REGULATING THE HOURS OF PUBLIC USE OF THE WILDERNESS PARK AREA. ~ A; ()/d:31 THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: ,c.\; SECTION I. DEFINITIONS. Unless it is apparent from the context that another meaning is intended, the following words and phrases, when used herein, shall have the meaning ascribed to them by this section. a. "Person" shall mean and include any individual, firm, copartnership, association or corporation. . , d. "Wilderness,Park Area" shall mean that certain real property owned by the City of Arcadia, located in the northeast sec- tion of the City of Arcadia and commonly referred to as the Wilder- ness Park Ir~a, comprising eight and one-half acres more or less, all as more particularly described in deed to the City of Arcadia recorded in Book 54190, page 426, of Official Records in the office of the County Recorder of Los Angeles .County, together with the access road thereto described as Lot 49, Tract 23l44, per map re- corded in Book 624, page 62, of Maps, in the office of the Recorder of said County. C: \ SECTION 2. WILDERNESS PARK. USE PROHIBITED DURING CER- TAIN HOURS. No person shall, at any time between one hour after sunset and one hour after sunrise of the following day, be or re- main in or upon, or enter, either on foot or by vehicle, or drive, operate, park or be in any vehicle within the Wilderness Park area. -1- 1024 ~ SECTION~. EXCEPTIONS. The provisions of the preceding section shall not apply to any person or personBparticipating in organized and supervised recreational activities at the Wilderness Park.area conducted or sponsored by any charitable, religious or fraternal organization with the approval of the Recreation Director of the City of Arcadia, nor to any employee of the City of Arcadia or of any public utility or governmental agency, who during said hours is required to enter or be in said area in the course of his employment. . SECTION 4, PENALTY. Any person violating any of the pro- visions of this Ordinance shall be guilty of a misdemeanor and upon. conviction thereof shall be punished by imprisonment in the Arcadia City Jailor in the County Jail for not exceeding six (6) months, or by a fine of not to exceed Five Hundred and nO/lOa Dollars ($500.00), or by both such fine and imprisonment. SECTION 5. EMERGENCY MEASURE. This Ordinance is hereby declared to be necessary as an emergency measure of preserving the public peace, health and safety and shall take effect immediately upon its adoption. A statement of the reasons for its urgency is 'as follows:' The above described Wilderness Park area has been devel- oped as a public recreational facility enhanced by natural wilder- ness growth in the foothill region. Due to the isolated and remote area where it is located and the difficulty of entry thereto and exit therefrom, adequate police and patrol measures are hard to main- tain, If said area be not closed to the public during night hours, the lack of adequate police supervision will result in said area being frequented by persons for the purpose of committing vandalism, nuisances and immoral acts. Said Wilderness Park area is immedi- ately adjacent to the U. S, National ~orest Preserve and the pres- ence of persons in the Wilderness Park area without adequate official -2- 1024 ... .... supervision will cause an extreme fire hazard to this forestry area and to the water shed area upon which the City of Arcadia is dependent for its water supply. Located within the confines of said area are valuable facilities of the Los Angeles County Flood Control District, expensive city-owned camp site equipment, fire control devices, sanitary facilities and other supplies. This type of facility is a natural attractant to unsupervised and unrestrained juveniles during the night hours, as evidenced by the fact that within two weeks after the Wilderness Park area was opened to public use, extensive damage to the facilities therein was caused by vandals during t!1e night hours. SECTION 6. CERTIFICATION.
