HomeMy WebLinkAbout1038 -" ORDINANCE NO. 1038 AN ORDINANCE OF THE CITY OF ARCADIA, CALIFORNIA, ADOPTING BY REFERENCE A PRIMARY CODE ENTITLED "FIRE PREVENTION CODE" (EDITION OF 1956) AND ALSO THE SECONDARY CODES REFERRED TO IN SAID PRIMARY CODE, AND REPEALING ORDINANCE NO. 775. -' THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1, FIRE PREVENTION CODES ADOPTED. With the ex- -. ception of ,the deletions and amendments set forth more particularly hereinafter, there are hereby adopted by reference the following codes for the City of Arcadia: a, PRIMARY CODE, The "Fire Prevention Code", a code pre- . scribing regulations governing conditions hazardous to life and prop- . erty from fire, Edition 1956, proposed and recommended by the Na- tional Board of Fire Underwriters, 85 John Street, New York 88, New York; 222 West Adams Street, Chicago 6, Illinois; and 465 California Street, San Francisco 4, California, which foregoing code is hereby designated as the "Primary Code" adopted by reference. ,. b, SECONDARY CODES. It is the intent and purpose of all of the aforesaid codes set forth herein to prescribe regulations con- sistent with nationally recognized standard practice for the safe- guarding of life and property to a reasonable degree from the hazards of fire and explosion arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the use or occupancy of buildings or premises. The titles of the various secondary codes hereinbefore listed indicate more particularly the specific purposes or the sub- divisions of said basic purposes, contributing to the safeguarding of life and property from the hazards of fire and explosion. +- ~ SECTION 3. DEFINITIONS. The words used in each of the codes herein adopted by reference shall have the meaning ascribed I -7- 1038 .... + ~ to them within each respective code, and in addition thereto the following words shall be understood and defined to have the mean- ings set forth in the following subsections: ao Whenever the term "Agency" is used, it shall mean the City of Arcadia or the appropriate agency of said City as the con- test may reasonably requireo bo Whenever the term "Municipality"is used, it shall refer to the City of Arcadiao Co Whenever the term "Legislative Body" is used, it shall ... mean the City Council of the City of Arcadiao do Whenever the term "enforcing officer" or "chief en- forcing officer" or "chief" is used, the said term shall refer to the Chief of the City of Arcadia Fire Department, unless the City Council shall designate some other officer in place and stead there- ofo .. eo Whenever the term "Chief of the Bureau of Fire Preven- tion" is used, it shall mean Chief of the City of Arcadia Fire De- +- partment or his duly authorized representativeo fo If any term used in said codes shall refer to an of- ficer, agency, board, or body not set up by or within the City of Arcadia, the term shall be deemed to refer to such officer, body, or agency as shall in fact be charged with the responsibility of performing the duty intended to be performed by said officer, ,<- agency, board or body 0 +- .k SECTION 40 AMENDMENTS, ADDITIONS AND DELETIONSo The fol- lowing sections and provisions of the Fire Prevention Code hereby adopted are hereby amended, deleted, repealed or augmented as more particularly set forth in the following subsections: ao Section 1015 is hereby added to Article 1 of said Uni- form Fire Code, to read as follows: SECTION 10150 PEACE OFFICER AUTHORITYo (1) To carry out the purposes of this Code the Chief of the City of Arcadia Fire Department and his representatives ~ -8- 1038 .~ -'- hereby are made and given the powers of police officers and are empowered to inspect and abate any condition that constitutes a fire hazard. (2) The Chief of Police of the City of Arcadia and his representatives shall have the power, and hereby are dir- ected upon the request of the Chief of the City of Arcadia Fire Department or his representatives to assist in the enforcement ~ of the provisions of this Code. b. Section 1.16 is hereby added to Article 1 of said Uni- form Fire Code, to read as follows: ... SECTION l.16. FALSE ALARMS PROHIBITED. No person shall send in an alarm from any fire alarm box or telephone system or any verbal alarm except for the pur- pose of giving an alarm of a fire or emergency which such per- son has good reason to believe endangers life or property. ,~ c. Section 1.17 is hereby added to Article 1 of said Uni- form Fire Code, to read as follows: SECTION 1.17. TAMPERING WITH FIRE DEPARTMENT EQUIP- MENT PROHIBITED. No person except a person authorized by the Chief or his representative, an authorized repair man, or any employee of the City acting within the scope of his public duties, shall tamper with in any manner any lock, gate, door, barrier, en- closure, fire hydrant, fire alarm circuit, fire alarm box or -+ auxiliary fire fighting apparatus or other equipment which is +- installed by, under the control of, or for the use of the Fire Department of the City. d. Section 1.18 is hereby added to Article 1 of said Uni- form Fire Code, to read as follows: SECTION l.18. INTERFERING WITH FIREMAN. It shall be unlawful for any person to interfere with ~ any officer or member of the Fire Department, or to refuse or neglect to obey any lawful order or requirement of any officer .... -9- 1038 ,. .. or member of the Fire Department, while such officer or member is in the lawful performance of his duties as such fireman. e. Section 1,l9 is hereby added to Article 1 of said Uni- form Code, to read as follows: SECTION 1, 19. FIRE HYDRANT OBSTRUCTION, No person shall place or keep any box, fence, trash, or other material, including vegetation near any fire hydrant, which will in any manner obscure the fire hydrant or hinder the Fire Department from gaining immediate access thereto, Whenever the Chief determines that the v1s'ibil1ty of . any fire hydrant is wholly or partially obscured to the view of members of the Fire Department answering emergency fire calls by light or sign standards, utility poles, or by similar installations on the sidewalk, street, or parkway, he may cause to be painted on each such obstruction a stripe, the top of which shall be not more than six feet above the surface of the sidewalk, street or parkway in which such obstruction is lo- cated, The stripe shall not be over twelve inches in width and shall be the same color as that of the fire hydrant so ob- structed. f, Section 1.20 is hereby added to Article I of said Uni- form Fire Code, to read as follows: SECTION 1,20. NOTICE OF BLOCKING STREETS, Any person excavating or working upon any street, alley or public thoroughfare and by reason thereof, or for any other reason, causing the same to be blocked or made impassa- ble shall notify the Fire Department at the time such work is started and upon the completion thereof. g, Section 1,21 is hereby added to Article 1 of said Uni- form Fire Code, to read as follows: .. - ... +- ... -~ -10- 1038 '.. .. ~. ~ - . ... " ... SECTION 1.21. FIRE DEPARTMENT BADGE. No person shall wear, display or have in his posses- sion any badge or shield of the same design as adopted as the official badge or shield of the City of Arcadia Fire Depart- ment, unless such person shall be a duly appointed acting mem- ber of said Fire Department. h. Section 1.21.1 is hereby added to Article 1 of said Uniform Fire Code, to read as follows: SECTION 1,21.1. SAME. EXCEPTION. The provisions of the preceding Section 1.21 shall not apply to any member of said Fire Department who has been honor- ably retired on a pension and who may have in his possession a facsimile of the official badge or shield presented to him by the City Countil, provided that the same shall plainly indicate the fact that such former member is no longer in the active ser- vice of the Fire Department, i, Section 13,07 is hereby added to Article 13 of said Uniform Fire Code, to read as follows: SECTION 13,07 FIRE EXTINGUISHER SERVICE AND REPAIR (1) No person shall service, repair, fill or refill any portable fire extinguisher which is to be used, kept or maintained in this City as required by any law to be kept, maintained, or is displayed for use as a fire protection de- vice in or upon any vehicle, lot, building, structure or prem- ises, or any portion thereof, unless such person shall have first made application for and received from the Chief a Certi- ficate of Fitness authorizing such person to perform the acts of servicing, repairing, filling or refilling any such port- able fire extinguisher. (2) Each application for a Certificate of Fitness shall be in writing upon a form furnished by the Chief, The application shall be signed by the applicant in the presence -11- 1038 '. of the Chief or his duly authorized representative. Any appli- cant shall be at least 21 years of age. The application shall contain: (a) The full name of the applicant. (b) The age, wejght, height, color of eyes, color of hair and sex of the applicant. (c) The business and resident address of the .... applicant. ~ (d) The address to which applicant desires all notices, required to be given under the provisions of this Code, to be directed. (e) A statement of the applicants experience and qualifications. (f) If employed, the name and business address of the employer. (g) Two prints of a bust picture of the appli- cant, one inch by one inch in size. (h) Such other and further information reason- ably related to the qualifications of the applicant as may be required by the Chief. (3) The Chief may deny an application for a Certifi- cate of Fitness if he finds that the applicant: (a) Is unable to furnish satisfactory proof of qualifications or ability. (b) Has violated any provisions of this Code. (c) Has been guilty of practices constituting fraud upon the public. (4) The City Council may upon the recommendation of the Chief suspend or revoke any Certificate of Fitness if it finds that the holder of the Certificate of Fitness has violated any of the provisions of this Code or upon any ground which would have been ground for denial at the time of the original appl1ca tion. ~ - .. . ~ -12- 1038 ,,.. ..... (a) The Chief shall notify the certificate holder that the Chief intends to recommend suspension or revocation of his Certificate and not less than 5 days thereafter or at the next regular Council meeting the Chief shall present the facts upon which he bases his recommendation and at that time the certificate holder shall be afforded every opportunity to offer evidence in his behalf. (b) At the conclusion of the hearing the City Council shall revoke or suspend the Certificate of Fit- ness or shall permit the certificate to remain in full force and effect. (5) Form of the Certificate. The certificate of Fitness shall be issued by the Chief and shall be in the form of an identification card, said card, to be valid, shall: (a) State the purpose for which it has been -- ~ issued. ., (b) State the date it is issued and the date of expiration. (c) Contain such information as may be neces- sary to identify the person to whom it is issued. (d) Have affixed one print of the photograph of the person to whom it is issued. (e) Have the signature of the person to whom it is issued and the company, if any, that he represents, (f) Have printed thereon in bold type the following: "This Certificate identifies, but does not recommend the bearer," (g) It shall contain any other information that the Chief considers necessary and proper to effect the proper identification of the holder thereof. + . .. ,4 -13- 1038 1 4. (6) The certificate holder shall, upon request, show the same to anyone for whom he seeks to service, repair, fill or refill any portable fire extinguisher, or to the Chief or his duly authorized representativeo (7) Any applicant for a Certificate of Fitness shall furnish satisfactory proof to the Chief that he is familiar with the materials required to be used in servicing, repairing, filling or refilling any portable fire extinguisher; that he is competent to do and perform any and all acts necessary or inci- dental thereto; and that he is familiar with and knows the ap- plication of the requirements of all provisions of this Code or any other laws relating to portable fire extinguishers. If the Chief determines that the applicant for any such Certificate conforms in all particulars with the requirements prescribed by this Section, the Chief shall grant such Certificate of Fit- ness. . . (8) Expiration of Certificate, All Certificates of Fitness issued shall be for three years from the date of issu- ance, unless a shorter time is provided for in said Certificate. jo Section 150507 is hereby added to Division V of Article 15 of said Uniform Fire Code, to read as follows: SECTION 15.507. No person shall vacate or discontinue a gasoline fill- ing or automotive service station business without having first given the Chief of the Fire Department of the City of Arcadia at least five (5) days' written notice thereof and when such gasoline, filling or automotive service station is closed or temporarily abandoned, the following regulations must be com- plied with by the operator of same, or other person in charge thereof: - ~ ,# (1) Underground tanks to be pumped down to where pump line breaks suction, leaving a small amount of gasoline below foot valve in the tank. ~ -14- 1038 ~ (2) Filler caps must be made wrench tight secure. Filler pipe box to be filled with sand, surfaced with a thin layer of concrete, leaving filler box cover in place. (3) Existing vents must be maintained and left free and open. 4 (4) Pump to be drained of gasoline and suction line from tank sealed off at the pump. Filler hose to be removed from pump and discharge capped or plugged. (5) All pump operating electrical circuits to be turned off or disconnected. (6) stations and all buildings on premises must be securely closed so as to prevent unauthorized persons gaining access thereto. (7) Gasoline buggies or other approved above-ground storage facilities must be removed from the premises or purged in such manner so as to make them gas-free. (8) If the station and premises are to be permanently abandoned, the tank or tanks must be removed; provided, however, upon permit from the Chief of the Fire Department, the tank may be filled with sand, earth, concrete or another equally accept- able process. (9) The foregoing regulations must be complied with within fifteen (15) days of said clOSing, temporary abandon- ment or permanent abandonment and any service station or other storage facilities close~temporarily abandoned or permanently abandoned prior to the effective date of this Ordinance must be made to conform with the foregoing regulations within fif- teen (15) days of notification of the passage of this Ordinance. (10) Upon discontinuance of gasoline service to any leased or privately owned service station or gasoline storage facilities, the servicing company shall notify said Chief of the Fire Department within five (5) days, and furnish name and ~ 4 ~' * ~ -15- 1038 ~ 4 address of owner or operator of such closed or abandoned stor- age facilities, k. Section 26.01 of the Fire Prevention Code as adopted herein is hereby amended to read as .follows: SECTION 26.01. BONFIRES AND OUTDOOR RUBBISH FIRES. All burning of combustible waste material permitted under this Section is subject to the restrictions of the Air Pollution Control District, County of Los Angeles, as the same now exists or are hereafter amended. (1) Fires on Public Property. It shall be unlawful for any person except an officer or employee of the City within the scope of his duties, to set fire to, ignite or burn any combustible material of substance upon any street, alley, side- walk, park, parkway or other public property within the City. Exception: This provision shall not probhibit a person from utilizing cooking and campfire facilities provided in the city parks if required permits are first obtained. (2) Restrictions on Incinerators and Open Fires. No person shall dispose of any combustible was~e material by burning or kindle or maintain any bonfire or rubbish fire, or authorize any such fire to be kindled or maintained on any lot or parcel of land within the city except as follows: (a) All outdoor burning done outside of an authorized incinerator shall require a written permit from the Chief of the Fire Department or his representative con- taining all the provisions deemed necessary for fire safety. Exception: This provision shall not pro- hibit the preparation of food by use of charcoal braziers, barbeque pits and similar devices on pri- vate premises where use of such device is not contrary to any proviSions of this Code, and such burning is not hazardous to life or property. -16- 1038 -} ~, ~ ~ ~ ~ 4 (b) An approved type incinerator shall mean an incinerator which has complied with all the regulations of the Air Pollution Control District, County of Los Angeles and the City Fire and Building Departments. The location of said incinerator shall be approved by the Fire Chief or his representative, 1. The Fire Prevention Code as adopted herein is hereby amended by adding to Article 26 thereof a new Section 26.13, to read as follows: ~ SECTION 26.13, AUTHORITY TO CORRECT CONDITIONS. (1) No person shall maintain or cause to be maintained or used, any device, appliance, apparatus, equipment, tank, tank vehicle, business process, structure or other place or thing which does not conform to the provisions of this Code, or which is not specifically covered under the provisions of this Code which due to improper use, maintenance, or to a defective condition, con- stitutes or contributes to or causes a condition liable to cause fire. -+ ~ (2) When any such condition is found, it shall be the duty of the Chief to order in writing an abatement or correction or installation of adequate safeguards, which shall conform to the minimum requirements of any ordinance of the City, law of the State, or order as set forth by the Fire Marshal of the State. In the event there is no such ordinance, law or order covering the specific conditions, then any such written order given by the Chief shall be based upon the minimum requirements of the current recommendations of the National Board of Fire Underwriters or other nationally recognized authority. (3) Unless immediate action is taken, or can be taken, to comply with his order, then he shall have the power to cause any act, performance, activity, operation or other condition contributing to or creating such condition, to cease until proper correction or compliance is made. ~ ~ k -17- 1038 .. . mo The Fire Prevention Code as adopted herein is hereby amended by adding to Article 26 thereof a new Section 26.15, to read as follows: SECTION 26,15, VACANT BUILDINGS. Every person owning or in charge or control of any vacant building shall remove therefrom all accumulations of flammable or combustible waste and rubbish and shall securely ~ lock, barricade, or otherwise secure, all windows, doors, and other openings thereof, so as to prevent unauthorized persons from gaining access thereto. -~. n. The Fire Prevention Code as adopted herein is hereby amended by adding to Article 26 thereof a new Section 26.16, to read as follows: SECTION 26.16, BLOCKING FUSES. . It shall be unlawful for any person to block or allow to be blocked in any manner any fuse or fuses used in any elec- trical circuit located on or within any building or structure. .. o. The following portions of the Fire Prevention Code as herein adopted are hereby deleted and repealed, to wit: ~ Section 3.04 of Article 3. Section 5.07 of Article 5. Article 8 in its entirety. Article 12 in its entirety. Paragraph k of Section 15.102 of Article 15, Sp.ction 15.504 of Article 15, Article 25 in its entirety. Article 29 in its entirety. Appendix B in its entirety. AppendiX D in its entirety, . SECTION 5. FIRE PREVENTION BUREAU. There is hereby es- tab Ii shed a Bureau of Fire Prevention in the Fire Department of the City of Arcadia and said Bureau shall operate under the direction and supervision of the Chief of the Fire Department. a. DUTIES. The Fire Prevention Code shall be enforced by the Bureau of Fire Prevention, The Chief of the Fire Department + may detail to such Bureau, to act in the capacity of Inspectors, in -18- 1038 ~ ~ addition to the inspectors authorized by the City Council, such mem- bers of the Fire Department as shall from time to time be necessary to enforce the Fire Prevention Code. SECTION 6, STORAGE OF FLAMMABLE LIQUIDS IN OUTSIDE ABOVE- GROUND TANKS PROHIBITED. The limits referred to in Section 15,201 of the Fire Prevention Code in which storage .~ of flammable liquids in outside above-ground tanks is prohibited are hereby established as the boundaries of the City of Arcadia as the same now exist or as the same may at any time hereafter exist, -+-. SECTION 7. NEW BULK PLANTS PROHIBITED. The l~mits re- ferred to in Section 15.401 of the Fire Prevention Code in which limits of the districts in which new bulk plants for flammable .. liquids are prohibited are hereby established as the boundaries of the City of Arcadia as the same now exist or as the same may at any time hereafter exist, .. SECTION 8. BULK STORAGE OF LIQUID PETROLEUM GAS RESTRICTED. The limits referred to in Section 19.06,a of the Fire Prevention Code, in which bulk storage of liquefied petroleum gas is restricted, are hereby established as the boundaries of the City of Arcadia as the same now exist or as the same may at any time hereafter exist, SECTION 9. STORAGE OF EXPLOSIVES AND AMMUNITION RESTRICTED. .. The limits referred to in Section 11.01 of the Fire Prevention Code, ... in which the storage of explosives and ammunition is restricted, are hereby established as the boundaries of the City of Arcadia as the same now exist or as the same may at any time hereafter exist. SECTION 10, EXCEPTION, The City Council may, upon writ- ten application, and after receipt of the report and recommendation . of the Fire Chief, after finding upon the evidence received that the ~ public health, safety, and welfare will not be jeopardized, alter ':0- -19- 1038 -+ -+- the limits fixed by any of the preceding four sections. Such al- teration of limits shall be effected by the vote of at least three of the members of the Council entered upon the Council minutes, SECTION 11. MODIFICATIONS, The Chief of the Fire Depart- ment shall have power to modify any provisions of the Fire Preven- tion Code upon application in writing by the owner or lessee, or ~ h~s duly authorized agent, where there are practical difficulties in the way of carrying out the strict letter of the Code, provided that the spirit of the Code shall be observed, public safety secured and substantial justice done, The particulars of such modifications ... when granted or allowed and the decision of the Chief thereon shall be entered upon the records of the Fire Department and a signed copy shall be furnished the applicant. ~ SECTION 12. APPEALS. Whenever the Chief of the Fire De- partment shall disapprove an application or refuse to grant a license or permit applied for, or when it is claimed that the provisions of of the Code do not apply or that the true intent and meaning of the Code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief of the Fire Department to the City Council within thirty (30) days from the date of the deci- sion. ~ SECTION 13. REPEALS. Ordinance No. 775, entitled "AN k ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA PROVIDING FOR k' THE ESTABLISHMENT OF A BUREAU OF FIRE PREVENTION, PROVIDING OFFICERS THEREFOR, DEFINING THEIR POWERS AND DUTIES, PRESCRIBING REGULATIONS FOR FIRE PROTECTION AND FIRE PREVENTION AND LIFE SAFETY IN CONNEC- TION WITH HAZARDOUS MATERIALS AND PROCESSES IN SAID CITY: PROVID- ING PENALTIES FOR THE VIOLATION THEREOF: AND REPEALING CERTAIN PARTS OF ORDINANCE NO. 323 OF THE CITY OF ARCADIA, ApOPTED SEPTEMBER 17, 1935, AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HERE- . ~ ~ WITH", adopted July 19, 1949 and all other ordinances in conflict herewith, are hereby repealed, -20- 1038 + -. SECTION 14. SEVERABILITY, If any section, subsection, sentence, clause, phrase, or portion of this Ordinance, including but not limited to any exemption by the decision of any court of competent jurisdiction is for any reason held to be invalid or un- constitutional by the decision of any court of competent jurisdic- tion, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council of the City of Arcadia hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions' be declared invalid or un- constitutional. 'f -. + SECTION 15. PENALTY, Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not more than Five Hundred Dollars ($500.00) or by imprisonment in the city jail of the City of Arcadia, California, or in the county jail of the County of Los Angeles, California, as the committing magis- trate may direct, 'for a period of not more than six (6) months, or by both such fine and imprisonment in the discretion of the court. Each separate day or any portion thereof during which any violation of this Ordinance occurs or continues shall constitute a separate offense and upon conviction thereof .shall be punishable as herein provided. ~ .~ + . SECTION 16. CERTIFICATION. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a news- paper of general circulation, published and circulated in the City of Arcadia, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. ~ -21- 1038 .. ..
