HomeMy WebLinkAbout1198 ORDINANCE NO,'1198 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, PROHIBITING THE ERECTION, ALTERATION OR MOVING IN OF, BUILDINGS .OR COMMENCEMENT OF NEW USES IN THAT PORTION OF SAID CITY UNDER STUDY FOR RECLASSIFICATION OR CHANGE OF ZONING REGULATIONS; THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: , I SECTION'l. That the City Planning Commission and the City Planning Department have conducted studies and within a reasonable time intend to hold a hearing for the purpose of recommending to the City Council the adoption of amendments and additions to the zoning , ordinance of the City of Arcadia affecting the zoning classification , of the property he'reafter described and the existing zoning regula- , tions applicable thereto. That to protect the public safety, health and welfare it is essential that the erection of buildings and the commencement of uses which will become nonconforming under such pro- sp~tive amendments and additions to the zoning ordinance be prevented. SECTION 2. No building or structure shall be erected, nor shall any existing building or structure be moved into, reconstructed, , structurally altered, 'added to or enlarged, nor shall any permit be issued for any of the forego~ng, as to any. lot or parcel of ground within the following described area, to wit: Parcell. That portion of the City of Arcadia bounded and described as follows: Commencing at the intersection of the easterly line of Santa Anita Avenue with the southerly line of Floral Avenue; thence -1- 1198 southeasterly in a direct line to a point in the westerly line of Fifth Avenue, which is 860 feet north of the northerly line of Hunt- ington Drive; thence southerly along the westerly line of Fifth Avenue to its intersection with the northerly line of Diamond street; thence westerly in a direct line to the intersection of the easterly line of Santa Anita Avenue with the northerly line of Diamond Street; thence northerly along the easterly line of Santa Anita Avenue to the point of beginning. Parcel 2. That portion of the City of Arcadia bounded and described as follows: Commencing at the intersection of the westerly line of Santa Anita Avenue and the northerly line of Huntington Drive; thence westerly along the northerly line of Huntington Drive to the north- westerly line of the former Pacific Electric Railway right-of-way, 60 feet wide; thence northeasterly along the last mentioned north- westerly line to the easterly line of Tract No. 15337; per map re- corded in Book 346, pages 12 and 13, of Maps in the office of the Los Angeles County Recorder; thence northerly along said easterly line of said Tract No. 15337 to the southerly line of Colorado Boule- vard; thence easterly along the southerly line of Colorado Boulevard to the westerly line of Santa Anita Avenue; thence southerly along the we~terly line of Santa Anita Avenue to the point of beginning. SECTION 3. Notwithstanding the provisions of the pre- ceding Section, the City Council may, by a vote of four-fifths of its memoership entered upon the Council minutes, authorize the issu- an c e: of a building permit for any building or structure within that portion of the property described in the preceding Section with respect to which the City Council has approved, either as on file or -2- ll98 as may be hereafter amended, that certain Planning Study entitled "A Preliminary Report on the Central Area Plan for the City of Arcadia, California" dated February, 1963 and on file in the office of the City Clerk, if in the opinion of the City Council such build- ing or structure conforms with the criteria and uses proposed for I , the area thus approved by the Council. SECTION 4. No certificate of occupancy shall be issued under the Building Code for any use of land or buildings within the area described in Section 2 hereinbefore other than for the same use for which such land or building has been used for a period of at least three (3) consecutive months during the six (6) months period immedi- ately preceding the issuance of such certificate of occupancy. SECTION 5. Notwithstanding the provisions of the preceding section, the City Council may authorize the issuance of a certificate of occupancy for any use which in its opinion conforms to the criteria and uses proposed for such property in that certain Planning Study entitled "A Preliminary Report on the Central Area Plan for the City of Arcadia, California," dated February, 1963, and on file in the office of ,the City Clerk. SECTION 6. This ordinance is adopted pursuant to Section 65806 of the California Government Code and is hereby declared oy the City Council,to be necessary as an emergency measure for.preserv_ ing the public peace, ,health and safety, and shall take effect im- mediately upon its adoption. The statement of the reasons for its urgency is as follows: The studies thus far completed by and under the direction of the City Planning Commission and the City Plannirg Department concerning the area described in Section 2 of this ordi- nance indicate clearly the necessity for the reclassification of -3- ll98 many of said properties and the amendment of and addition to the zoning regulations effecting the same. That the purpose of such studies, reclassification, and amendments and additions to the zoning regulations will be seriously jeopardized and thwarted if prior to the effective date thereof buildings and uses may be erected and com- menced contrary thereto. It is therefore necessary that this ordi- nance take 'effect immediately upon its adoption. SECTION 7. The City Clerk shall certify to the adoption of this ordinance and shall cause it to be publiShed once in the official newspaper.
