ORDINANCE NO. 1138
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
APPROVING THE ANNEXATION TO SAID CITY
OF THAT CERTAIN UNINHABITED' TERRITORY
CONTIGUOUS TO SAID CITY DESCRIBED IN
RESOLUTION NO. 3400 ADOPTED BY SAID
CITY COUNCIL ON AUGUST 1, 1961, AND
DESIGNATED THEREIN AS "ANNEXATION NO.
25, EAST ARCADIA UNINHABITED".
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
HEREBY DETERMINE AND ORDAIN AS FOLLOWS:
SECTION 1. That the City Council of the City of Arcadia
did on its own motion on August 1, 1961, adopt Resolution No. 3400
entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, INSTITUTING PROCEEDINGS FOR, SETTING A PUBLIC HEARING
CONCERNING AND GIVING NOTICE OF THE TIME AND PLACE OF SUCH PUBLIC
HEARING CONCERNING THE PROPOSED ANNEXATION TO THE CITY OF ARCADIA
OF CERTAIN TERRITORY ADJACENT AND CONTIGUOUS TO THE PRESENT CITY
LIMITS OF SAID CITY, SAID TERRITORY BEING SITUATED NEAR THE EASTERLY
PORTION OF THE CITY OF ARCADIA AND DESIGNATED AS 'ANNEXATION NO.
25, EAST ARCADIA UNINHABITED''', which resolution recited that the
proceedings for the annexation of the territory hereinafter de-
scribed. were initiated on the said Council's own motion, and stated
the reasons for which the said Council desires to annex said terri-
tory, and which resolution further specifically described the
boundaries of the territory sought to be included in said City,
and fixed Tuesday, September 19, 1961,.at the hour of 8:00 o'clock
P.M. in the Council Chamber of the City Hal1.of said City, as the
day, hour and place when and where the City Council would hear pro-
tests made by any person owning real' property in such. territory
proposed to be annexed.
SECTION 2. That at a regular meeting of said City Coun-
cil held on the 19th day of September, 1961, at the hour of 8:00

o'clock P.M. in the Council Chamber of said City Council in the
Arcad~a City Hall, 240 West Huntington Drive, Arcadia, said City
Council did find and determine that the publication of Resolut~on
No. 3400 had been made at the time and in the manner required by
Section 35311 of the Government Code of the State of California.
That the annexation of said territory is not prohibited either by
Section 35002.5 or by Section 35326 of the said Government Code.
That the territory proposed to be annexed as described by said Reso-
lution No. 3400 was and is uninhabited and is contiguous to the City
of Arcadia. That said territory was heretofore a part of the City
of Monrovia, a Municipal Corporation. That the legislative bodies
of the Cities of Monrovia and Arcadia have received the written con-
sent of at least two-thirds of the freeholders within the territory,
holding at least two-thirds in value of the real property within the
territory, and the legislative body of the City of Monrovia has by
resolution consented to the detachment of said territory from the
City of Monrovia and the annexation thereof to the City of Arcadia.
That written protest was not made either by private owners of one-
half of the value of the privately owned territory proposed to be
annexed or by public owners of one-half of the publicly owned terri-
tory proposed to be annexed.
SECTION 3. That under and pursuant to and in accordance
with the provisions of an act of the legislature of the State of
California entitled "Annexation of Uninhabited Territory Act of
1939", the annexation to the City of Arcadia of that certain unin-
habi ted territory' contiguous to said City as described in Resolution
No. 3400, adopted by said City Council of said City on August 1,
1961, and therein designated as "Annexation No. 25, East Arcadia
Uninhabited", be and the same is hereby ratified, confirmed and
approved. That a specific description of the boundaries of said
territory, as submitted to and favorably reported upon by the
Boundary Commission of Los Angeles ,County pursuant to Section 35002
of the California Government Code, is as follows:

"ANNEXATION NO. 25, EAST ARCADIA UNINHABITED"
TO THE CITY OF ARCADIA
Beginning at the intersection of the center line of
Duarte Road, 60 feet wide, and the easterly boundary of the City
of Arcadia as shown on map of Tract No. 18616 in Book 543, pages
9 and 10, of Maps in the office of the Recorder of Los Angeles
County; thence southerly 42.53 feet along said boundary to the
true point of beginning; thence easterly parallel with the center
line of said Duarte Road to a point of intersection with the
easterly line of Fifth Avenue as shown on map of said Tract;
thence southerl:\' along last mentioned easterly line to a point
that is 15 feet southerly of the northwest corner of Lot 41 of
said Tract; thence easterly at right angles to the last mentioned
course to the easterly line of above mentioned Lot 41; thence
southerly along the easterly line of said Lot 41 to the southeast
corner thereof, said corner being in the boundary of the City of
Arcadia; thence westerly and northerly along the boundary of the
City of Arcadia to the true point of beginning.

SECTION 4. The City Clerk shall certify to the adoption
of this Ordinance and within fifteen (15) days after the date of
adoption hereof shall cause a copy hereof to be published once in
the Arcadia Tribune, and the City Clerk shall upon the taking effect
of this Ordinance, make and certify under the seal of the City of
Arcadia and transmit to the S~cretary of State of the State of
California a copy of this Ordinance giving the date of. its passage.
I HEREBY CERTIFY that the foregoing ordinance was adopted
at a regular meeting of the City Council of the City of Arcadia
held on the 3rd day of Oc tober
, 1961, by the affirmative
vote of at least three Councilmen, to wit:
