AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
AMENDING ORDINANCE NO. 737 OF SAID
CITY BY ADDING THERETO A NEW SECTION
NO. 23-A.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:

SECTION 1. That Ordinance No. 737 of the City of Arcadia,
adopted November 16, 1948, entitled "AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ARCADIA, CALIFORNIA, LICENSING THE TRANSACTION AND
CARRYING ON OF CERTAIN BUSI1~SSES, TRADES, PROFESSIONS, CALLINGS
AND OCCUPATIONS IN THE CITY OF ARCADIA, FOR THE PURPOSE OF RAISING
MUNICIPAL REVENUES, AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF
AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH", be and the same is hereby amended by adding thereto a
new Section No. 23-A, the same to read as follows:

SECTION'23-A. AMUSEMENT AND GAME MACHINES - LICENSE RATES -
PENALTIES. Notwithstanding the provisions of Subsection 19 of Sec-
tion 23, for every person renting, leasing, owning or maintaining,
as a business or in connection with any business, any amusement or
game machine or device; any juke box; any device for the playing of
records or music automatically upon deposit of a coin, slug or other
device; any pin ball machine; or any other or similar instrument,
machine or device of like character, not prohibited by law, where

any sum is charged by means of a coin, slot or otherwise; Twenty-
five and nO/100 dollars ($25.00) per year or fraction thereof for
each such machine.
Each application for such a license shall describe the
type of machine, the serial number, if any, the name of the manu-
facturer and the location where each machine is to be operated.

Each machine shall also bear the name of the licensee in plain view
in letters of not less than one-fourth inch in height.

Any machine or device licensed hereunder may be removed
from the place of operation for which it has been licensed and re-
placed with a like or similar machine or device at any time during
the term of the license issued hereunder, upon the payment totne
Business License Officer of a transfer fee in the amount of One
Dollar ($1.00) and upon the submission in writing to such Officer

of all the information concerning such replacement machine or de-
vice as is required in an initial application for any such machine
or device.
Each and every machine described herein and operated in

the City of Arcadia and not licensed or not complying with other
regulations of this Ordinance may be sea1ed.against further opera-
tion and held by the City of Arcadia, at the owner's risk, until
all license fees, storage charges and other accumulated costs are
paid.
Every person,' firm or corporation, either as principal,
'agent, employee or otherwise, who operates, plays or utilizes, or
permits any person'or persons to operate, play or utilize any
amusement machine, game or device licensed under the provisions
hereof, for the purpose of gambling, betting, wagering or pledging
in.any manner whatsoever, any money, thing, consideration of value
or the' equivalent, or memorandum thereof upon the outcome, score
or result of the playing or operation of said amusement machine,

game or device, is guilty of a misdemeanor and upon conviction
thereof shall be punished by a fine not exceeding Five Hundred and
nO/100 Dollars ($500.00) or by imprisonment in the City Jail of
said City of Arcadia, or in the County Jail of the County of Los
Angeles for not exceeding six (6) months, or by both such fine or
imprisonment.
SECTION 2.' This Ordinance is hereby declared to be neces-
sary as an emergency measure for preserving the public peace, health

and safety, and shall take effect immediately upon its adoption.
A statement of the reasons for its urgency is as follows:
During recent months the City Council of the City of
Arcadia has conducted extensive public hearings and investigations
concerning the effect upon public peace, health and safety of the
operation, owning, renting, leasing or using of game and amuse-
ment machines and devices within the City of Arcadia.

These hearings and investigations have demonstrated the
necessity for the immediate prohibition of the use of such machines
and devices as instruments of .gamb1ing or being used in connection
with gambling activities. ,
This Ordinance is expressly adopted for the purpose of
pr~hibitingwagering or gambling upon the result or outcome of any
game or amusement machine or device as the same is defined herein.

SECTION 3. The City Clerk shall certify to the adoption
of this Ordinance and prior to the expiration of fifteen (15) days
from the passage thereof shall cause the same to be' published once
in the Arcadia Tribune and Arcadia News, a newspaper of general
circulation, publish~d and circulated in the City of Arcadia.
I HEREBY CERTIFY that the foregoing Ordinance was adopted
at a regular meeting of the City Council of the City of Arcadia,
held on the 20th day of
January , 1959, by the affirmative
vote of at least three Councilmen, .to wit:
