ORDINANCE NO. 1104
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
AMENDING SECTIONS 6220.56, 6426.2
AND 6426.6 OF THE ARCADIA MUNICIPAL
CODE AND ADDING THERETO NEW SECTIONS
6220.56.1 AND 6421.3.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. That the Arcadia Municipal Code be amended by
amending Sections 6220.56, 6426.2 and 6426.6 thereof to read re-
spectively as follows:
"6220.56. TIP SHEETS - AT TRACK. For every person who
by any mean~ engages in the business or practice of disseminating,
distributing, pa:ssing out, giving away, handing out, selling, offer-
ing for sale, or soliciting for the sale of any sheet, dodger, hand-
bill, circular, letter, booklet, or any other printed, typewritten,
mimeographed or written matter of any kind, other than a newspaper,
pertaining to any horse race, choice of a horse or horses, recom-
mending any horse or horses, or giving or conveying any information
about any horse, horse race or contest of endurance or speed between
horses or beasts, upon property owned and controlled by any racing
association duly licensed by the State to conduct horse racing under
and in acco~dance with the laws of the State relating to such mat-
ters, and in conjunction with which such property is used by such
racing association, Three Hundred Dollars ($300.00) per ninety (90)
day period. The number of persons allowed to distribute such mate-
rial under anyone license shall not exceed the number specified in
Section 6426."
"6426.2. DISTRIBUTING. No person shall, in the dissemi-
nating, distributing, passing out, giving away, handing out, selling,
offering fo~ sale, or soliciting for the sale of any of said mate-
rials described in section 6220.56, interfere with or cause inter-
ference with the normal flow of traffic upon the city streets. For

the purpose of preventing congestion in traffic upon the public
streets, the location occupied by such person in the conduct of
such business on private property shall be subject to the approval
of the Chief of Police; provided, however, that any person aggrieved
by the decision of the Chief of Police under this Division may appeal
to the Council, in which event the Council, by order of the majority
of its members entered upon the council minutes, may affirm, modify
or reverse such decision of the Chief of Police, and the Council's
action in such matter shall be final."
"6426.6. LICENSE. EXTENSION. Upon written application
filed with the License Officer requesting such extension (accompanied
by the required extension fee) the Council may in its discretion
grant an extension of the ninety (90) day period referred to in Sec-
tion 6220.56 for either:
(1) An additional thirty (30) day period immediately fol-
lowing said ninety (90) day period, upon the payment of an additional
license fee equal to one-third (1/3) of the amount of the fee due
under the original ninety (90) day period; or
(2) An additional sixty (60) day period immediately fol-
lowing said ninety (90) day period, upon the payment of an additional
license fee equal to two-thirds (2/3) of the amount of the fee due
under the original ninety (90) day period.
No extension shall be valid unless and until the respective
additional fee is paid."
SECTION 2. That the Arcadia Municipal Code be amended by
adding thereto new Sections 6220.56.1 and 6421.3, the same to read
respectively as follows:
"6220.56.1. TIP SHEETS - AWAY FROM TRACK. For every per-
son who by any means engages in the business or practice of dissemi-
nating, distributing, passing out, giving away, handing out, selling,
offering for sale, or soliciting for the sale of any sheet, dodger,
handbill, circular, letter, booklet, or any other printed,

typewritten, mimeographed or written matter of any kind, other than
a newspaper, pertaining to any horse race, choice of a horse or
horses, recommer.ding any horse or horses, or giving or conveying
any information about any horse, horse race or contest of endurance
or speed between horses or beasts, upon any privately owned property
in the City other than any real property described in Section
6220.56, Six Hundred Dollars ($600.00) per ninety (90) day period.
The number of persons allowed to distribute such material under any
one license shall not exceed the number specified in Section 6426."
"6421.3. ADVERTISING DISTRIBUTION ON PUBLIC PROPERTY PRO-
HIBTED. No person shall, upon any street, sidewalk, highway, park-
way or any public property of the City, cast, throw or deposit, sell
or distribute among pedestrians or to persons in vehicles any adver-
tising matter or any materials described in Section 6220.56."
SECTION 3. The City Clerk shall certify to the adoption
of this ordinance and prior to the expiration of fifteen (15) days
from the passage thereof, shall cause the same to be published once
in the Arcadia Tribune and Arcadia News, a newspaper of general cir-
culation, published and circulated in the City of Arcadia.
I HEREBY CERTIFY that the foregoing ordinance was adopted
at a regular meeting of the City Council of the City of Arcadia,
held on the 1st
day of November
, 1960, by the affirmative vote
of at least three councilmen, to wit:
