HomeMy WebLinkAbout1194 (J ORDINANCE NO. 1194 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING THE ANNEXATION TO SAID CITY OF THAT CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO SAID CITY DESCRIBED IN RESOLUTION NO. 3531 ADOPTED BY SAID CITY COUNCIL ON NOVEMBER 20, 1962 AND DESIGNATED THEREIN AS "ANNEXATION NO. 30, SOUTHEAST ARCADIA (UNINHABITED)". THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Arcadia did on its own motion on November 20, 1962, adopt Resolution No. 3531 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, INSTITUTING PROCEEDINGS FOR, SETTING A PUBLIC HEARING CONCERNING AND GIVING NOTICE OF THE TIME AND PLACE OF SUCH PUBLIC HEARING CONCERNING THE PROPOSED ANNEXATION TO THE CITY OF ARCADIA OF CERTAIN TERRITORY ADJACENT AND CONTIGUOUS TO THE PRESENT CITY LIMITS OF SAID CITY, SAID TERRITORY BEING SITUATED NEAR THE SOUTHEASTERLY PORTION OF THE CITY OF ARCADIA AND DESIGNATED AS 'ANNEXATION NO. 30, SOUTHEAST ARCADIA (UNINHABITED)''', which reso- lution reci~ed that the proceedings for the annexation of the terri- tory hereinafter described were initiated on the said Council's own motion, and stated the reasons for which the said Council desires to annex said territory, and which resolution further specifically described the boundaries of the territory sought to be included in said City, and fixed WedneSday, January 2, 1963, at the hour of 8:00 o'clock P.M. in the Council Chamber of the City Hall of said City, as the day, hour and place when and where the City Council would hear protests made by any person owning real property in such territory proposed to be annexed. -1- 1194 SECTION 2. That at a regular meeting of said City Coun- cil held on the 2nd day of January, 1963, at the hour of 8:00 o'clock P.M. in the Council Chamber of said City Council in the Arcadia City Hall, 240 West Huntington Drive, Arcadia, said City Council did find and determine that the publication of Resolution No. 3531 had been made at the time and in the manner required by Section 35311 of the Government Code of the State of California. That the annexation of said territory is not prohibited either by Section 35002.5 or by Section 35236 of the said Government Code. That the territory pro- posed to be annexed as described by said Resolution No. 3531 was and is uninhabited and is contiguous to the City of Arcadia. That writ- ten protest was not made either by private owners of one-half of the value of the privately owned territory proposed to be annexed or by public owners of one-half of the publicly owned territory proposed to be annexed. SECTION 3. That under and pursuant to and in accordance with the provisions of an act of the legislature of the State of California entitled "Annexation of Uninhabited Territory Act of 1939", the annexation to the City of Arcadia of that certain unin- habited territory contiguous to said City as described in Resolu- tion No. 3531, adopted by said City Council of said City on Novem- ber 20, 1962, and therein designated as "Annexation No. 30, South- east Arcadia (Uninhabited)", be and the same is hereby ratified, confirmed and approved. That a specific description of the bound- aries of said territory, as submitted to and favorably reported upon by the Boundary Commission of Los Angeles County pursuant to Section 35002 of the California Government Code, is as follows: -2- 1194 "ANNEXATION NO. 30, SOUTHEAST ARCADIA (UNINHABITED)" TO THE CITY OF ARCADIA Beginning at a point in the southwesterly boundary of the City of Arcadia, as same existed on October 1, 1962, said point being at the intersection of the southwesterly line of Clark Street, 50 feet wide, as shown on map of Chicago Park, recorded in Book 30, page 100, of Miscellaneous Records, in the office of the Recorder of Los Angeles County and the southeasterly line of Durfee Avenue, 80 feet wide, as shown on map of Tract No. 13286, recorded in Book 268, pages 29 to 32 inclusive, of Maps in the office of said Recorder of Los Angeles County; thence southwesterly along said southeasterly line 628.09 feet more or less, to its inter- section with the southwesterly line of Randolph Street, as shown on map of said Chicago Park; thence southeasterly along the last mentioned line to an angle point in the existing City of Arcadia boundary; thence southeasterly along said boundary, following its various courses and distances to the point of beginning. ~~8gpipti9R appr9~aQ ey L. ~. The City Clerk shall certify to the adoption of this Ordinance, and upon the taking effect of this Ordinance, shall make and certify under the seal of the City of Arcadia and transmit to the Secretary of State of the State of California a copy of this Ordinance giving the date of its passage.
