OF ARCADIA AND THE DRINKING OF ALCOHOLIC BEVERAGES IN CERTAIN PUBLIC' PLACES IN SAID CITY AND REPEALING ORDINANCE NO. 74. THE CITY COUNCIL OF THE CITY OF ARCADIA. CALIFORNIA,' DOES ORDAIN AS FOLLOWS: SECTION 1. No' person 'shall be or appear in or at any pub- ,/ :lic 'place, or in .or a't any place open, to the public view, or in, at , or upon any street, sidewalk, road, place, way, court, parkway, park or highway in a state of drunkenness or intoxication. SECTION 2. No person shall be in, at or on any private premises or in or at any private house in a state of drunkenness or intoxication to the annoyance or disturbance of any other person. SECTION 3. No person whether in any type of vehicle or n9t, shall drink any liquid containing more than one-half percent of alcohol by volume in or upon any public street, sidewalk, road, place, way, court, parkway, park, highway, public hall or other pub- lic place withi~ the City of Arcadia. SECTION 4. That Ordinance No. 74, entitled "AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE CITY OF ARCADIA PROVIDING FOR THE PUNISHMENT OF DRUNKENNESS AND OF DISORDERLY PERSONS THEREIN", a- dopted February 6, 1918, be and the same.is hereby repealed. SECTION 5. Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not more than Five Hundred and nO/IOO Dollars ($500.00) or by imprisonment in -1- 1021 the city jailor the county jail for a period of not more than ninety (90) days or by both such fine and imprisonment. SECTION 6. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held unconstitutional, such decision shall not affect the validity of the remaining por~ tion of this Ordinance. The legislative body hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that . . anyone or 'more sections, subsections, sentences, clauses or phrases be declared unconstitutional. SECTION 7. The City Clerk shall certify to .the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general cir- culation, published and circulated in the City of Arcadia. I HEREBY CERTIFY that 'the foregoing Ordinance w~s adopted at a regular meeting of the City Council of the City of Arcadia, held on the 5th day of . August , 1958, by the affirmative vote of at least three Councilmen, to wit: AYES: Cquncilmen Jacobi, Balser and Phillips NOES: None .'
