THE BOARD OF TRUSTEES OF THE CITY OF ARCADIA DO OR- DAIN AS FOLI.O\'JS: SECTION 1: That it shall be unlawful for any person owing, having an interest in, harboring, or having the care, charge control, custody or possession of any dog, to allow or permit such dog to go free or to run at large in or upon any street, publio way, square or other publiC place in said C~ty of Arcadia unless around the neck of said dog is a collar to which is attached a tag bearing the :number marked thereon by the City Tax and License Col- lector of said City of Arcadia, provided however, that this require ment shall not apply to any dog which accompanies its owner, such owner not being a resident of said City of Arcadia. Uhen such dog is taken up by any Police Officer, same shall 19 20 be delivered by him to said Pound Master, and all of said dogs shall be impodnded in the Public Pound. SECTION 4: Said Pound Master shall keep confined in said Pound, properly provided with food and water, for trxee days, all dogs impounded by him and until said dog or dogs be redeemed 21 22 23 24 by the paymsnt of $1.00 pound fee. Said Pound Master shall post 25 a desoription of all dogs impounded by him in three publio places in said City of Arcadia for a period not less than three days and if any dog is not redeemed within three days after the description has been so posted, said dog shall be killed by the Pound liaster 26 27 28 29 30 in some humans way. 31 SECTION 5: The word "dog" whenever ussd in this Ordi- nance, shall be deemed to include female as uell as male dogs. S SECTION 8: Said Pound Master shall pay over weekly 9 to the City Treasurer all sums collected by him as herein provided 10 and make a monthly report to said Board of Trustees of his proceed- 11 ings hereunder. 12 SECTIOli 9: Ths terms "lhninclosed lot or premi ses" as 13 used in this Ordinance, is hereby defined as meaning any lot, land 14 or premises not enclosed in such manner as to prevent any dog con- 15 fined therein from esoaping therefrom. C 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 son shall bel examined by the City Health Officer and it shall be the duty of suoh City Health Officer when oalled upon to examine any suoh dog, to ascertain whether or not such dog is afflicted with rabiss, Any dog found by said City Health Officer upon ex- amination te> be so afflioted shall bs at once killed by the person having possElssion thereof, and any dog found not to be sQ afflicted upon examinetion, and after sufficient time for proper observation thereof, shall be returned to the owner thereof upon the payment of the expenses incurred in impounding such dog, which shall not exceed fifty cents per day. The City Health Officer is hereby authorized to pro- vide for thEI care of the dogs captured and held pursuant to the provisions (If this Ordinance, and the expenses incurred thereby shall, in c~~ses where such dogs are not reolaimed, be paid by the' City of ArcHdia not exoeeding fifty cents per day for each dog. Every person who kills any dog, as herein provided shall bury ()r destroy the same. If any dog is found not to be afflicted With rabies and is not reo1aimed by the owner thereof, within ten (10) days after the oapture thereof, such dog shall be killed by the person captur,ing the same, or given to such person as V/lll pay the expense incurred in impounding such dog. SECTION 14: Whenever any animal shall be bitten by another animal having rabies, it shall be unlawful for the owner or person having the care, control, custody or posseSSion of the animal so bitten, upon being informed thereof, to fail, refuse or neglect to either kill such animal or quarantine it, and keep it confined or tied up for a period of six months, and the City Health Officer or his deputy shall have the power, in his discretion, to kill or qua.rantine the animal so bitten in case the ooner or per- son having the oustody or possession thereof shall fail to do so immediately', or in case the ol7I1er or person having the care, con- tro1, custcldy or possession thereof is not readily accessible. SECTION 15: It shall be unlal'1fu1 for any person to bring any ~og into the City of Arcadia from any place in which rabies shall be present or shall have been knO\'ffi to be present within six months, without permission of the City Health Officer. SECTION 16; That Sections 10 to 15, both inclusive of this Ordinance, shall be operative only when rabies exist in or near the City of Arcadia. It shall be the duty of the City Health Officer to determine when rabies exist in or near the City of Ar- cadia and his finding in the matter shall be final and conclusive. Notice of the finding of the City Health Officer as to the exist- ence of rabiee and as to the termination of the existence thereof in and near said City of Arcadia s~ll be given by one publication in such neuspaper 'published ~d circulated within said City as said Bo(~rd of Trustees may designate. SECTION 17: That any person, firm or corporation violating any of the provisions of this Ordinance 'shall be deemed guilty of !~ misdemeanor and upon conviction thereof shall be pun- ished by a fine not exceeding $300.00 or by i~prisonment in the -5- , , O,A-ciuY1~.-yzu. SECTION 19: This Ordinance is urgently required for 2 3 4 the immediate preservation of the public peace, health and safety as cases of rabies exist within portions of the County of Los An- geles and sa.id.
