HomeMy WebLinkAbout1296 ORDINANCE NO. 1296 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING THE ANNEXATION TO SAID CITY OF THAT CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO SAID CITY DESCRIBED IN RESOLUTION NO. 3792 ADOPTED BY SAID CITY COUNCIL ON MAY 18 1965 AND DESIGNATED THEREIN AS ~ANNEXATION NO. 37, WEST ARCADIA UNINHABITED~. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Arcadia did on its own motion on May 18, 1965, adopt Resolution No. 3792 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GIVING NOTICE OF THE PROPOSED ANNEXATION OF CERTAIN CONTIGUOUS TERRITORY DESIGNATED AS 'ANNEXATION NO. 37, WEST ARCADIA UNINHABITED'," which resolution recited that the proceedings for the annexation of the territory hereinafter described were initiated on the said Council's own motion, and stated the reasons for which the said Council desires to annex said territory, and which reso- lution further specifically described the boundaries of the terri- tory sought to be included in said City, and fixed Tuesday, July 6, 1965, at the hour of 8:00 o'clock P.M. in the Council Chamber of the City Hall of said City, as the day, hour and place when and where the City Council would hear protests made by any person own- ing real property in such territory proposed to be annexed. SECTION~. That at a regular meeting of said City Council held on the 6th day of July, 1965, at the hour of 8:00 o'clock P.M. in the Council Chamber of said City Council in the Arcadia City Hall, 240 West Huntington Drive, Arcadia, said City Council did find and -1- 1296 determine that the publication of Resolution No. 3792 had been made at the time and in the manner required by Section 35311 of the Government Code of the State of California. That the annexation of said territory is not prohibited either by Section 35002.5 or by Section 35236 of the said Government Code. That the territory pro- posed to be annexed as described by said Resolution No. 3792 was and is uninhabited and is contiguous to the City of Arcadia. That written protest was not made either by private owners of one-half of the value of the privately owned territory proposed to be annexed or by public owners of one-half of the publicly owned territory proposed to be annexed. SECTION 3. That under and pursuant to and in accordance with the provisions of an act of the legislature of the State of California entitled "Annexation of Uninhabited Territory Act of 1939", the annexation to the City of Arcadia of that certain uninhabited territory contiguous to said City as described in Resolution No. 3792, adopted by said City Council ~f said City of May 18, 1965, and therein designated as "Annexation No. 37, West Arcadia Uninhabited", be and the same is hereby ratified, confirmed and approved. That a specific description of the boundaries of said territor,r, as submitted to and favorably reported upon by the Boundary Commission of Los Angeles County pursuant to Section 35002 of the California Government Code, is as follows: Beginning at an angle point in the boundary of the City of Arcadia, as it existed on December 24, 1964, said angle point being the intersection of the westerly prolongation of the northerly line of Lot 6, Block A, Santa Anita Land Company's Tract, as shown on map recorded in Book 6, Page 137 of Maps, in the office of the Recorder of Los Angeles County, said northerly line now being the center line of Naomi Avenue, 50 feet wide, and the center line of Golden West Avenue, 60 feet wide, as shown on map of said tract; thence easterly 245 feet along said boundary -2- 1296 to a line that is parallel with the easterly line of said Lot 6; thence southerly 227.5 feet along said parallel line; thence westerly 89 feet parallel with the northerly line of said Lot 6; thence northerly 102.5 feet parallel with the easterly line of'said Lot 6; thence westerly 50 feet parallel with the' northerly line of said Lot 6; thence northerly 7 feet parallel with the easterly line of said Lot 6; thence westerly 106 feet parallel with the northerly line of said Lot 6 to the center line of said Golden West Avenue; thence northerly 118 feet along said center line to the point of beginning. SECTION 4. The City Clerk shall certify to the adoption of this Ordinance and within fifteen (15) days after the date of adoption hereof shall cause a copy hereof to be published once in the Arcadia Tribune, and the City Clerk shall upon the taking effect of this Or- dinance, make and certify under the seal of the City of Arcadia and transmit to the Secretary of State of the State of California a copy of this Ordinance giving the date of its passage.
