HomeMy WebLinkAbout1117 ORDINANCEN0:.. 1117 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING THE M~NEXATION TO SAID CITY OF THAT CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO SAID CITY DESCRIBED IN RESOLUTION NO. 3328 ADOPTED BY SAID CITY COUNCIL ON NOVEMBER 6,.1960, AND DESIGNATED THEREIN AS "ANNEXATION NO. 22, SOUTH ARCADIA (UNINHABITED)." THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Arcadia did on its own motion on November 6, 1960 adopt Resolution No. 3328 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, INSTITUTING PROCEEDINGS FOR, SETTING A PUBLIC HEARING CONCERNING AND GIVING NOTICE OF THE TIME AND PLACE OF SUCH PUBLIC HEARING CONCERNING THE PROPOSED ANNEXATION TO THE CITY OF ARCADIA OF CERTAIN TERRITORY ADJACENT AND CONTIGUOUS TO THE PRESENT CITY LIMITS OF SAID CITY, SAID TERRITORY BEING SITUATED NEAR THE SOUTHERLY PORTION OF THE CITY OF ARCADIA AND DESIGNATED AS 'ANNEXATION NO. 22, SOUTH ARCADIA (UNINHABITED)''', which resolution recited that the proceedings for the annexation of the territory hereinafter described were initiated on the said Council's own motion, and stated the reasons for which the said Council desires to annex said territory, and which resolution further specifically described the boundaries of the territory sought to be included in said City, and fixed Tuesday, January 17, 1961, at the hour of 8:00 o'clock P.M. in the Council Chamber of the City Hall of said City, as the day, hour and place when and where the City Council would hear protests made by any person owning real property in such territory proposed to be annexed. -1- 1117 SECTION 2. That at a regular meeting of said City Council held on the 17th day of January, 1961, at the hour of 8:00 o'clock P.M. in the Council Chamber of said City Council in the Arcadia City Hall, 240 West Huntington Drive, Arcadia, said City Council did find and determine that the publication of Resolution No. 3328 had been made at the time and in the manner required by Section 35311 of the Govern- ment Code of the State of California. That the annexation of said territory is not prohibited either by Section 35002.5 or by Section 35326 of the said Government Code. That the territory proposed to be annexed as described by said Resolution No. 3328 was and is unin- habited and is contiguous to the City of Arcadia. That said terri- tory was heretofore a part of the City of Temple City, a Municipal Corporation. That the legislative body of Temple City has received the written consent of at least two-thirds of the freeholders within the territory, holding at least two-thirds in value of the real property within the territory, and the legislative body of Temple City has by resolution consented to the detachment of said territory from the City of Temple City and the annexation thereof to the City of Arcadia. That written protest was not made either by private owners of one-half of the value of the privately owned territory proposed to be annexed or by public owners of one-half of the publicly owned territory proposed to be annexed. SECTION 3. That under and pursuant to and in accordance with the provisions of an act of the legislature of the State of California enti:tled "Annexation of Uninhabited Territory Act of 1939", the annexation to the City of Arcadia of that certain unin- habited territory contiguous to said City as described in Resolution No. 3328, adopted by said City Council of said City on November 6, 1960, and therein den:l:gnatwas "Annexation No. 22, South Arcadia (Uninhabited)", be and the same is hereby ratified, confirmed and -2- 1117 approved. That a specific description of the boundaries of said territory, as submitted to and favorably reported upon by the Boundary Commission of Los Angeles County pursuant to Section 35002 of the California Government Code, is as follows: Beginning at a point in the existing boundary of the City of Arcadia as same existed on November 1, 1960, said point being the northeast corner of Lot 4, Tract No. 10260, as per map recorded in Book 219, page '20, of Maps in the office of the Recorder of Los Angeles CountYjthence southerly along the easterly line of Lots 4 and 5 of said Tract No. 10260 to the southeast corner of said Lot 5; thence westerly along the southerly line of said Lot 5 to the southwest corner thereof; thence northerly along the westerly line of previously mentioned Lots 4 and 5 to the northwest corner of said Lot 4, said corner being in the previously mentioned boundary of the City of Arcadia; thence easterly along said boundary to the point of beginning. SECTION 4. The City Clerk shall certify to the adoption of this Ordinance. The City Clerk shall upon the taking effect of this Ordi- nance, make and certify under the seal of the City of Arcadia and transmit to the Secretary of State of the State of California a copy of this Ordinance giving the date of its passage.
