HomeMy WebLinkAbout1180 ORDINANCE NO. 1180 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, PROHIBITING THE ISSUANCE OF BUILDING PERMITS EXCEPT IN ACCORDANCE WITH INCREASED OFF~STREET PARKING STANDARDS. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND ORDAIN AS FOLLOWS: SECTION 1. No building permit shall hereafter be issued for the construction of any multiple family dwelling unit or units unless the plans for such multiple family dwelling unit or units provide for at least two (2) parking spaces per dwelling unit as provided in Ordinance No. 1178 of the City of Arcadia. SECTION 2. This ordinance is hereby declared to be neces- sary as an emergency measure for preserving the public peace, health and safety and shall take effect immediately upon its adoption. A statement of the reasons for its urgency is as follows: Staff studies conducted over a period of time indicate clearly that the City's off- street parking requirements are considerably inadequate and that the situation is steadily worsening. That the failure to anticipate, recognize and deal with the ever growing problem of the increasing number of vehicles in the City has necessitated the removal of the much-needed ban on all night parking and will make its re-enactment more difficult, and has added immeasurably to the hazard of pedes- trians who are required in most instances to walk in the street in multi-family zones and to the hazard of vehicular traffic by reason of the excessive street parking of vehicles due to inadequacy of off-street parking in multiple family areas. That in anticipation of the enactment of legislation increasing the amount of off-street parking in the multiple family zone, plans for hundreds of multiple family dwelling units have been hastily drawn or copied from plans designed for other building sites without any attempt to adapt the -1- 1180 same to the building site now proposed therefor, for the obvious and sole purpose of obtaining building permits for multiple family hous- ing without providing the amount of off-street parking deemed to be necessary. That the issuance of an unseasonal number of permits for and the construction of an unusual number of multiple family dwell- ing units will create an equal number of buildings soon to become non-conforming, and will greatly and irrevocably increase the traf- fic hazard to both pedestrians and vehicles from the increased con- gestion necessarily resulting from such construction without the provision of sufficient off-street parking, all to t~e impairment or d jeopardy of the public peace, health and safety. It is therefore necessary that this ordinance take effect immediately upon its adop- tion. If for any reason it be judicially determined that this ordi- nance not take effect upon its adoption, it shall take effect thirty (30) days after its adoption occurring not less than five (5) days after its introduction. SECTION 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause it to be published once in the official newspaper.
