. PERMIT REQUIRED. No person shall collect or remove any rubbish or refuse from any premises in the City, nor convey the same upon or along any public street of the City without first having -2- 1256 obtained a permit so to do pursuant to Chapter 3 of Article VI; pro- vided, however, that the provisions of this Section shall not apply to any person in the employ of the City who shall be assigned to the work of garbage or refuse collection or disposal, nor to any person, firm or corporation having a contract with the City for the collec- tion or disposal of garbage or refuse with respect to the collection and disposal of garbage and refuse pursuant to such contract. 6220.43. PROFESSIONAL SERVICES. For every person engaged in any professional or semi-professional occupation, trade or craft, and persons primarily engaged in selling, performing or furnishing services other than commodities, including trades and crafts, and all other persons engaged in business, unless otherwise in this Part ex- pressly provided, an annual license tax computed as follows: Twelve dollars ($l2.00) plus Two dollars ($2.00) for each partner exceeding one partner, and Two dollars ($2.00) for each employee of said person actually employed in said business with the City. Employees engaged sOlely in rendering service to the City, either under contract or as employees, shall be excluded in computing the amount of fee due under this Section. In no event shall the maximum annual license tax exceed the sum of Two hundred dollars ($200.00). 6324.17. RUBBISH, REFUSE, GARBAGE AND DRY GARBAGE COLLECTION, HAULING OR REMOVAL. ',.. '6434: ..PERMIT REQUIRED. No person shall collect, haul or dispose of garbage} dry garbage, refuse or rubbish in the City without obtaining a permit so to do pursuant to Chapter 3 of this Article. 6434.1. REGULATIONS. No person collecting, hauling or disposing of garbage, dry garbage, refuse or rubbish in the City shall fail to comply with all applicable provisions of Chap~er 1 of Article V of this Code. -3- 1256 SECTION 2. That the Arcadia Municipal Code is hereby amended by adding to Chapter 1 of Article V new Sections 5110.1.1 and 5110.4, the same to read respectively as follows: 5l10.1.l. SAME. DRY GARBAGE. Dry garbage shall mean and include market greens and vegetable cuttings emanating from the wholesale or retail produce business. 5110.4. SAME. JUNK OR SALVAGE. Junk or salvage shall be deemed to mean and include any metal or metal scrap that is pur- chased for its salvage value, and paper and cardboard resulting from business establishments if the same is baled on the business premises by the owner or operator of such business. Refuse shall not include junk or salvage as thus defined. SECTION 3. That the Arcadia Municipal Code is hereby amend- ed by adding to Chapter 4 of Article VI a new Section 6434.2 to read as follows: 6434.2. LIMITATION. No more than five (5) permits for the collecting, hauling or disposing of garbage, dry garbage, refuse or rubbish in the City shall be in effect at anyone time. In granting permits, prefer~nce shall be given first to such applicants as shall have had a permit from the City for the period immediately preceding the period for which application is made, and then to applicants in the order of application. SECTION 4.
