ORDINANCE NO. 1133 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING THE ARCADIA MUNICIPAL CODE BY ADDING TO CHAPTER 1 OF ARTICLE III THEREOF A NEW PART 4 ENTITLED "HAZARDOUS FIRE AREAS". THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That Chapter 1 of Article III of the Arcadia Municipal Code be and the same is hereby amended by adding thereto a new Part 4 entitled "Hazardous Fire Areas", containing Sections 3140 to 3142.1, inclusive, the same to read as follows; ARTICLE III. PUBLIC SAFETY CHAFrER 1. FIRE PREVENTION PART 4. HAZARDOUS FIRE AREAS 3140. DESIGNATION. The Fire Chief is hereby authorized to declare any portion of the City which is sparsely settled and which is substantially covered with brush, grass or other inflam- mable material as a hazardous fire area. Such declaration shall be made in writing over the signature of the Fire Chief and shall specify the dates during which such declaration shall be effective. A copy of such declaration, together with a map delineating the area thus designated~shall be filed with the City Clerk. 3141. ENTRY RESTRICTED. Except as hereinafter pro-. vided, no person shall enter upon, be at or remain in any hazardous fire area so designated by the Fire Chief during the effective period of any such declaration, when signs giving notice that the area is a hazardous fire area are posted at such locations within or immediately adjacent to such area as will in the opinion of the Fire Chief give reasonable notice to the public that the area has been designated as a hazardous fire area. 3141.1. SAME. PROPERTY EXEMPT. The following places -1- 1133 within any hazardous fire area are exempt' from the provisions of the preceding section, to wit: public roads~ properties improved with family dwellings and occupied by the owners or tenants thereof; improved camp sites designated by the Fire Chief. 3141.2. SAME. PERSONS EXEMPT. City, county, state and federal public officers and their respective authorized agents, while acting within the course of their official duty, are exempt from the provisions of Section 3141. The owners or tenants of pri- vate property located within any designated hazardous fire area, as well as the guests or invitees of such owners or tenants, are exempt from the provisions of Section 3141 but only with respect to the property of such owners or occupants included within a hazardous fire area. 3142. FIRES AND SMOKING PROHIBITED. No person shall light, ignite or otherwise set fire to any combustible material or smoke any cigarette, cigar, pipe or tobacco in any form within any hazardous fire area designated as provided in Section 3140. 3142.1. SAME. EXCEPTION. The provisions of the preced- ing section shall not apply to any occupied dwelling nor to any smoking area, camp site, or public park designated by the Fire Chief. SECTION 2. 'This ordinance is hereby declared by the City Council to be necessary as an emergency measure for preserving the public peace, health and safety, and shall take effect immediately upon its adoption. A statement of the facts constituting its urgency is as follows: Within the City of Arcadia and particularly adjacent to the United States National Forestry area and the foot- hill mountains are large areas of brush covered land accessible to the public. That the scant amount of rainfall during the past year has caused a condition of extreme fire hazard to exist in such areas. That it is essential that the public be immediately ex- cluded from all such areas to reduce the danger of fire. in such -2~ 1133 areas which fires would gravely endanger large portions of the City of Arcadia as well as the United States Forestry areas. SECTION 3. The City Clerk shall certify to the adoption of this ordinance. I HEREBY CERTIFY that the foregoing ordinance was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 18th day of. WAY, FIRE CHIEF SUBJECT: OPENING OF HAZARDOUS FIRE AREA As set forth in our DECLARATION, issued in July 1961, the HAZARDOUS FIRE AREA, as described in that declaration, is now declared to be open to entry, due to weather conditions.
