HomeMy WebLinkAbout1275 ORDINANCE NO. 1275 AN ORDINANCE OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN THE CITY OF ARCADIA ON THE 2ND DAY OF FEBRUARY, 1965, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION TO AMEND ARTICLE XII OF THE ARCADIA CITY CHARTER, AND PARTIALLY CONSOLI- DATING SAID ELECTION WITH THE SPECIAL ELECTION OF THE ARCADIA UNIFIED SCHOOL DISTRICT TO BE HELD ON SAID DATE. ORDAIN AS FOLLOWS: THE CITY COUNCIL OF THE CITY OF ARCADIA, '\ CALIFORNIA, DOES SECTION I. That a special election be held, and the same is hereby called to be held, in the City of Arcadia, California, on the 2nd day of February, 1965, for the purpose of submitting to the quali- fied voters of said city a proposition to amend Section XII of the Arcadia City Charter as hereinafter more particularly set forth. SECTION 2. That the pOlls for said election shall be opened at seven o'clock, A.M., of the day of said election and shall remain open continuously from said time until seven o'clock, P.M., of the same day, when said polls shall be closed, except as provided in Section 14436 of the Elections Code of the State of California. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSSES (+) ON BALLOT ONLY WITH RUBBER STAMP: NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL. J - - - INSTRUCTION TO VOTERS To vote on any measure, stamp a cross (t) in the voting square after the word "YES" or after the word "NO". All marks, except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. On absent voter's ballots mark a cross (+J with pen or pencil. -1- 1275 PROPOSED ARCADIA CITY CHARTER AMENDMENT NO, 2: SHALL ARTICLE XII OF THE ARCADIA CITY CHARTER BE AMENDED TO READ AS FOLLOWS: ARTICLE XII BOARD OF EDUCATION SECTION 1200. The control, management and administration of the public schools of the City of Arcadia and the territory that is now or may hereafter be annexed thereto for school purposes, in accordance with the Constitution and general laws of the State of California, is hereby vested in a Board of Education consisting of five (5) members to be elected from the school district at large, and the said Board is hereby vested with all the powers and charged with all the duties provided by the laws of the State for city boards of education. SECTION 1201. The members of such board of education shall hold office for the term of four (4)'years, and until their successors are'elected and duly qualified, School board elections shall be held on, the third Tuesday of April of each odd numbered yea~ the first such election to be held in April, 1967, at which time three (3) members shali be elected; in April of 1969 two (2) members shall be elected, and thereafter three (3) and two (2) members shall be alternately elected. The members of such board of education elected and duly qualified prior to the April 1967 election shall continue in office for their respective terms of office and until their respective suc- cessors are elected and duly qualified as herein provided, The offi- cers of the election for members of 'the Board of Education shall be compensated for their services as provided by the general laws of the State governing school elections; such compensation and any other ex- pense incurred in the conduct of said election shall be a charge upon the School District and not upon the city. In the preparation of ballots for the election of members of the Board of Education, there shall be printed, stamped or written the name of each candidate for such office who has officially announced himself sixty days prior to the date of the election by filing or having filed with the Secretary of the Board of Education a written statement signed by him that he is a candidate for the office of mem- ber of the Board of Education, In all other matters the election for members of the Board of Education shall be governed by the general law of the State relating to the election of city Boards of Education. SECTION 1202. ,The members of the Board of Education shall enter upon the discharge' of their duties on the first Monday in July after their election, and the Board shall meet upon said day and annual- ly thereafter and organize by electing one of their number President and one of their number Vice-President, whose terms of office shall be one, year. They shall hold regular meetings at least once each month, at such time and place as may be ,determined by'their rules. Special meetings may be called by the President or by written request of any three members. A majority of the members shall constitute a quorum. The Board may determine the rules of its proceedings, and the ayes and noes shall be taken and recorded when demanded by any member, and en- tered on the records of the Board, Any vacancy occurring on the Board shall be filled by the remaining members of the Board, and if there be no members, then by the City Council. SECTION 1203. The Board of Education shall, at the first meeting in each school year, or at such other time as shall be fixed by resolution of the Board, appoint a secretary, who mayor may not be one of their own number, and shall prescribe the duties and fix the salary of such secretary. SECTION 1204. In all matters not specifically provided for in this Article, the Board shall be governed by the provisions of the general law relating to such matters, -2- YES NO 1275 SECTION 3. A cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore pro- vided shall be counted against the adoption of the proposition. SECTION 4. That for the purpose of holding said election there shall be and there are hereby established twenty~two (22) elec- tion precincts designated as hereinafter, stated. That the polling places for the respective precincts shall be the places hereinafter designated, and that the persons hereinafter named, being competent and qualified electors and residents of said City, and of their re- spective election precincts, are hereby appointed officers of elec- tion for their respective election precincts, and they shall hold said election and make return thereof in the manner provided by law: . That precincts I through 8 and 13 through 21 fully coinciding with precincts similarly numbered and established by the Ar- cadia Unified School District for its aforesaid special election to be held on said date, the special election hereby called and noticed shall be and is hereby ordered consolidated as to the said precincts here- tofore'specified in this Sectio~, pursuant to Section 23304 of the Elections Code. Pursuant to Section 23305 of the Elections Code, within the territory affected by such order of consolidation the election pre- cincts, polling places and voting booths shall, in every case, be the same and there shall be only one set of election officers in each of said precincts. The returns of the elections hereby consolidated be- ing required to be canvassed by different canvassing boards, the elec- tions shall be conducted separately in the same manner as if they had not been consolidated, except as provided in Chapter 4, Part 2, Divi- sion 12 of the Elections Code. Separate ballots shall be used in all precincts. SECTION 6. That the compensation of such persons hereinabove named as election officers as have been appointed election officers by said Arcadia Unified School District shall be the sum specified by said District as compensation for said officers and shall be paid by said District, and no additional compensation shall be paid by the City of Arcadia. That the compensation of all other persons hereinabove named as election officers is hereby fixed at the sum of Eighteen Dollars ($18.00) for each Clerk for said election. SECTION 7. That said general municipal election shall be held in accordance with the provisions of the City Charter of the City of Arcadia and in accordance with the provisions of the Elections Code of the State of California pertaining to General Law Cities insofar as the same are not in conflict with said City Charter. SECTION 8. That said City Council shall meet in the Council Chambers of the Arcadia City Hall on Tuesday, February 9, 1965, at the hour of 7:00 o'clock. P.M., to canvass the returns of said election and to declare the results thereof. -6- 1275 SECTION 9. The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published and notice of said election, the proposition to be voted upon and of other matters relating to said election to be given as required by the Elections Code of the State of California. That precincts 1 through 8 and 13 through 21 fully coinciding with precincts similarly numbered and established by the Ar- cadia Unified School District for its aforesaid special election to be held on said date, the special election hereby called and noticed shall be and is hereby ordered consolidated as to the said precincts here- tofore specified in this Section, pursuant to Section 23304 of the Elections Code. Pursuant to Section 23305 of the Elections Code, within the territory affected by such order of consolidation the election pre- cincts, polling places and voting booths shall, in every case, be the same and there shall be only one set of election officers in each of said precincts. The returns of the elections hereby consolidated be- ing required to be canvassed by different canvassing boards, ,the elec- tions shall be conducted separately in the same manner as if they had not been consolidated, except as provided in Chapter 4, Part 2, Divi- sion 12 of the Elections Code. Separate ballots shall be used in all precincts. SECTION 6, That the compensation of such persons hereinabove named as election officers as have been appointed election officers by said Arcadia Unified School District shall be the sum specified by said District as compensation for said officers and shall be paid by said District, and no additional compensation shall be paid by the City of Arcadia. That the compensation of all other persons hereinabove named as election officers is hereby fixed at the sum of Eighteen Dollars ($18.00) for each Clerk for said election. SECTION 7. That said general municipal election shall be held in accordance with the provisions of the City Charter of the City of Arcadia and in accordance with the provisions of the Elections Code of the State of California pertaining to General Law Cities insofar as the same are not in conflict with said City Charter. SECTION 8. That said City Council shall meet in the Council Chambers of the Arcadia City Hall on Tuesday, February 9, 1965, at the hour of 7:00 o'clock, P.M., to canvass the returns of said election and to declare the results thereof. -6- 1275 SECTION 9. The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published and notice of said election, the proposition to be voted upon and of other matters relating to said election to be given as required by the Elections Code of the state of California.
