HomeMy WebLinkAbout1045 ~ ORDINANCE NO. 1045 ,AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CALLING A SPECIAL ELECTION TO BE HELD ON THE TWENTY-FOURTH DAY OF MARCH, 1959, PERTAINING TO THE ANNEXATION TO THE CITY OF ARCADIA OF ANNEXATION NO. l7-A, SOUTHWEST . ARCADIA INHABITED. ~ WHEREAS, by Resolution No. 3083, the City Council of the City of Arcadia declared its intention to call a special election to be held on the twenty-fourth day of March, 1959, in certain in- habited territory contiguous to said City proposed to be annexed to said City, for the purpose of submitting to the qualified elec- tors residing in said territory the question whether or not said territory shall be annexed to said City; and, WHEREAS, a copy of said Resolution was published as re- quired by. law; and, . ' WHEREAS, within the time prescribed by law written or oral protests or objections were not filed or made by the owners, either public or private, of one-half of the value of the terri- tory proposed to be annexed as shown by the last equalized assess- ment roll; and, ,~ WHEREAS, all proceedings have been had in accordance with. said Resolution and the Annexation Act of 1913, reference thereto hereby being made for further particulars; NOW ,THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. A special election hereby is called tQ be held on the twenty-fourth day of March, 1959, in the territory hereinafter described and proposed to be annexed to the City of .,. -1- 1045 + .. . 'f Arcadia, for the purpose of submitting to the qualified electorsre- siding in said territory the question whether or,not such territory , shall be annexed to, incorporated in, and male'apart of said City of Arcadia. Beginning at a point in the boundar,v ot the City ot Ar- cadia, as same existed on March 1, 1957, said point lying in the northerly line of Lot 2, Block C, Santa Anita !and Company's Tract, as per map recorded in Book 6, page 137, ot Maps in the otfioe of the Reoorder of Los Angeles County, 247.14 feet easterly of the northwest corner of said Lot 2; thence southerly 327.11 feet along a line parallel with the easterly line ot said Lot 2 to the south- erly line thereof; thenoe easterly along the southerly lines of Lots 2 and 1 of said Block C to the southeast corner of said Lot 1; thence easterly in a direct line to a point in the westerly line of Lot 2, Block B of said Santa. Anita Land Company's Tract, said point lying 10.23 teet northerly from the southwest corner of said last mentioned Lot 2; thence easterly parallel with the northerly line ot said last mentioned Lot 2 a distance ot 300 feet; thence southerly parallel with the westerly line of said last mentioned Lot 2 to the southerly line thereof; thence easterly along the southerly lines of Lots 2 and 1 of said Block B to the southeast corner of Lot 1 of said Block B; thence easterly in a direct line to the southwest corner of Lot 2 of Block A of said Santa Anita Land Company's Tract; thence 378 feet easterly along the southerly line of Lot 2 of said Block A to a point; thence southerly along a line, said line being parallel with the easterly line of Lot 3 of said Block A, to,a point in the southerly line of said Lot 3; thence easterly along said last mentioned southerly line a dis- tance of 3 feet; thence southerly parallel with the easterly line of Lot 6 of said Block A to a point in the northerly line of Lot 7 of said Block A; thence westerly along last mentioned northerly line a distance of 15 feet; thence southerly in a direot line to the southeasterly corner of Lot 12 of said last mentioned tract, being a point in the northerly line of Lot 6 of Block G of the previously mentioned Santa Anita Land Company's Tract; thence westerly along the southerly line of said last mentioned lot to a line that is parallel with and distant 280 feet westerly, measured at right angles, from the westerly line of Baldwin Avenue 55 feet wide as shown on said last mentioned map; thence generally in a northerly and westerly direction along the various courses and distances of the westerly and southerly boundar1es of said City of Arcadia to the point. of beginning. -4- 1045 -+ SECTION 2. The po11s'at said election shall be opened at 7:00 o'clock a.m. of the day herein fixed for the holding of said election and shall be kept open until 7:00 Q'clock p.m. of the same day, when .the polls shall be closed. .' SECTION 3. Upon the ballots to be used at said election there shall be printed the words: SHALL ANNEXATION NO. 17-A, SOUTHWEST ARCADIA INHABITED, BE ANNEXED TO THE CITY OF ARCADIA? Opposite these words there shall be printed the words "Yes" and "No", and to the right of each of these last two words there shall be a voting square. If an elector shall stamp a cross (+-) in the voting square after the printed word "Yes" the vote of such elector shall be counted in favor of the annexation of said territory to the City of Arcadia; and if an elector shall stamp a cross (+) in the voting square after the printed word "No" the vote of such elector shall be counted against such annexation. Except as otherwise prOVided by law, the ballots used, the opening and closing of the polls, and the conduct of the elec- tion in the territory shall conform as nearly as possible with the Elections Code provisions concerning general elections. t- SECTION 4. For the purpose of said election there hereby are established in the territory described herein two (2) voting precincts, which shall include all of said territory. The follow- ing are the polling places of said election precincts and the fol- lowing named persons hereby are named officers of election and shall constitute the boards of election for such election precincts, re- spectively, as fo1Yows: r -5- 1045 ... . Cutter 9903 Estrella Avenue, Te~ple City For their services in connection with said election, each inspector shall receive fifteen and nO/100 dollars ($15.00) and each judge twelve and nO/100 dollars ($12.00); and the person in posses- sion of the polling place named herein shall receive for the use of such premises in connection with said election the sum of twelve and nO/100 dollars ($12.00). SECTION 5. The City Clerk shall publish a notice of said special election as .required by said Annexation Act of 1913, at least once a week for 'the four (4) weeks prior to the date of the election on March 24, 1959, in the Temple City Times, a newspaper of general circulation printed and published outside of the City of Arcadia but in the County of Los Angeles, California. ~ SECTION 6. This Ordinance shall take effect upon its '-r adoption. .. -6- 1045 , SECTION 7. The City Clerk shall certify to the adoption of this Ordinance by a vote of more than two-thirds of all of the members of the City Council and shall cause said Ordinance to be published once within fifteen days after its adoption in. the Arcadia Tribune. and Arcadia News, a weekly newspaper of general circulation, published and circulated in the City of Arcadia.
