HomeMy WebLinkAbout1071 ORDINANCE NO. 1071 , I l^ t' , AK ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ESTABLISHING ALL THAT REAL PROPERTY BOUNDED BY DUARTE ROAD, LOVELL AVENUE, CAMINO REAL AND BALDWIN AVENUE, NOT ALREADY ZONED COMMERCIALLY, IN ZONES C-2, AND C-3 AND D (ARCHITECTURAL OVERLAY) UPON THE PERFORMANCE OF SPECIFIED CONDITIONS PRECEDENT. /4.~# r~"v'. rf" \... 'u ulf -I' .Jl- THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. After proceedings duly instituted by and pub- lic hearings dUly held before the City Planning Commission, and after a public hearing dUly held by the City Council, this Council hereby determines that the public necessity, convenience, general welfare and good zoning practice justify the reclassification as hereinafter provided of all that property bounded by Duarte Road, Lovell Avenue, Camino Real and Baldwin Avenue not already zoned commercially, upon certain specified conditions; that the timely and proper development of the area and good zoning practice require that said property be permitted to be developed in sections as here- inafter set forth; and that such reclassification and development will not be detrimental or injurious to other properties or im- provements in the vicinity. SECTION 2. That property located at 1424 South Baldwin Avenue in the City of Arcadia, County of Los Angeles, State of Cali- fornia, specifically described as Lot 1, except the North 50 feet and the East 100 feet, Tract No. 5907, as shown on map recorded in Book 63, page 67, of Maps, records of said County, presently zoned R-2 and developed and used for church purposes, should be and the same is hereby reclassified and established in Zone C-2. -1- 1071 SECTION 3. That Lots 1 to 9, inclusive, of Tract No. 8487, per map recorded in Book 114, page 48, of Maps, Records of Los Angeles County, should be and the same are hereby reclassified and established in Zone C-3 and also in Zone D (Architectural Over- - lay); p~ovided, however, that such reclassification shall become effective and operative only when and if the following conditions shall have occurred or been fully complied with: a. TI~e Northerly 12 feet of aforesaid Lots 1, 2, 3 and 4, of T~act No. 8487, be dedicated or offered for dedication to the City of Arcadia for the widening of Duarte Road. b. TI1at the Southerly 30 feet of Lot 9, of said Tract No. 8487, be dedicated or offered for dedication to the City of Arcadia for alley purposes. c. That the Easterly 24 feet of Lots 1, 5, 6, 7, 8 and 9 of said Tract No. 8487, be dedicated or offered for dedication to the City of Arcadia for the widening of Lovell Avenue. d. That except for the paving of the properties described in Subsection "a", all properties required by Subsections "a", "b" and "c" hereinabove to be offered or dedicated for street or alley purposes be improved to city standards, or that a cash or surety bond in the estimated amount of the cost of such improvements, as determined by the City Engineer, be deposited with the City of Ar- cadia. SECTION 4. That Lots 5 to 14, inclusive, and Lot 16 of Tract No. 4611, per map recorded in Book 51, page 82, of Maps, Records of Los Angeles County, should be and the same are hereby reclassified and established in Zone C-3 and also in Zone D (Ar- - chitectural Overlay); provided, however, that such reclassifica- tion shall become effective and operative only when and if the fol- lowing conditions shall have occurred or been fully complied with: a. The Southerly 12 feet of aforesaid Lots 5 to 14, in- clusive and Lot 16 of Tract No. 4611, be dedicated or offered for -2- 1071 dedication to the City of Arcadia for the widening of Na;mi Avenue. b. That the Easterly 24 feet of Lot 16 of said Tract No. 4611, be dedicated or offered for dedication to the City of Arcadia for the widening of Lovell Avenue. c. That either the Easterly 15 feet of Lots 1, 2, 3 and 4 and the westerly 15 feet of Lot 5 of said Tract No. 4611, or the Westerly 30 feet of said Lot 5 be dedicated or offered for dedica- tion to the City of Arcadia for alley purposes. d. That all properties required by Subsections "a", "b" and "c" hereinabove to be offered or dedicated for street or alley purposes be improved to city standards, or that a cash or surety bond in the estimated amount of the cost of such improvements, as determined by the City Engineer, be deposited with the City of Arcadia. SECTION 5. That Lots 17 to 27, inclusive, of Tract No. 4611, per map recorded in Book 51, page 82, of Maps, Records of Los Angeles County, should be and the same are hereby reclassified and established in Zone C-3 and also in Zone D (Architectural over- - lay); provided, however, that such reclassification shall become " effective and operative only when and if the following conditions shall have occurred or been fully complied with: a. The Northerly 12 feet of aforesaid Lots 17 to 27, in- clusive, of Tract No. 4611, be dedicated or offered for dedication to the City of Arcadia for the widening of Naomi Avenue. b. That the Easterly 24 feet of Lot 17, Tract No. 4611, be dedicated or offered for dedication to the City of Arcadia for the widening of J~ovell Avenue. c. That either the Southerly 30 feet of said Lots 17 to 27, inclusive, of said Tract No. 4611, or the Northerly 30 feet of the Easterly 100 feet of Lot 1, and the Northerly 30 feet of Lots -3- 1071 4 to 9, inc~usive, of Tract No. 5907, per map recorded in Book 63, page 67, of Maps, Records of Los Angeles County, or any combination of the two resulting in a continuous strip of land 30 feet in width, be dedicated or offered for dedication to the City of Ar- cadia for a~ley purposes. d. That the Easterly 20 feet of Lots 28 and 29, of Tract No. 4611, per map recorded in Book 51, page 82, of Maps, Records of Los Angeles County, or the Westerly 20 feet of Lot 27 of said Tract 4611, be dedicated or offered for dedication to the City of Arcadia for alley purposes. e. That all properties required by Subsections "a", "b", "c" and "d" hereinabove to be offered or dedicated for street or alley purposes be improved to city standards, or that a cash or surety bond in the estimated amount of the cost of such improve- ments, as detefinined by the City Engineer, be deposited with the City of Arcadia. SECTION 6. That the Easterly 100 feet of Lots 1, 2 and 3, and all of Lots 4 to 9, inclusive, of Tract No. 5907, per map recorded in Book 63, page 67, of Maps, Records of Los Angeles County, should be and the same hereby are reclassified and estab- lished in Zone G-3 and also in Zone D (Architectural overlay); - provided, however, that such reclassification shall become effec- tive and operative only when and if the following conditions shall have occurred or been complied with: a. That the Southerly 24 feet of the Easterly 100 feet of Lot 3, and the Southerly 24 feet of Lots 4 to 9, inclusive, of said Tract No. 5907, be dedicated or offered for dedication to the City of Arcadia for the widening of Camino Real. b. That the Easterly 24 feet of Lot 9 of said Tract No. 5907 be dedicated or offered for dedication to the City of Arcadia for the widening of Lovell Avenue. -4- 1071 c. That either the Southerly 30 feet of Lots 17 to 27, inclusive, of Tract No. 4611, per map recorded in Book 51, page 82, of Maps, Rec:ords of Los Angeles County, or the Northerly 30 feet of the Easterly 100 feet of Lot 1 and the Northerly 30 feet of Lots 4 to 9, inclusive, of said Tract No. 5907, or any combina- tion of the two resulting in a continuous strip of land 30 feet in width be dedicated or offered for dedication to the City of Arcadia for alley purposes. d. That all properties required by Subsections "a", "b" and "c" hereinabove to be offered or dedicated for street or alley purposes be improved to city standards, or that a cash or surety bond in the estimated amount of the cost of such improve- ments, as detennined by the City Engineer, be deposited with the City of Arcadia. SECTION? That minor modifications in the specified areas and conditions set forth above may be made by the City Plan- ning Commission and by this Council if such modifications are needed and desirable and will accomplish substantially the same re- sults as will strict adherence to the conditions hereinabove speci- fied. That if, within two (2) years after the effective date hereof, all of the conditions required by anyone of the foregoing~tions shall not have been fulfilled as to all of the properties described within any such section, the properties described within such sec- tion shall again be reviewed by the City Planning Commission and by this Council and appropriate action thereafter taken with respect thereto. 8 SECTION 1. That Ordinance No. 760 of the City of Arcadia and the map therein contained is hereby amended to reclassify and designate the above described properties in Zones C-2, C-3 and D, -5- 1071 as hereinabove respectively set forth. 9 SECTION %. The City Clerk shall certify to the adoption of this ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general cir- culation published and circulated in the City of Arcadia.
