ORDINANCE NO. 1187
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
AMENDING SECTIONS 4113, 4113.6, 4124.1,
4124.1.3, 4124.2.3, 4124.3.1, 4125.6,
4125.11.1, and 4133.1 OF THE ARCADIA
MUNICIPAL CODE, REPEALING SECTION
4124.1.5, THEREOF,AND ADDING NEW SEC-
TIONS 4133.8, 4136.6, 4136.6.1, '
4136.6.2 AND 4136.6.3 THERETO.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:
SECTION 1. That Sections 4113, 4113.6, 4124.1, 4124.1.3,
4124.2.3, 4124.3.1, 4125.6, 4125.11.1, and 4133.1, of the Arcadia
Municipal Code are hereby amended to read respectively as follows;
4113. CAPTURE OF ANIMALS. The Poundmaster shall capture
and take into custody all:
(1) Unlicensed dogs;
(2) Dogs and other animals running at large contrary to
the provisions of the State Agricultural Code or any other state
statute or of Part 2 of this Chapter;
(3) Sick, injured, stray, unwanted, or abandoned animals;
(4) Dogs which are unvaccinated in violation of Part 2
of this Chapter;
(5) Animals delivered by the owners to the Poundmaster,
all title and interest in which is abandoned by such owners;
(6) Animals for which the owner or custodian is unable
to care because of imprisonment, illness, bankruptcy, litigation,
or other contingency, or in cases in which the owner or custodian
cannot be found.
4113.6. INSPECTIONS. For the purpose of discharging
the duties imposed upon him by this Part,the Poundmaster, each
Poundkeeper and each person authorized under the provisions of this-
Part to enforce the provisions hereof and to take up and impound any
unlicensed dog and any unvaccinated dog required by this Part to be
vaccinated, shall enter upon any premises upon which any dog is

kept or harbored or upon which he has reason to believe any dog is
kept or harbored and demand the exhibition by the person owning or
having charge or control of any such dog, of the dog, the required
rabies vaccination certificate and the license or license tag for
such dog for the current year provided by Part 2 of this Chapter.
No person upon whom any demand is made under authority of this Part
for the exhibition of any dog, and required rabies vaccination
certificate, or any dog license or tag shall fail or refuse to
exhibit the same if he has it in his possession.
4124.1 LICENSE REQUIRED. No person shall have, harbor
or keep, or cause or permit to be harbored or kept, any unlicensed
dog over four (4) months of age.
4124.1.3 VACCINATION CERTIFICATE. The Poundmaster shall
not issue a license unless the applicant exhibits a certificate
signed by a veterinarian licensed either by the State or by any other
state to practice veterinary medicine that:
(l) Such dog has been vaccinated with phenolized tissue
vaccine less than six (6) months prior to date of applicat10n or the
first day of the license period, whichever is later, or
(2) Such dog has been vaccinated with chick embryo vac-
cine less than eighteen (18) months prior to date of application or
the first day of the license period whichever is later, or
(3) Such dog, should not be vaccinated with rabies vaccine
because such vacc1nation would jeopardize the health of such dog due
to infirmity or,other disability, which infirmity or other disability
and the estimated date of termination thereof is shown on the face
of the certificate to the satisfaction of the Poundmaster.
4124.2.3 SAME. EXCEPTIONS. Every person owning or
having custody or control of a dog over the age of four (4) months,
which has been honorably discharged from the armed forces of the

United states, or a dog owned by a blind person, who submits proof
to the Poundmaster that such dog has been successfully trained to
lead the blind person as a guide dog, for which a dog license tag
was not issued prior to July 1, 1959, shall procure a dog license
tag and a license, which dog license tag and license shall be good
while such dog is owned or harbored by the same person. No fee
shall be charged for such license over and above the One Dollar
($1.00) required for the dog license tag.
4124.3.1 REPLACEMENT. If any license tag for an indivi-
dual dog is lost or destroyed, a duplicate thereof may be procured
from the Poundmaster upon the submission to the Poundmaster of such
proof as he may require and upon the payment therefor of the sum
of One Dollar ($1.00).
4125.6 SAME. DISPOSAL. Not less than five (5) days
after the taking up and impcunding of any dog as herein provided,
unless it be sooner redeemed, such person or association in charge
of any such pound shall destroy such dog or shall dispose of such
dog to any person who will pay the reasonable value of such dog, in
no case less than Seven Dollars ($7.00), if the dog has been vacci-
nated while in the care of the Poundmaster, otherwise Four Dollars
($4.00), and who will procure and pay for the required license for
such dog for the current year unless such a license is already
issued and in full force and effect.
4125.11.1 SAME. IMPOUNDING. For the redeeming of any
impounded dog, three dollars and fifty cents ($3.50); for vaccina-
tion by the Livestock Inspector if he has vaccinated such dog, three
dollars ($3.00); for feeding and caring for any such dog, twenty-
five cents (25/) for each day or fraction thereof curing which dog
is kept in such pound except the day on which it is impounded,
shall be collected.

4133.1 CATS. For the redeeming of any impounded cat,
the Poundmaster or Poundkeeper shall charge One dollar ($1.00),
and for feeding and caring for such cat, twenty-five cents (25t)
for each day or fraction thereof during which such cat is kept in
such pound except the day on which it is impounded.
SECTION 2. That Section 4124.1.5 of the Arcadia Muni-
cipal Code is hereby repealed.
SECTION 3. That new Sections numbered 4133.8, 4136.6,
4136.6.1, 4136.6.2 and 4136.6.3 are hereby added to Division 6 of
Part 3 of Chapter 1 of Article IV of the Arcadia Municipal Code,
the same to read respectively as follows:
4133.8 DISPOSAL. Except where it is otherwise provided
by this Code or any statute, 1f the owner or person entitled to the
possession of any animal impounded by the poundmaster or a pound-
keeper does not redeem such animal within thirty days of such
impounding, the poundmaster or poundkeeper may destroy or sell such
animal, or may give such animal to any governmental entity.
4136.6. IMPROPER ACTIVITY. No person shall do any act
specified in any of the following Subsections.
4136.6.1. SAME. MIMIMUM AGE.
(1) Sell, offer for sale, barter, or give away, as pets,
toys, premi~ms, or novelties, any baby chickens, ducklings or other
fowl under three weeks of age, or any rabbits under two months of
age, or br1ng any fowl or rabbits into the City for any such purpose.
4136.6.2. SAME. COLORING PROHIBITED.
(1) Color, dye, stain or otherwise change the natural
color of any baby chickens, ducklings, or other fowl under three
weeks of age, or any rabbits under two months of age, or bring into
the City any such fowl or rabbits.

4136.6.3. SAME. EXCEPTION. This article does not pro-
hibit the sale or display of any of the fowl or rabbits described
herein, in proper facilities by breeders or stores engaged in the
business of selling for commercial breeding or raising, or for food,
or their exhibition at any fair, show or exhibit where such fowl
or animals are displayed for commercial purposes and in the interest
of improving agriculture or industry.
SECTION 4. The City Clerk shall certify to the adoption
of this ordinance.
I HEREBY CERTIFY that the foregoing ordinance was adopted
at a regular meeting of the City Council of the City of Arcadia
held on the 5th day of February, 1963, by the affirmative vote of
at least three Councilmen, to wit:
