HomeMy WebLinkAbout1238 ORDINANCE NO. 1238 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING CHAPTER 2 OF ARTICLE IX OF THE ARCADIA MUNICIPAL CODE BY REPEALING SECTION 9282.1 THEREOF AND AMENDING SECTIONS 9251.2.1, 9252.2.1, 9253.2.1, 9254.2.1, 9255.2.1, 9261.2.1, 9262.2.1, 9263.2.1, 9264.2.1, 9265.2.1, 9266.2.l~ 9267.2.1, 9282.1.1, 9282.1.2 and 9282.1.3 THEREOF, THEREBY REDUCING THE HEIGHT OF BUILDINGS TO TWO STORIES OR 35 FEET IN ALL RESIDENTIAL ZONES AND TO THREE STORIES OR 35 FEET IN ALL COMMERCIAL AND INDUSTRIAL ZONES EXCEPT BUILDINGS IN ZONE H - SPECIAL HEIGHT ZONE. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That Section 9282.1 of the Arcadia Municipal Code is hereby repealed. SECTION 2. That Sections 9251.2.1, 9252.2.1, 9253.2.1, 9254.2.1, 9255.2.1, 9261.2.1, 9262.2.1, 9263.2.1, 9264.2.1, 9265.2.1, 9266.2.1, 9267.2.1, 9282.1.1, 9282.1.2 and 9282.1.3 of the Arcadia Municipal Code are hereby amended to read respectively as follows: 9251.2.1. BUILDING HEIGHT., No building hereafter erected, constructed or established shall exceed two (2) stories or thirty- five (35) feet in height except as provided in Division 6 of Part 7 or in Division 2 of Part 8 of this Chapter. 9252.2.1. BUILDING HEIGHT. No building hereafter erected, constructed or established shall exceed two (2) stories or thirty- five (35) feet in height except as provided in Division 6 of Part 7 or in Division 2 of Part 8 of this Chapter. 9253.2.1. BUILDING HEIGHT. No building hereafter erected, constructed or established shall exceed two (2) stories or thirty- five (35) feet in height except as provided in Division 6 of Part 7 or in D1vision 2 of Part 8 of this Chapter. -1- 1238 9254.2.1. BUILDING HEIGHT. No building hereafter erected, constructed or established shall exceed two (2) stories or thirty- five (35) feet in height, and no portion of any building within one , hundred (100) feet of the front lot line shall exceed one (1) story in height, except as provided in Division 6 of Part 7 or in Division 2 of Part 8 of this Chapter. 9255.2;1; BUILDING HEIGHT. No building hereafter erected, constructed or established shall exceed two (2) stories, or thirty- five (35) feet in height except as provided in Division 6 of Part 7 or in Division 2 of Part 8 of this Chapter. A basement designed or used to provide only required parking space, laundry rooms, storage rooms and other incidental purposes other than living quarters, shall not constitute a story if no portion of the surface of the floor next above such basement, or if there be no floor above it then if the ceiling next above it, is more' than two (2) feet above the top of the street curb at any point adjacent to the lot, or if there be no curb in the street adjacent thereto, then more than two (2) feet above the established grade of the center line of the street at any point adjacent to the lot. Beyond one hundred (100) feet from the front property line the two (2) feet may be above the approved finished grade. 9261.2.1. BUILDING HEIGHT. No building hereafter erected, constructed or established shall exceed three (3) stories or thirty- five (35) feet in height, except as provided in Division 6 of Part 7 or in Division 2 of Part 8 of this Chapter. 9262.2.1. BUILDING HEIGHT. No building hereafter erected, constructed or established shall exceed three (3) stories or thirty- five (35) feet in height, except as provided in Division 6 of Part 7 or in Division 2 of Part 8 of this Chapter. 9263.2.1. BUILDING HEIGHT. No building hereafter erected, constructed or established shall exceed three (3) stories or thirty- five (35) feet in height, except as provided in Division 6 of Part 7 or in Division 2 of Part 8 of this Chapter. -2- 1238 9264.2.1. BUILDING HEIGHT. No building hereafter erected, constructed or established shall exceed three (3) stories or thirty- five (35) feet in height, except as provided in Division 6 of Part 7 or in Division 2 of Part 8 of this Chapter. 9265.2.1. BUILDING HEIGHT. No building hereafter erected, constructed or established shall exceed three (3) stories or thirty- five (35) feet in,height, except as provided in Division 6 of Part 7 or in Division 20f Part 8 of this Chapter. 9266.2:1. BUILDING HEIGHT. No building hereafter erected, constructed or established shall exceed three (3) stories or thirty- five (35) feet in height, except as provided in Division 6 of Part 7 or in Division 2 of Part 8 of this Chapter. 9267.2.1. BUILDING HEIGHT. No building hereafter erected, constructed or, established shall exceed three (3) stories or thirty- five (35) feet in height, except as provided in Division 6 of Part 7 or in Division 2 of Part 8 of this Chapter. 9282.1.1. PUBLIC BUILDINGS. Public buildings may be erected to a height not exceeding four (4) stories or forty-five (45) feet when the required front, side and rear yards are increased an additional one (1) foot for each one (1) foot in height such build- ings exceed thirty-five (35) feet. 9282.1.2. THROUGH LOTS. On through lots one hundred and fifty (150) feet or less in depth, the height of a building may be measured from the adjoining sidewalk lev~l on either street. On through lots more than one hundred and fifty (150) feet in depth, the height regulations and basis of height measurements for the street permitting the greater height shall apply to a depth of not more than one hundred and fifty (150) feet from such street. 9282.1.3. ROOF STRUCTURES. Penthouses or roof structures for the housing of elevators, stairways, tanks, ventilating fans or similar equipment required to operate and maintain the buildings, and fire or parapet walls, skylIghts, towers, roof signs except in the -3- 1238 ,< c-o and C-l Zones, flagpoles, chimneys, smokestacks, wireless masts or similar structures may be erected above the height limits herein prescribed, but no penthouses or roof structures or any space above the height limit shall be allowed for the purpose of providing addi- t10nll floor space. SECTION 3. The City Clerk shall certify to the adoption of this ordinance and shall cause it to be published once in the official newspaper.
