HomeMy WebLinkAbout1152 ORDINANCE NO. 1152 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ESTABLISHING THE REAL PROPERTY WITHIN THE LIMITS OF PROPOSED "ANNEXATION NO. 26, WEST ARCADIA UNINHABITED" IN ZONES R-3 AND D (ARCHITECTURAL OVERLAY) AND AMENDING THE ARCADIA MUNICIPAL CODE ACCORDINGLY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That after proceedings duly instituted and public hearings duly held by and before the City Planning Commis- sion and the City Council of the City of Arcadia, concurrent with the proceedings for the annexation to the City of Arcadia of the te~ritory hereinafter described and after due notice as required by law, this Council hereby determines that the property herein- after described, comprising "Annexation No. 26, West Arcadia Unin- habited", in the County of Los Angeles, State of California, to wit: Beginning in the northeast corner of Lot 1, Tract No. 10815, as shown on map recorded in Book 188, pages 7 and 8, of Maps in the office of the Recorder of Los Angeles County, said point also being in the westerly boundary of the City of Arcadia as same existed on July 10, 1961; thence southerly along said boundary to an angle point in said ~oundary in Duarte Road as shown on said map; thence westerly along said boundary in Duarte Road 134.92 feet more or less to the intersection with the southerly prolongation of the westerly line of said Lot 1; thence northerly along said prolongation and along said westerly line to the northwest corner of said Lot 1; thence easterly along the northerly line of said lot to the point of beginning, should be and the same is hereby classified and established in Zone I R-3 and also in Zone D (Architectural Overlay), and from and after -1- 1152 the effective date of this ordinance said real property shall be zoned and established as a district in Zone R-3 and Zone D (Archi- tectural Overlay) under the provisions of the Zoning Ordinance, and concurrent with the effective date of the annexation of said territory to the City of Arcadia, the Zoning Map and the map con- tained in Section 9233.12 of the Arcadia Municipal Code shall be Ct!C,M'J &->:;t;f; cr-" amended to classify and designate 'the above described property as a district in Zone R-3 and also in Zone D (Architectural Overlay). SECTION 2. The City Clerk shall certify to the adoption of this Ordinance. SECTION 2. This ordinance is adopted pursuant to Section 65806 of the Government Code of the State of California and Divi- sion 4 of Part 9 of Section 2 of Article IX of the Arcadia Munici- pal Code and is hereby declared to be an emergency measure neces- sary for the immediate preservation and protection of public health, safety and welfare and shall take effect immediately upon its adop- tion. The facts constituting the emergency are hereby declared to be as follows: The property hereinabove described has been or is being annexed to the City of Arcadia. Under Section 9232.6 of said Code, the foregoing property will automatically be classified as Zone R-l upon annexation. The classification to Zone R-l of the property hereinabove described is impractical and will preclude the proper development and use of said property and such classifi- cation would be contrary to the facts and circumstances concerning said property. It is therefore necessary that this ordinance take effect immediately upon its adoption. SECTION 3. The City Clerk shall certify to the adoption of this Ordinance.
