ORDINANCE NO. 1222
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
AMENDING THE ARCADIA MUNICIPAL CODE
BY AMENDING SECTION 3214.1 THEREOF
AND ADDING THERETO NEW SECTIONS
3214.2 THROUGH 3214.13, AMENDING
AND AUGMENTING THE UNIFORr~ TRAFFIC
ORDINANCE BY PROHIBITING ALL NIGHT
STREET PARKING AND PROVIDING FOR
THE ISSUANCE OF TEMPORARY AND ANNUAL
ALL NIGHT STREET PARKING PERMITS.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. That Section 3214.1 of the Arcadia Municipal
Code and Section 11.9 added thereby to the Uniform Traffic Ordinance
1960 Edition are hereby amended to read as follows:
3214.1. SECTION 11.9 ADDED. Early Morning Parking Pro-

street between the hours of 30' clock a.m. and 4 0' clock a.m. of any
day.
SECTION 2. That Division 4 of Part 1 of Chapter 2 of
Article III of the Arcadia Municipal Code is hereby amended by add-
ing thereto Sections 3214.2 through 3214.13, thereby adding new Sec-
tions 11.10 through 11.21 to said Uniform Traffic Ordinance, the
same to read respectively as follows:
3214.2. SECTION 11.10 ADDED. Same. Exception. The pro-
visions of Section 11.9 shall not apply to emergency vehicles, nor
to a vehicle for which a temporary or annual all night street parking
permit, issued in accordance with this Article, is in effect.
3214.3. SECTION 11.11 ADDED. Annual All Night Street
Parking Permit. Application. Every person desiring an annual all
night street parking permit shall file with the City Treasurer a
written application therefor on a form to be furnished by the City.
Each such application shall set forth:

(a) The name and residence of the applicant;
(b) The license number, the make and the model of the
vehicle for which such permit is requested;
(c) A statement that there is no parking space available or
obtainable upon the property designated as applicant's residence.
(d) A statement that no parking space previously provided
or available upon ~he property designated as applicant's residence is
now used for any purpose other than for the parking of vehicles;
(e) The period of time for which such permit is requested;
(f) Such additional information as the City may require;
(g) A statement that applicant declares under penalty of
perjury that all statements in the application are true;
(h) The signature of the applicant.
3214.4. SECTION 11.12 ADDED. Same. Fee. To be acceptable
for filing, each such application shall be fully completed as required
by the preceding Section and shall be accompanied by the payment of a
permit fee in the amount of Twelve dollars ($12.00) to cover in part
the City's cost incurred in the enforcement of this Article. No por-
tion of any permit fee shall be refunded, whether the application is
granted or denied, or whether the permit issued thereunder is subse-
quently revoked or modified.
3214.5. SECTION 11.13 ADDED. Same. Same. Proration.
Such permit fee shall be reduced by Three dollars ($3.00) for each
full quarter of the calendar year that shall have already elapsed at
the time of filing of such application.
3214.6. SECTION 11.14 ADDED. Same. Issuance. Upon the
receipt of an application duly completed and executed in the form
prescribed by Section 11.11 accompanied by the payment of the fees
specified in Section 11.12, the City shall forthwith issue an all
night street parking permit in the form designated by the Chief of
Police, specifying the date of its expiration~

3214.7. SECTION 11.15 ADDED. Same. Duration. Annual all
night street parking permits shall be valid throughout the calendar
year of their issuance and shall expire at midnight on the last day
of such year, unless sooner revoked as hereinafter provided.
3214.8. SECTION 11.16 ADDED. Same. Filing. After issuance
of an all night street parking permit, the application therefor shall
be filed with the Police Department. Prior to such filing the City
Treasurer shall endorse upon each application the date that a permit
was issued thereunder and the serial number thereof.
3214.9. SECTION 11.17 ADDED. Same. Investigation. Upon
the filing with the Police Department of an all night street parking
permit application, the Chief of police shall cause to be made such
investigation thereof as he deems necessary or advisable.
3214.10. SECTION 11.18 ADDED. Same. Revocation. Upon
receipt of information from any source that any material statement
in an application for an all night street parking permit was untrue
or is no longer true, the Chief of Police shall order the person to
whom a permit was thus issued to appear and show cause why such per-
mit should not be revoked. Such order may be served upon the permittee
either personally or by mail, and shall be thus served at least five
(5) full days prior to the date upon which such person is thus ordered
to appear. If from the evidence on hand at such time the Chief of
Police determines that one or more material statements in an applica-
tion for an all night street parking permit was or is untrue, he shall
revoke the permit issued pursuant to such application. Any permit
thus revoked shall be of no further force or effect whatsoever.
3214.11. SECTION 11.19 ADDED. Same. Display. No annual
all night street parking permit issued under this Article shall be
effective at any time when the same is not affixed to the left side
window to the rear of the driver's compartment of the vehicle for
which it war issued, or if there be no such side window then in the
lower right hand portion of the windshield of such vehicle.

3214.12. SECTION 11.20 ADDED. Same. Transfer. Upon the
acquisition by an all night street parking permittee of a new vehicle
and the sale or disposal of the vehicle for which an all night street
parking permit had been obtained and is still in effect, such person
may apply for and obtain a new permit for such new vehicle. Applica-
tion for such new permit shall be made to the City Treasurer on a
form provided by the City, and shall be accompanied by the payment of
a transfer fee of One dollar ($1.00). No other permit fee shall be
required, and the permit shall be only for the unexpired portion of
the calendar year. Upon issuance of a new permit under this Section,
the permit previously issued for applicant's car that was sold or dis-
posed of shall be deemed revoked and shall be of no further force and
effect, and prior to the issuance of such new permit the City may re-
quire the applicant therefor to submit satisfactory evidence that
such former permit has been destroyed or will no longer be used.
3214.13. SECTION 11.21 ADDED. Temporary All Night Street
Parking Permit. Notwithstanding the preceding Sections of this Arti-
cle, the Chief of Police or an on duty Watch Commander of the Police
Department for good cause may, upon oral or written application,
grant temporary permission for the parking of a vehicle contrary to
Section 11.9 for a period of time not to exceed fifteen (15) days.
No fee shall be due or payable for any such permit, and the decision
of the Police Chief or Watch Commander shall be final in each case.
Any such permit shall be in the form and shall be displayed in the
manner specified by the Chief of Police.
SECTION 3. The City Clerk shall certify to the adoption of
this ordinance.

Ordinance is hereby adopted pursuant ,to Section' 65806 of: 'the California
Government Code' and i~ hereby declared by the City Council to be necessary
as an emergency measure for preserving the p~blic peace, health and
safety, and shall take effect immediately upon its adoption. The state-
