HomeMy WebLinkAbout1179 ORDINANCE NO. 1179 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ADOPTING A TEMPORARY INTERIM ZONING ORDINANCE AMENDING SECTION 9255.2.8 OF THE ARCADIA MUNICIPAL CODE CONCERNING REQUIRED PARKING SPACES IN ZONE R-3. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 9255.2.8 of the Arcadia Munici- pal Code is hereby amended to read as follows: 9255.2.8. PARKING REQUIREMENTS. At least two (2) park- ing spaces, one of which shall be in a roofed carport or garage, shall be provided on the same site for each dwelling unit. Each such parking space shall be located back of the required front yard and shall be paved with asphaltic or cement concrete. Each such parking space shall contain a gross area not less than ten (10) feet wide and twenty (20) feet long, and shall have adequate indi- vidual access including a turning radius of not less than twenty- five (25) feet. No portion of a required driveway may be used to fulfill any such parking space requirements. SECTION 2. That the City Planning Commission in good faith has held a hearing and has recommended to this legislative body the adoption of a zoning amendment increasing the amount of, parking space required in Zone R-3 under the Zoning Ordinance of the City as hereinbefore set forth. To protect the public safety, health and welfare, this legislative body does hereby adopt the within temporary interim zoning ordinance as an urgency measure pursuant to Section 65806 of the California Government Code, and this ordinance shall take effect immediately upon its adoption. -1- 1179 A statement of the reasons for its urgency is as follows: Staff studies conducted over a period of time indicate clearly that the City's off-street parking requirements are considerably inadequate and that the situation is steadily worsening. That the failure to anticipate, recognize and deal with the ever growing problem of the increasing number of vehicles in the City has necessitated the re- moval of the much-needed ban on all night parking and will make its re-enactment more difficult, and has added immeasurably to the hazard of pedestrians who are required in most instances to walk in the street in multi-family zones and to the hazard of vehicular traffic by reason of the excessive street parking of vehicles due to inade- quacy of off-street parking in multiple family areas. That in an- ticipation of the enactment of legislation increasing the amount of off-street parking in the multiple family zone, plans for hundreds of multiple family dwelling units have been hastily drawn or copied from plans designed for other building sites without any attempt to adapt the same to the building site now proposed therefor} for the obvious and sole purpose of obtaining building permits for multiple family housing without providing the amount of off-st~eet parking deemed to be necessary. That the issuance of an unseasonal number of permits for and the construction of an unusual number of multiple family dwelling units will create an equal number of buildings soon to become non-conforming, and will greatly and ir- revocably increase the traffic hazard to both pedestrians and vehicles from the increased congestion necessarily resulting from such construction without the provision of sufficient off-street parking, all to the impairment or jeopardy of the public peace, health and safety. It is therefore necessary that this ordinance take effect immediately upon its adoption. -2- 1179 SECTION 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause it to be published once in the official newspaper.
