HomeMy WebLinkAbout1151 ORDINANCE NO. 1151 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING THE ANNEXATION TO SAID CITY OF THAT CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO SAID CITY DESCRIBED IN RESOLUTION NO. 3410 ADOPTED BY SAID CITY COUNCIL ON SEPTEMBER 5, 1961, AND DESIGNATED THEREIN AS "ANNEXATION NO. 26, WEST ARCADIA UNINHABITED." THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND ORDAIN AS :fOLLOWS: SECTION 1. That the City Council of the City of Arcadia \. on September 5, 1961, adopt Resolution No. did on its own motion 3410 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GIVING NOTICE OF THE PROPOSED ANNEXATION OF CERTAIN CONTIGUOUS TERRITORY DESIGNATED AS 'ANNEXATION NO. 26, WEST ARCADIA UNINHABITED''', which resolution recited that the proceed- -< ings for the annexation of the territory hereinafter described were initiated on the said Council's own motion, and stated the reasons for which the said Council desires to annex said territory, and which resolution further specifically described the boundaries of the territory sought to be included in said City, and fixed Tues- day, October 17, 1961, at the hour of 8:00 o'clock P.M. in the Council Chamber of the City Hall of said City, as the day, hour and place when and where the City Council would hear protests made by any person owning real property in such territory proposed to be annexed. SECTION 2. That at a regular meeting of said City Coun- '/cil held on the 17th day of October, 1961, at the hour of 8:00 \ o'clock P.M. in the Council Chamber of said City Council in the Arcadia City Hall, 240 West Huntington Drive, Arcadia, said City Council did find and determine that the publication of Resolution -1- 1151 No. 3410 had been made at the time and in the manner required by Section 35311 of the Government Code of the State of California. That the annexation of said territory is not prohibited either by Section 35002.5 or by Section 35326 of the said Government Code. That the territory proposed to be annexed as described by said Resolution No. 3410 was and is uninhabited and is contiguous to the City of Arcadia. That written protest was not made either by private owners of one-half of the value of the privately owned territory proposed to be annexed or by public owners of one-half of the publicly owned territory proposed to be annexed. SECTION 3. That under and pursuant to and in accordance with the provisions of an act of the legislatu~e of the State of California entitled "Annexation of Uninhabited Territory Act of 1939", the annexation to the City of Arcadia of that certain unin- habited territory contiguous to said City as described in Resolu- tion No. 3410, adopted by said City Council of said City on Sep- tember 5, 1961, and therein designated as "Annexation No. 26, West Arcadia Uninhabited", be and the same is hereby ratified, confirmed and approved. That a specific description of the boundaries of said territory, as submitted to and favorably reported upon by the Boundary Commission of Los Angeles County pursuant to Section 35002 of the California Government Code, is as follows: -2- 1151 "ANNEXATION NO. 26, WEST ARCADIA UNINHABITED" TO THE CITY OF ARCADIA Beginning in the northeast corner of Lot 1, Tract No. 10815, as shown on map recorded in Book 188, pages 7 and 8, of Maps in the office of the Recorder of Los Angeles County, said point also being in the westerly boundary of the City of Arcadia as same existed on July 10, 1961; thence southerly along said boundary to an angle point in said boundary in Duarte Road as shown on said map; thence westerly along said boundary in Duarte Road 134.92 feet more or less to the intersection with the southerly prolongation of the westerly line of said Lot 1; thence northerly along said prolongation and along said westerly line to the northwest corner of said Lot 1; thence easterly along the northerly line of said lot to the point of beginning. The City Clerk shall certify to the adoption of this Ordinance and within fifteen (15) days after the date of adoption hereof shall cause a copy hereof to be published once in the Arcadia Tribune, and the City Clerk shall upon the taking effect of this Ordinance, make and certify under the seal of the City of Arcadia and transmit to the Secretary of State of the State of Cali- fornia a copy of this Ordinance giving the date of its passage.
