ORDINANCE NO. 1007
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
APPROVING THE ANNEXATION,TO SAID
CITY OF CERTAIN UNINHABITED TERRITORY
DESIGNATED AS "SOUTHEAST ARCADIA
UNINHABITED ANNEXATION NO. 18".
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
HEREBY DETERMINE AND ORDAIN AS FOLLOWS:

SECTION 1. That pursuant to the provisions of the "An-
nexation of Uninhabited Territory Act of 1939", as amended, a'peti-
tion of the owners of the property hereinafter described was filed
with the City Council of the City of Arcadia, requesting the annexa-
tion to the City of Arcadia, State of California, of that certain
uninhabited territory adjacent to and contiguous with the present
City limits of the City of Arcadia, California, designated as
"Southeast Arcadia Uninhabited Annexation No. 18" and more particu-
larly described hereinafter in Section 10 hereof.

SECTION 2. That the property hereina~er described and
proposed to be annexed to the City of Arcadia is uninhabited ter-

ritory as defined by Section 35303 of the Government Code of the
State of California; that the said described property is contiguous
to the territory contained within the corporate boundaries of the
City of Arcadia; that said petition was signed by the owners of all
of the land in the territory by area, and by assessed value as
shown on the last equalized assessment roll of the County of Los
Angeles in which the territory is situated.
SECTION 3. That said proposal for the annexation of the
hereinafter described uninhabited territory to the City of Arcadia
has heretofore been submitted to and reported upon favorably to the
proponents thereof by the Boundary Commission of the County of Los
Angeles, with respect to the definiteness and certainty of the

proposed boundaries thereof and as to the other matters referred to
in and as required by Section 35002 of the said California Govern-
ment Code.

SECTION 4. That at a regular meeting of the City Council
of the City of Arcadia, held on the 7th day of January, 1958, Reso-
lution No. 2968 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA, CALIFORNIA, SETTING A PUBLIC HEARING CONCERNING
AND GIVING NOTICE OF THE TIME' AND PLACE OF A PUBLIC HEARING CONCERN-
ING THE PROPOSED ANNEXATION OF CERTAIN TERRITORY ADJACENT AND CON-
TIGUOUS TO THE PRESENT CITY LIMITS OF THE CITY OF ARCADIA, THE SAME
BEING SITUATED NEAR THE SOUTHEAST PORTION OF THE CITY OF ARCADIA
AND DESIGNATED AS · SOUTHEAST ARCADIA UNINHABITED ANNEXATION NO. 18 I"
was adopted by said City Council, giving notice of and fixing the
18th day of February, 1958, at 8;00 o'clock p.m., in the Council
Chambers of the City of Arcadia, as the day, hour and place when and
where all persons owning real property in said territory so proposed
to be armexed, and having any objection to the proposed annexation,
might appear before the said City Council of the City of Arcadia
and show cause why such territory should not be so annexed. That a
copy of said Resolution No. 2968 was published in the Arcadia Tri-
bune and Arcadia News, a newspaper of general circulation published
in the City of Arcadia, at least twice but not oftener than once a
week, which said publications were completed at least twenty days
prior to February 18, 1958, the date set for the hearing on said an-
nexation.

SECTION 5. That written notice of such proposed annexa-
tion was given to each person owning land within the territory thus
proposed to be annexed in accordance with and as required by Sec-
tion 35311 of the Govern ment Code of the State of California.
SECTION 6. That no person has filed his name, address or

the designation of the lands in which he has an interest, either
legal or equitable, with the City Clerk of the City of Arcadia.

SECTION 7. That protest was not made by the owners of
one-half or more of the value of the territory as shown by the last
equal'ized assessment roll. That no portion of said territory is
owned by a public agency; that no portion of said territory consists
of publicly owned property and no protest was made by a public ~r.
SECTION 8. That the annexation of the hereinafter de-
scribed territory is not precluded by Section 35002.5 of the said
J California Government Code. That all proceedings concerning South-
east Arcadia Uninhabited Annexation No. 18 have been in conformity
with the law applicable thereto.
SECTION 9. That under and pursuant to and in accordance
with the provisions of the Annexation of Uninhabited Territory Act

of 1939, as amended, the annexation of that certain uninhabited ter-
ritory contiguous to said City of Arcadia and known and designated

as "SOUTHEAST ARCADIA UNINHABITED ANNEXATION NO. 18" be and the
same is hereby ratified, confirmed and approved, and the same is
hereby ordained to be annexed to and made a part of the City of
Arcadia, California.
SECTION 10. That on the 3rd day of January, 1958, there
was filed with the City Clerk the written consent of the owners of
t all of the real property so proposed to be annexed to the City of
Arcadia, wherein consent was given that the said property, after its
annexation to the City of Arcadia, may be taxed equally with the
property within the City of Arcadia, to pay the bonded indebtedness
of the City of Arcadia, both interest and principle, outstanding on
the date of such annexation, heretofore authorized and issued by
the City Council of the City of Arcadia, to wit:

SECTION 11. That a specific description of the boundaries

of said territory hereinabove referred to is as follows:
That portion of Lot 126, Arcadia Acreage Tract,
in the County of Los Angeles, state of California,
as recorded in Book 10, page 18, of Maps, records
of said county, described as follows:

Begirming at the southeast corner of Tract No.
21122 as recorded in Book 568, pages 44 and 45,
of Maps, records of said county; thence southerly
along the westerly line of the easement for flood
control purposes as provided in deed recorded in
Book 17446, page 163, of Official Records of said
County, South 11045'53" West 177.29 feet to the
beginning of a tangent curve concave to the East
and having a radius of 2070.00 feet, said curve
also being said westerly line; thence southerly
along said curve to a northerly line of the City
of Arcadia; thence westerly, northeasterly and
easterly along the boundary lines of the City of
Arcadia, as the same existed on December 1, 1957,
to the point of begirming.

SECTION 12. That the boundaries of the City of Arcadia,
California, be and the same are hereby altered to include the above
described territory, the armexation of which is hereby approved and
ordained herein and incorporated in the City of Arcadia) California.
SECTION 13. The City Clerk shall certify to the adoption
of this Ordinance 'and prior to.the expiration of fifteen (15) days
from the passage thereof, shall cause the same to be published once
in the Arcadia Tribune and Arcadia News, a newspaper of general

circulation published and circulated in the City of Arcadia.
SECTION 14. The City Clerk shall thereupon, on the taking
effect of this Ordinance, make and certify under the seal of the City
of Arcadia and transmit to the Secretary of State of the State of
California, a copy of this Ordinance giving the date of its passage.
I HEREBY CERTIFY that the foregoing Ordinance was adopted
at a regular meeting of the City Council of the City of Arcadia
