HomeMy WebLinkAbout1087 ORDINANCE NO. 1087 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, VACATING AND ABANDONING A PORTION OF FIFTH AVENUE, A PUBLIC STREET IN SAID CITY AND RESERVING SPECIFIED EASEMENTS THEREIN. THE c:rry COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND ORDAIN AS FOLLOWS: SECTION 1. That Resolution No. 3250 entitled "A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DE- CLARING ITS INTENTION TO VACATE AND ABANDON A PORTION OF FIFTH AVENUE, A PUBLIC STREET IN SAID CITY AND TO EXCEPT AND RESERVE EASEMENTS THEREIN, AND FIXING A TIME AND PLACE FOR THE HEARING OF OBJECTIONS TO SljCH PROPOSED VACATION AND ABANDONMENT" was duly and regularly adopted by the City Council of the City of Arcadia on May 3, 1960; that said Resolution, among other things, fixed the hour of 8:00 o'clock p.m. on the 8th day of June, 1960, in the Council Chamber of the Arcadia City Hall, 240 West Huntington Drive, Arcadia, California, as the time and place for hearing all persons interested in or objecting to the proposed vacation as therein out- lined; that a copy thereof was duly and regularly published in the Arcadia Tribune and Arcadia News, a weekly newspaper of general circulation, published and circulated in said City, as required by the Streets and Highways Code of the State of California, and that the property hereinafter described and proposed to be vacated was dUly and regularly posted as required by the Streets and High- ways Code of the State of California; that the affidavits of said publication and of said posting were duly filed with and are now on file with the City Clerk of the City of Arcadia; that on the 8th day of June, 1960, at the hour of 8:00 o'clock p.m., in the Council Chamber of the Arcadia City Hall, 240 West Huntington -1- 1087 Drive, Arcadia, California, the City Council of the City of Arcadia did accept and receive all testimony offered in support of or in objection to the said proposed vacation; that thereupon the said City Council found from evidence submitted that the property hereinbefore used for street purposes and hereinafter particularly described is unnecessary for present or prospective street purposes, and that the public welfare, convenience, necessity and safety require and will be better served by the vacation thereof as a pUblic street in said City. SECTION 2. That the City of Arcadia does therefore hereby order the vacation and abandonment of that property, heretofore a part of Fifth Avenue, in the City of Arcadia, County of Los Angeles, State of California, specifically described as follows: That portion of Lot 9, Tract No. 5205, as shown on map recorded in Book 54, page 61, of Maps, in the office of the County Recorder of said County, described as follows: Beginning at a point in the easterly line of Lot 9, Tract No. 5205, in Book 54, page 61, of Maps, said point being 40 feet South from the northeast corner of said lot; thence South 0002' West 136.0 feet along the east line of said lot; thence North 29013'35" West, 1l4.57 feet; thence North 36011115" West, 69.39 feet to the south line of Huntington Drive; thence East along the south line of said Huntington Drive, 67.0 feet; thence South 45000' East 28.28 feet; thence East 10.00 feet to the point of beginning. As heretofore determined in Resolution No. 3250, adopted May 3, 1960, the public convenience and necessity require a reservation of easements and rights of way for the various structures enumer- ated in Section 8330 of the Streets and Highways Code of the State of California, the City of Arcadia does therefore hereby reserve and except from the aforesaid vacation and abandonment a permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers, storm drains and appurtenant structures in, upon, over and across -2- 1087 any part of said portions of street proposed to be vacated and, pursuant to any existing franchises or renewals thereof or other- wise, to construct, maintain, operate, replace, remove, renew or enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines and for the transporation and distribution of electric energy, pe- troleum and its products, water, and incidental purposes, including access thereto and therefrom, and the right to keep the property free from inflanmlable materials, wood growth and structures of any nature, and otherwise protect the same from all hazards in, upon and over any and all portions of said street hereby vacated, and as to which easements and rights are thus retained. . SECTION 3. The City Clerk shall certify to the adoption of this ordinance and prior to the expiration of fifteen (15) days from the passage thereof shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation published and circulated in the City of Arcadia.
