HomeMy WebLinkAbout1125 ORDINANCE NO. 1125 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, RECLASSIFYING SPECIFIED PROPERTY ABUTTING DUARTE ROAD TO ZONE C-l AND ~IAKING FINDINGS AND DETERMINATIONS RELATIVE TO THE PROPOSED RECLASSIFICATION TO ZONE C-I OF OTHER PROPERTY ABUTTING DUARTE ROAD. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND ORDAIN AS FOLLOWS: SECTION I. That after hearings duly instituted and held, after notice required by law, by and before the City Planning Com- mission and the City Council, this Council heretofore determined that Duarte Road is a heavily traveled east-west traffic arterial, designated as a major traffic arterial in the Los Angeles County master plan of highways; that said Duarte Road had already been zoned for comme:t'cial purposes for some distance east and west of Baldwin Avenue and from Santa Anita Avenue to First Avenue, and that Duarte Road properties to the east in the City of Monrovia had already been zoned for commercial purposes. That the orderly development of the City of Arcadia and the proper utilization of property along this major highway required the further reclassifi- cation of the property hereinafter described for commercial pur- poses. That this Council on July 19, 1955, adopted Ordinance No. 912, whereby it determined that property on Duarte Road between First and Second Avenues should be reclassified to Zone C-l upon dedications of property for the widening of Duarte Road and for alley purposes, provided that such dedications were made within two (2) years after the effective date of said Ordinance No. 912. SECTION 2. That there are still two lots on the north side of Duarte Road and five on the south side that have not made -1- 1125 the required dedications and therefore have not been reclassified to Zone C-l. That the two year period specified in said Ordinance No. 912 for con~liance with the requirement of dedications has ex- pired; that the present development in the area indicates the need of rezoning to C-l of those properties not already so zoned upon making the dedications required by Ordinance No. 912, but that fur- ther time should be granted for such dedications. SECTION 3. That after hearings again duly instituted and held, after notice required by law, by and before the City Planning Commission on January 24, 1961, and the City Council on March 21, 1961, this Council again determines that the timely and proper de- velopment of the area requires that the individual properties on Duarte Road between First and Second Avenues not heretofore reclas- sified for commercial purposes be reclassified to Zone C-l when the individual properties have made provision for street widening and alley access. SECTION 4. That provision having been made for the widen- ing of Duarte Road and alley access with respect to the property in this section hereinafter described, as hereinbefore determined to be necessary prior to such reclassification, the following real prop- erty in the County of Los Angeles, State of California, to wit: The east 104.96 feet of lot 13 and the west 6 feet of lot 14, Tract No. 808, as shown on map recorded in Book 16, pages 82 and 83, of Maps, records of said County, excepting there- 'from the southerly 252 feet thereof, shall be and the same is hereby reclassified to Zone C-l and from and after the effective date of this Ordinance said property shall be rezoned and established as a district in Zone C-I under the provisions of the Zoning Ordinance and the Zoning Map and the map contained in Section 9233.14 of the Arcadia Municipal Code are hereby amended to reclassify and designate the above described property as a district in Zone C-l. -2- 1125 SECTION 5. That the following described properties in the County of Los Angeles, State of California, to wit: Lots 13 and 14 and the south half of the vacated alley adjoining on the north, Block 62, Santa Anita Tract, as shown on map recorded in Book 16, page 58, of Miscellaneous Records of said county; Lot 4, Tract No. 10532, as shown on map recorded in Book 177, pages 21 and 22, of Maps, records of said County, should be reclassified to Zone C-l when and if adequate provision is made for the widening of Duarte Road ~d for an alley at the rear of said properties, and each of said properties which within five years after the effective date of this ordinance shall have made provision for dedication for street purposes for the widening of Duarte Road to forty-two (42) feet from the present center line, and for an alley twenty (20) feet wide extending across the rear of the respective parcels, shall without the necessity of further notice or proceedings be reclassified and established as districts in Zone C-I under the provisions of the Zoning Ordinance. SECTION 6. That the following described properties in the County of Los Angeles, State of California, to wit: The west 115.5 feet of lot 13, except the southerly 252 feet thereof; the east 107.23 feet of lot 14, except the southerly 252 feet thereof; and lot 15, except the southerly 326 feet thereof and except the easterly 76 feet thereof, Tract No. 808, as shown on map recorded in Book 16, pages 82 and 83, of Maps, records of said County, should be reclaasified to Zone C-l when and if adequate provision is made for an alley at the rear of said properties, and each of said properties which within five years after the effective date of this ordinance shall have made provision for dedication for an alley twenty (20) feet wide extending across the rear of the re- spective parcels, shall without the necessity of further notice or proceedings be reclassified and established as districts in Zone C-I under the provisions of the Zoning Ordinance. -3- 1125 SECTION 6. ~he City Clerk shall certify to the adoption of this ordinance. I HEREBY CERTIFY that the foregoing ordinance was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 18th day of April , 1961, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Camphouse, Phillips, Reibold and Balser NOES: None .
