CALIFORNIA, PROHIBITING THE ERECTION, ALTERATION OR MOVING IN,OF BUILDINGS OR STRUCTURES AND RESTRICTING THE COMMENCEMENT OF Nffi.J USES IN,.A PORTION OF THE CITY OF ARCADIA. THE, CITY COUNCIL, OF THE CITY ,'OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: . ;1 , SECTION 1. No bU,ilding or structure shall be erected nor 'II shall any existing building or structure be moved into, reconstructed, Ii. structurally'altered, adde~ to or enla:ged, nor shall any permit be issued for any of the ,foregoing, as to any lot or parcel of ground " within the following described area, to wit: " . Parcel 1. That portion of the City of Arcadia bounded and described as follows: Commencing at the inte~section of the easterly line of Santa Anita Avenue with the southerly line of Floral Avenue; thence southeasterly in a direct line to a point in the weste'rly line of Fifth Ave- nue, which is 860 feet north of the northerly line of Huntington Drive; thence i~outherly along the westerly line of Fifth Avenue to i,ts intersection with'the northerly line of the Atchison, Topeka and Santa Fe Railroad right-of-way; ,thence northwesterly along said right-of-way to the southerly line of . Huntington Drive; thence westerly' along said southerly line to the westerly line of Second Avenue; thence southerly along said "westerly line to the northerly line of Alta Street; thence westerly along the northerly line of said street to a point that is 235 feet, easterly of the easterly line of First ,Avenue; thence southerly pa~allel with First Avenue to the northerly line of Diamond street; thence westerly along the northerly line of Diamond Street to the westerly line, of Fir~t Avenue; .thence , northerly along 'said westerly line to the northerly line of California Street; thence westerly along said northerly line 241.69 feet; thence northerly, parallel with said'First Avenue to the northerly line of Alta street; thence, westerly along said northerly line to the easterly line ef Santa Anita Avenue; thence northerly along the last mentioned line to the point of beginning. That portion of the City of Arcadia bounded and described as follows: ' Commencing at the inter~ection of the westerly line,of Santa Anita Avenue and the northerly line of Hunting~on Drive; thence westerly along the northerly line .of HuntingtonDrive to the north- westerly line of the former Pacific Electric Rail- way right-of-way, 60 feet wi~e; .thence northeaster- ly along the last mentioned northwesterly line to the easterly line of Tract No. 15337; thence northerly along said easterly line of said Tract No. 15337 to the southerly line of Colorado Boule- vard; thence easterly along the southerly line of CploradoB9ulevard: to the ,westerly lin~ of Sa~ta Anita Avenue; thence 'southerly along the westerly . Notwithstanding the provisions of the pre- ceding Section, the City Council may, by a vote of four-fifths . I of its membership entered upon the Council min~tes, authorize " the issuance of a building permit for any ,building or structure I, within that portion of the City described in Section 1 with respect to which the City Counci], has approved, either as on file , . or as may be hereafter amended, that certain Planning Study entitled IlA Preliminary Report on ,the 'Central' Area Plan for the City of A~cadia, Californiall dated FeJ:jruary 1963 and on file in the office of the City Clerk, if in the opinion of the City Council .1 -. such building or structure conforms with the criteria and uses " proposed for the area thus approved by the Council. SECTION 3. No certificate of occupancy shall be issued under the Building Code for any use of land or buildings within the area described in Section 1 hereinbefore other than for the same use for which such land or building h~s been used for a period of at least three (3)' ,consecutive months. during the six (6) months period immediately preceding the issuance of such certificate of occupancy. This Section shall not preclude the issuance by the I. , Division of Building and Safety of an' occupancy permit for a -2- 1242 building constructed or remodeled pursu'ant to a permit issued " o. by the Division of Buildin'g and Safety 'after March 19, 1963, for , ,I' any use contemplated by or specified in such permit. SECTION 4. Notwithstanding the provisions of the ,I' ' preceding Section, the City Council may, by a four-fifths vote of its membership entered upon the Council minutes, authorize the issuance of a certificate of occupancy;for any use of any portion of the property described in Section l~which in its opinion con-;- forms to the criteria and uses proposed for such property in that certain Planning Study entitled "A Pretiminary Report on the Central Area Plan for the City of Arcadia, California, dated February 1963 and on file in the office of the City 9lerk. Likewise by a four- fifths vote of its membership entered upon the Council minutes, the City Council may authorize the issuance of a certificate of occupancy for any conforming use of an existing building or structure within the area described in Section 1; upon such terms and con- It. ditions, including the making 'of minor, alterations, as the Council , . This ordinance ~s adopted pursuant to Sections 8 and 11 of Article XI of the Califor~ia Constitution and Sections 290 and 412, of the Arcadia City Charter, and is hereby declared by the City Council to be,necessary as ar emergency measure for pre- I' serving the public peace, health and safety and shall take effect II' . immediately upon its adoption. A statement of the reasons for its II urgency is as follows: For 'nearly two (2) years the City Council, " City Planning Commission, City Plann~~g Department, City Staff, , technical advisors and property owners have been engaged in studies concerning the property described in 'Section 1 and in studies and -3- 1242 proceedings for the adoption of a Cent~al Area Plan and the amend- ment, of the zoning ordinance and other related provisions of the Municipal Code and in studies and proceedings prel~inary to the " possible reclassification of portions of the above described property.
