ORDINANCE NO. 1005
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
REGULATING THE PARKING OF VEHICLES
ON PRIVATE PROPERTY.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION l. DEFINITIONS. Unless it is apparent from'the
context that another meaning is intended, the following words and
phrases, when used herein, shall be the meaning ascribed to them by
this Section.
a. "Vehicle" shall mean any device in, upon, or by which

any person is or may be transported upon a street or highway.
b. "Person" shall mean and ,include any individual, firm,
, ,
copartnership, association, or corporation.
c. "Park" or "Parking" shall mean the stopping or stand~
,. ,
ing of a vehicle, whether occupied or not.

SECTI'N 2. PARKING ON PRIVATE PROPERTY - WHEN PROHIBITED.
No person shall park a vehicle in or upon a private driveway or in
or upon any private property within the City of Arcadia without the
direct or implied consent of the owner of said driveway or' private
property or the direct or implied co~sent of the person in lawful

possession of any such private driveway or private property.
SECTION 3. EMERGENCY MEASURE. This Ordinance is hereby
declared to be necessary as an emergency measure for preserving the
publiC peace, health and safety and shall take effect immediately
upon its adoption. A statement of the reasons for its urgency is as
follows:
Ordinance No~ 728'was adopted October 5, 1948, regulating
traffic within the City of Arcadia. Since that time' Arcadia has ex-
perienced a tremendous growth in population and a corresponding

increase in the number of vehicles daily traveling upon city streetsj
that said vehicular traffic in the City of Arcadia is abnormally in-
creased by the ever-increasing attendance at the Santa Anita Race
Track. Drivers of vehicles are indiscriminately utilizing private
property as parking space without the direct or implied consent of
the owners of said private property or the tenants in lawful posses-
sion thereof. This indiscriminate use is depriving private property
owners of the use of their property and does specifically and par-
ticularly endanger the lives of patients in the Methodist Hospital

adjacent to the race track, in that doctors and emergency vehicles
are being delayed in arriving at the hospital on emergencies because
of their inability to gain access to the emergency vehicle parking
area at the hospital.
SECTION 4. PENALTY. Any,person violating any of the pro-
visions of this Ordinance shall be guilty of a misdemeanor and upon
conviction thereof shall be punished by imprisonment in the Arcadia
City ,Jail or in the County Jail for not exceeding six (6) months,
or by a fine of not to exceed Five hundred and nO/lOO Doilars
($500.00), or by both such fine and imprisonment.
SECTION 5. CERTIFICATION. The City Clerk shall certify

to the adoption of this Ordinance and prior to the.expiration of
fifteen (15) days from the passage thereof shall cause the same to
be published once in the Arcadia TriQune and Arcadia News, a news-

paper of general circulation, published and circulated in the City
of Arcadia.
I HEREBY CERTIFY that the foregoing Ordinance was adopted
at a regular meeting of the City Council of the City of Arcadia
held on the 21st day of January, 1957, by the affirmative vote of
at least three Councilmen, to wit:
