HomeMy WebLinkAbout1276 ORDINANCE NO. 1276 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, VACATING AND ABANDONING A PORTION OF FOURTH AVENUE AND OF THE FIRST ALLEY SOUTH OF HUNTINGTON DRIVE IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND ORDAIN AS FOLLOWS: SECTION 1. That Resolution No. 3737 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION TO VACATE AND ABANDON A PORTION OF FOURTH AVENUE AND OF THE FIRST ALLEY SOUTH OF HUNTINGTON DRIVE, AND FIXING A TIME AND PLACE FOR THE HEARING OF OBJECTIONS TO SUCH PROPOSED VACATION AND ABANDONMENT", was duly and regularly adopted by the City Council of the City of Arcadia on November 17, 1964; that said Resolution, among other things, fixed the hour of 8:00 o'clock p..m. on the 15th day of December, 1964, in the Council Chamber of the Arcadia City Hall, 240 West Huntington Drive, Arcadia, California, as the time and place for hearing all per- sons interested in or objecting to the proposed vacation as therein outlined; that a copy thereof was duly and regularly published in the Arcadia Tribune, a newspaper of general circulation published and cir- culated in said City, as required by the Streets and Highways Code of the State of California, and that the property hereinafter described and proposed to be vacated was duly and regularly posted as required by the Streets and Highways Code of the State of California; that the affidavits of said publication and of said posting were duly filed with and are now on file with the City Clerk of the City of Arcadia; that on the 15th day of December, 1964, at the hour of 8:00 o'clock p.m., in the Council Chamber of the Arcadia City Hall, 240 West Huntington Drive, Arcadia, California, the City Council of the City of Arcadia did accept and receive all testimony offered in support of or in ob- jection to the said proposed vacation; that thereupon the said City, -1- 1276 Council found from evidence submitted that the property hereinbefore u~ed for street and alley purposes, and hereinafter particularly de- scribed is unnecessary for present or prospective street and alley pur- poses, and that the public welfare, convenience, necessity and safety require and will be better served by the vacation thereof as a public street and as an alley in said City. SECTION 2. That the City of Arcadia does therefore hereby order the vacation and abandonment of that property, heretofore a part of Fourth Avenue and of the First Alley South of Huntington Drive, in the City of Arcadia, County of Los Angeles, State of California, speci- fically described as follows: Parcell - That parcel of land deeded to the City of Arcadia for alley, street and highway purposes in deed recorded in Book 50303, Page 203, of Official Records of Los Angeles County, described as follows: The northeasterly 20 feet of the southwesterly 45 feet, measured at right angles to and radially from the southwesterly line of Lot 3, Tract No. 5205, per map recorded in Book 54, Page 61, of Maps in the office of the Recorder of Los Angeles County; Parcel 2 - That parcel of land deeded to the City of Arcadia for street and alley purposes in deed recorded in Book 55889, Page 400, of Official Records of Los Angeles County described as follows: The northeasterly 20 feet of the southwesterly 45 feet, measured at right angles to and radially from the southwesterly line of Lot 5, Tract No. 5205, per map recorded in Book 54, Page 61, of Maps in the office of the Recorder of Los Angeles County; and the northeasterly 20 feet of the southwesterly 65 feet, measured at right angles to and radially from the southwesterly line of said Lot 5, of the easterly 40 feet, measured at right angles to the easterly line of said Lot 5; Parcel 3 - That portion of Fourth Avenue dedicated for street purposes in Tract 8504 as shown on map recorded in Book 107, Page 56, of Maps in the office of the Recorder of Los Angeles County, lying southerly of the easterly prolongation of the southerly line of Lot 23 of said Tract 8504. SECTION 3.
