HomeMy WebLinkAbout1123 ORDINANCE NO. 1123 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, VACATING AND ABANDONING A PORTION OF THE FIRST ALLEY SOUTH OF LA PORTE STREET IN SAID CITY. THE CI'I'Y COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND ORDAIN AS FOLLOWS: SECTION 1. That Resolution No. 3359 entitled "A RESO- LUTION OF THE CB~Y COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DE- CLARING ITS INTENTION TO VACATE AND ABANDON A PORTION OF THE FIRST ALLEY SOUTH OF LA PORTE STREET, A PUBLIC ALLEY IN SAID CITY AND FIXING A TIME AND PLACE FOR THE HEARING OF OBJECTIONS TO SUCH PRO- POSED VACATION AND ABANDONMENT" was duly and regularly adopted by the City Council of the City of Arcadia on March 7, 1961; that said Resolution, among other things, fixed the hour of 8:00 o'clock p.m. on the 4th day of April, 1961, in the Council Chamber of the Arcadia City Hall, 240 West Huntington Drive, Arcadia, California, as the time and place for hearing all persons interested in or objecting to the proposed vacation asctherein outlined; that a copy thereof was duly and regularly published in the Arcadia Tri- bune and Arcadia News, a weekly newspaper of general circulation, published and ci:~culated in said City, as required by the Streets and Highways Cod,~ of the State of California, and that the property hereinafter desc~ibed and proposed to be vacated was duly and regu- larly posted as required by the Streets and Highways Code of the State of California; that the affidavits of said publication and of said posting were duly filed with and are now on file with the City Clerk of the City of Arcadia; that on the 4th day of April, 1961, at the hour of 8:00 o'clock p.m., in the Council Ch~nber of the Arcadia City Hall, 240 West Huntington Drive, Arcadia, Califor- nia, the City Council of the City of Arcadia did accept and re- ceive all testimony offered in support of or in objection to the said proposed vacation; that thereupon the said City Council found from evidence submitted that the property hereinbefore used for -1- 1123 alley purposes, and hereinafter particularly described is unne~essary for present or prospective alley purposes, and that the public wel- fare, convenience, necessity and safety require and will be better served by the vacation thereof as a public alley in said City. SECTION 2. That the City of Arcadia does therefore hereby order the vacation and abandonment of that property, heretofore ao part of the First Alley South of La Porte Street, in the City of Arcadia, County of Los Angeles, State of California, specifically described as follows: That portion of the first alley south of La Porte Street lying west of the west right of way line of Second Avenue, 60 feet wide, and east of the northerly prolongation of the east line of the west 20 feet of Lot 14, Block 81, of the Santa Anita Tract, as per map recorded in Book 15, pages 89 and 90, of Miscellaneous Records in the office of the Recorder of Los Angeles County. SECTION 3. The City Clerk shall certify to the adoption of this Ordinm1ce and upon the same taking effect shall cause a certified copy hereof to be recorded in the office of the County Recorder of LOB Angeles'County.
