ORDINANCE NO. 1103
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ARCADIA,' CALIFORNIA,
LIMITING THE HEIGHT OF MULTIPLE
DWELLINGS IN SAID CITY.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. That under the provisions'of Ordinance No. 760
of the City of Arcadia, as originally enacted and as subsequently
amended, the most restrictive zone in which multiple dwellings were
and are permitted was and is Zone R-3. That multiple dwellings in
Zone R-3 are restricted to a maximum height of two (2) stories or
twenty-five (25) feet. That when Zone C-O was created, all uses
permitted in Zone R-3 were permitted in Zone C-O. That in creating
Zone c-o and pennitting multiple dwellings therein, it was not the
intent of this Council to permit multiple dwellings exceeding in
height the height limit applicable to multiple dwellings in Zone R-3,
even though all uses permitted in Zone R-3 were blanketed into the
new Zone C-O. That at best there is serious doubt whether the
provisions of said Ordinance No. 760, and particularly the provisions
of Section 8.1 thereof, restrict or will be officially construed to
restrict the heig~t of multiple dwellings in Zone C-O to the same
height limit specified for multiple dwellings in Zone R-3. That the
construction of four (4) story multiple dwellings would not only be
contrary to the long-established policy of reasonable limitation of
population density, but such four (4) story construction of multiple

dwellings without adequate safegpards with respect to type of mate-
rials and methods of constructed to be used, the location and means
of egress and particularly emergency exits, and without the possession
by the City of Arcadia of emergency equipment adequate to cope with
the dangers and hazards inherent in and resulting from the initial
and sudden construction of multiple dwellings three (3) and four (4)

stories in heigh~ would greatly jeopardize the public peace, health
and safety. That before permitting construction of multiple dwell-
ings of such height, a review of all regulations applicable thereto,
an intense study of the dangers and hazards involved therein, and a
thorough survey of the City'S equipment and means for combatting or
coping with such dangers and hazards must be made in order to pro-
tect the health, safety and welfare of the residents and property
in the City of Arcadia.
SECTIO,N 2. That for the foregoing reasons, no person
shall, until the repeal or amendment of this ordinance, construct,
erect, locate, alter or enlarge any multiple dwelling, as defined
by Ordinance No. 760 of the City of Arcadia, as amended, anywhere
within the City of Arcadia.
SECTION 3. This ordinance is hereby declared by the City
Council to be necessary as an emergency measure for preserving the
public peace, health and safety, and shall take effect immediately
upon its adoption. A statement of the reasons for its urgency is
as follows: That at least since the adoption of Ordinance No. 760
of the City of Arcadia in 1949, no multiple dwellings of three (3)
or four (4) stories in height have been constructed. That multiple
dwellings of such height require safeguards in excess of those re-
quired for or now in effect with respect to existing multiple
dwellings. That the construction of multiple dwellings in excess
of two (2) stories in height should be prohibited until a review of
all present regulations applicable to such construction, a full study
of the dangers and hazards involved therein, and a thorough survey
of the City's equipment and means for combatting such danger and
hazards can be made, and such other or further regulations enacted
as will be necessary to insure the protection of the public peace,
health and safety of the residents and properties in the City of
Arcadia.

SECTION 4. Any person violating any of the provisions of
this ordinance shall be deemed guilty of a misdemeanor and upon con-
viction thereof shall be punishable by a fine of not more than Five
Hundred Dollars ($500.00) or by imprisonment in the City Jail of the
City of Arcadia, California, or in the County Jail of the County of
Los Angeles, California, as the committing magistrate shall direct,
for a period of not more than six (6) months, or by both such fine
and imprisonment in the discretion of the Court.
SECTION 5. The City Clerk shall certify to the adoption
of this ordinance and prior to the expiration of fifteen (15) days
from the passage thereof, shall cause the same to be published once
in the Arcadia Tribune and Arcadia News, a newspaper of general cir-
culation, published and circulated in the City of' Arcadia.
I HEREBY CERTIFY that the foregoing ordinance was adopted
at a regular meeting of the City Council of' the City of Arcadia,
held on the 4th day of October, 1960, by the affirmative vote of at
least four councilmen, to wit:
