ORDINANCE NO.' 1049 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, PROHIBITING THE CONSTRUCTION OF DWELLINGS AND STRUCTURES UPON CERTAIN LOTS AND PORTIONS OF LOTS IN SAID CITY AND REPEALING ORDINANCE NO. 1040. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That from the effective date of this Ordinance, it shall be unlawful for any person, firm or corporation to erect, ~ construct or alter, or permit to be erected, constructed or altered any dwelling or structure upon the following real property lying between Baldwin Avenue and Holly Avenue in the City of Arcadia, County of Los Angeles, State of California, to wit: All those portions of lots, included within the following described exterior boundary line in Tract No. 3430, as shown on map recorded in Book 42, page 32, of Maps, Records of Los Angeles County, to wit: Beginning at the southeast corner of Lot 20; thence north along the east line of said lot 74.94 feet; thence west parallel with the south line of said lot and its westerly prOlongation 190.00 feet; thence north parallel with the east line of Lot 21 and 14.90 feet westerly therefrom to a point distant 85 feet north from the south line of Lot 21; thence southwesterly in a direct line to a point in the east line of Lot 26 distant north 25 feet from the southeast corner of said Lot 26; thence south along the east line of Lot 26 to a point distant 10 feet north from the southeast corner thereof; thence westerly parallel with and 10 feet northerly from the south line of Lot 26 to the west line of said lot; thence south to a point in the west line of Lot 49 distant south 75 feet from the northwest corner of said Lot 49; thence easterly parallel with and 75 feet southerly from the north line of Lot 49 to the east line of said Lot 49; thence south thereon 10 feet; thence northeasterly in a direct line to a point 79.19 feet easterly measured along the north line of Lot 54 and 25 feet south from the northwest corner of Lot 54; thence north parallel with the west line of Lot 54 to a point 10 feet southerly from the northerly line of said lot; thence easter- ly parallel with ,and 10 feet southerly from the north line of Lots 54 and 55 to the east line of said Lot 55; thence north thereon 10 feet to the point of beginning. +-- t' ... Beginning ,at the southeast corner of Lot 27; thence north along the ~ast line of said lot 10 feet; thence westerly parallel with and 10 feet northerly from the south line of said lot to the west line thereof; thence north thereon 15 feet; thence westerly parallel with and 25 feet northerly from the south lines of Lots 28 and 29 to the west line of Lot 29; thence northwesterly in a direct -1- ~ ,...... + .. +- line toa point in the east line of Lot 31 distant north, 55 feet from the southeast corner of said Lot 31; thence westerly parallel with and 55 feet northerly from the south lines of' Lots 31, 32, 33 and 34 to the west line of Lot 34; thence south thereon to a point 30 feet north from the southeast corner of Lot 34; thence westerly parallel with and 30 feet north from the south line of Lot 37 to the east line of Baldwin Avenue (95 feet wide); thence southerly thereon to a point distant 30 feet southerly from the north line of Lot 38; thence easterly parallel with and 30 feet southerly from the north line of Lot 38 to the east line of said lot; thence north thereon to the northeast corner of said lot; thence easterly to the northwest corner of Lot 43; thence southerly on the west line of said lot 55 feet; thence easterly parallel with and 55 feet south- erly from the north line of Lot 43 to the east line thereof; thence north thereon to the northeast corner of said lot; thence easterly to the northwest corner of Lot 45; thence south on the west line of said lot 55 feet; thence southeasterly in a direct line to a point in the east line of Lot 45 distant south 85 feet from the northeast corner of said lot; thence easterly parallel with and 85 feet south from the north lines of Lots 46 and 47 to a point distant 16.88 feet west from the east line of Lot 47; thence south:- ' . parallel with the east line of'Lot 47 15 feet; thence easterlyPar~ , ~~' with and 100 feet south from the north line of Lots 47 and 4S-- " to the east line of said Lot 48; thence north thereon 100 feet to _ : , ..the point of beginning. SECTION 2. This ordinance is hereby declared to be neces- sary as an emergency measure for preserving the public peace, health and' safety, and shall take effect immediately upon its adoption. A statement of the reasons for its urgency is as follows: That pursuant to City of Arcadia Planning Commission Reso- lution No. 299, adopted July 8, 1958, the said Planning Commission recommended to the City Council that certain property referred to in said Resolution be rezoned and that Arcadia Avenue be opened and improved along the lots and portions of the lots described in Section 1 above. That said recommendation is now being considered by the .. City Counc1l and proceedings are now being held by said City Council prior to final determination of the matter. That the comprehensive general plan of development for this area contemplates the opening and improving of a street to be known as Arcadia Avenue'and that any development on the portion of lots described in Section 1 herein- above will preclude and prevent the contemplated development, open- ing and improving of Arcadia Avenue. In order to preserve the plans for the development and_rezoning of this area and to further preserve the r public peace, health and safety it is necessary that this ordinance ~ t - -2- 1049 ... take effect immediately and that the construction, erection or alteration of dwellings, buildings and structures in the area described in Section 1 above be prohibited. Further detailed study of the area now indicate that the above described area, but no more than the above described area will be required for the opening and improvement of Arcadia Avenue as proposed. SECTION 3. Any person violating any of the provisions ,--0 t of this Ordinance shall ,be guilty of a misdemeanor and upon con- viction thereof,'shall b~ .punished by imprisonment in the Arcadia City Jailor in the County Jail for not exceeding six (6) months, or , by a fine of not to' exceed Five Hundred and nO/lOO Dollars ($500.00), or by both such fine and imprisonment. . SECTION 4. That Ordinance No. i040, entitled "AN ORDIN- i. ANCE OF THE CITY OF ARCADIA, CALIFORNIA, PROHIBITING THE CONSTRUCTION OF DWELLINGS AND STRUCTURES UPON CERTAIN LOTS AND PORTIONS OF LOTS IN J SAID CITY," adopted December 2, 1958, b~ and the same is hereby re- pealed. +- SECTION 5. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia. Tribune and Arcadia News; a newspaper of general cir- culation published and circulated in the City of Arcadia.
