HomeMy WebLinkAbout1197 ORDINANCE NO. 1197 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA AMENDING SECTIONS 2531.2, 9113.1.2, 9113.2.2, 9122.1, 9122.2, 9122.5.1, 9291.2.2, 9291.2.8 AND 9293.2.1 OF THE ARCADIA MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. LEGISLATIVE DETERMINATION. The City Council hereby finds and determines that City planning and enforcement of zoning and subdivision regulations to a great degree benefit the entire City and to such extent the cost thereof should be borne by the City at large. That the cost to the City of City planning, the enforcement of zoning and property division regulations and the ad- ministration of regulations dealing with the division, use and development of land have greatly increased in recent years. That the administration of many such regulations results in direct and tangible benefits to individuals greatly in the excess of the benefit derived therefrom by the public generally. That to the extent that the costs of administration are ascertainable the same should to a reasonable degree be borne by the persons specially benefited thereby. That the Council has determined from staff studies that the fees hereinafter imposed are levied upon administrative aspects which benefit individuals more directly than the general public, and that the fees thus imposed will reimburse the City for only a fair and reasonable proportion of tht: Ci~y's total administrative costs incurred therein. SECTION 2. That Sections 2531.2, 9113.1.2, 9113.2.2, 9122.1, 9122.2, 9122.5.1, 9291.2.2, 9291.2.8 and 9293.2.1 of the -1- 1197 Arcadia Municipal Code are hereby amended to read respectively as follows: 2531.2. SOURCE. To such fund shall be credited the pro- ceeds of any special tax levied for such purposes, the proceeds of any bonds issued for such purposes, and such other funds as the Council may from time to time order transferred thereto pursuant to the Charter. 9113.1.2. FILING FEE. For each subdivision~" a fee of Fifty dollars ($50.00) shall be paid at the time of filing the tentative map. 9113.2.2. FINAL APPROVAL FEE. After approval of the final map of a subdivision and prior to the recordation thereof, there shall be paid to the City a sum of Twenty-five do11ars ($25.00) per lot for each lot in such subdivision. 9122.1. FILING FEE~. For each lot split, a fee of Fifty dollars ($50.00) shall be paid at the time of filing the application. 9122.2. FINAL APPROVAL FEE. A fee of Twenty-five dollars ($25.00) shall, prior to final approval of any lot division, be paid for each additional lot resulting from the division of property pur- suant to this Division. 9122.5.1. APPEAL AND REVIEW. An applicant for a lot divi- sion pursuant to this Division may appeal to the Council from a decision of the Planning Commission relative thereto, by filing with the City Clerk within five (5) days after such decision a written statement setting forth the decision appealed from, his objections thereto, and sufficient factual data to indicate the validity of such objections. A fee of Twenty-five dollars ($25.00) shall be paid to the Treasurer concurrent with the filing of any such appeal. The Council shall consider such appeal and take action thereon within a -2- 1197 reasonable time. At its first regular meeting occurring at least five (5) days after the deci.sion of the Planning Commission on an application for a lot division filed pursuant to Section 9122, the Council may on its own motion, by a vote of a majority of its members entered in the Council minutes, institute a review of such decision of the Planning Commission. At the conclusion of the hearing of any such appeal or upon completion of any such review the Council shall, by a vote of a majority of its members entered upon the Council minutes, affirm, modify or reverse the decision of the Planning Com- mission, and such action by the Council shall be final. 9291.2.2. FILING FEE4. Before accepting for filing any application for a variance, the City shall, for the purpose of defraying the expenditures incidental to the proceedings described herein, charge and collect a fee of One hundred twenty-five dollars ($125.00) for the first lot or portion thereof, concerning which such application is filed. 9291.2.8. APPEAL. Within ten (10) days after such deci- sion by the Planning Commission, the applicant, or any other person aggrieved by such decision, may appeal therefrom in writing to the Council by filing such with the City Clerk. A fee of One hundred dollars ($100.00) shall be paid to the Treasurer concurrent with the filing of any appeal concerning a variance or special use. A fee of Ten dollars ($10.00) shall be paid to the Treasurer concurrent with the filing of any appeal cGncerning a modification request. 9293.2.1. SAME. FEE~.
