HomeMy WebLinkAbout1116 ORDINANCE NO. 1116 J~ ORDINANCE OF THE CITY COUNCIL OF ~~E CITY OF ARCADIA, CALIFORNIA, VACATING AND ABANDONING A PORTION OF PIFTH AVENUE, A PUBDIC STREET IN SAID CITY AND RESERVING SPECIFIED EASEMENTS THEREIN. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETEmrllNE AND ORDAIN AS FOLLO\'lS: SECTION 1. That Resolution No. 3322 entitled ~A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLAR- ING ITS INTENTION TO VACATE AND ABANDON A PORTION OF FIFTH AVENUE, A PUBLIC STREET IN SAID CITY AND TO EXCEPT AND RESERVE EASEMENTS THEREIN, AND FIXING A TIME AND PLACE FOR THE HEARING OF OBJECTIONS TO SUCH PROPOSED VACATION AND ABANDONMENT" was duly and regularly adopted by the City Council of the City of Arcadia on November 30, 1960; ti1at said .Resolution, among other things, fixed the hour of 8:00 o'clock p. m. on the 20th day of December, 1960, in the Council Chamber of the Arcadia City Hall, 240 West Huntington Drive, Arcadia, California, as the time and place for hearing all persons interested in or objecting to the proposed vacation as therein outlined; that a copy thereof was duly and regularly published in the Arcadia Tribune and Arcadia News" a weekly newspaper of general circulation, pub- lished and circulated in said City, as required by the Streets and Highways Code of the State of California, and that the property here- inafter described and proposed to be vacated was duly and regularly posted as required by the Streets and Highways Code of the State of California; that the affidavits of said publication and of said posting were duly filed with and are now on file with the City Clerk of the City of Arcadia; that on the 20th day of December, 1960, at the hour of 8:00 o'clock p.m., in the Council Chamber of the Arcadia City Hall, 240 West Huntington Drive, Arcadia, California, the City Council of the City of Arcadia did accept and receive all testimony -1- 1116 offered in support of or' in objection to the said proposed vacation; that thereupon the said City Council found from evidence submitted that the property hereinbefore used for street purposes and herein- after particularly described is unnecessary for present or prospec- tive street purposes, and that the pUblic welfare, convenience, necessity and safety require and will be better served by the vaca- tion thereof as a public street. in said City. SECTION 2. That the City of Arcadia does therefore hereby order the vacat:Lon .and abandonment of that property, heretofore a part of Fifth Avenue, in the City of Arcadia, County of Los Angeles, State of California, specifically described as follows: A str:Lp of land beginning in the East line of Lot 9, Tract No. 5205, per Map Book 54, page 61, Records of said County, forty (40) feet southerly from the northeast corner of said Lot 9; thence West and parallel to the north line of said lot for a distance of ten (10) feet; thence North 45.00' West for a distance of 28.28 feet to the south line of Huntington Drive; thence East and parallel to the southerly line of Lot 9 for a distance of ten (10) feet; thence South 45000' East :~or a distance of 28.28 feet to the point of beginning. As heretofore determined in Resolution No. 3322, adopted November 30, 1960, the pUblic convenience and necessity require a reservation of easements and r:Lghts of way for the various structures enumerated in Section 8330 of the Streets and Highways Code of the State of California, the City of Arcadia does therefore hereby reserve and ex- cept from the a:oresaid vacation and abandonment a permanent easement and right at an~r time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers, storm drains and appurtenant structures in, upon, over and across any part of said portions of street to be vacated atid, pursuant to any existing franchises or renewals thereof or otherwise, to construct, maintain, operate, replace, remove, renew or enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraph and tele- phone lines, railroad lines and for the ,~'ransportation and I -2- 1116 distribution of electric energy, petroleum and its products, water, and incidental purposes, including access thereto and therefrom, and the right to keep the property free from inflammable materials, wood growth and structures of any nature, and otherwise protect the same from all hazards in, upon and over any and all portions of said street hereby vacated, and as to which easements and rights are thus retained. SECTION 3. The City Clerk shall certify to the adoption of this ordinance.
