SUBJECT: Pavement Reqair of Utilitv Cuts
Recommendation: Award a one year contract extension in the amount of
$94,400.00 to Paveco Construction Inc. for the Pavement Repair of Utility
Cuts Maintenance Contract
SUMMARY
On August 19, 2003, the City Council approved a one (1) year Agreement with optional
contract extensions to Paveco Construction Inc. for the on-call pavement repair of utility
cuts. On January 4, 2005 the City Council extended this contract. Paveco has
reached the end of its second year of the contract and has submitted a written offer to
extend the existing contract for an additional one year in accordance with the existing
Agreement. Paveco Construction Inc. has agreed to continue the contract using the
same unit bid amounts adjusted by the consumer price index (4.4%) for an additional
one-year term contract:
Based on the excellent seroice provided by Paveco Construction Inc. from the previous
year, staff recommends that the City Council award a one (1) year contract extension in
the amount of $94,400.00 to Paveco Construction Inc. for Pavement Repair of Utility
Cuts.
DISCUSSION
City street crew's current workload prohibit timely repair of utility cuts within the
roadway. The logistical complexity of dealing with perishable hot mix.asphalt paving
material, labor intensity of the work, combined with relatively small isolated repairs
results in a highly unproductive operation for City street crews. Private companies who,
on a daily basis, deal with pavement repair of utility cuts for other utility companies and
municipalities in adjacent cities are readily mobilized and tooled to provide this service
at cost effective rates. Contracting this type of work to a private contracting company
has provided complete utility cut asphalt repairs in a timely and cost effective manner.

On August 19, 2003, the City Council approved a one (1) year Agreement with optional

Pavement Repair of Utility Cuts. On January 4 2005 the City Council extended this
contract for one additional year in the amount of $90,450: The Previous two year's
workloads adjusted by future _projections result in a proposed $94,400.00 budget for
utility cut repairs over the next twelve months.
Staff recommends that the City Council award a one (1) year contract extension in the
amount of $94,400 to Paveco Construction Inc. for Pavement Repair of Utility Cuts.
ENVIRONMENTAL ANALYSIS
Pursuant to Section 1.5302, Replacement or Reconstruction, of the California
Environmental Quality Act, this project is categorically exempt.
FISCAL IMPACT .
There is no fiscal impact on the budget. This work is funded from the fee deposit
collected from each permit. ~
RECOMMENDATIONS
1. Award a one (1) year contract extension in the amount of $94,400.00 to
Paveco Construction Inc. for Pavement Repair of Utility Cuts.
3. Authorize the City Manager and City Clerk to execute a contract in a form

Recommendation: Accept all work performed by Alliance Streetworks,
Inc. for the construction of the Street Rehabilitation of Santa Anita Avenue
and Sunset Boulevard Project as complete and authorize the final
payment to be made in accordance with the contract documents
SUMMARY
On July 5, 2005, the City Council awarded a contract to Alliance Streetworks, Inc. in the
amount of $598,836.30 for street rehabilitation of Santa Anita Avenue and Sunset
Boulevard. There were a total of three (3) change orders decreasing the total contract
by $41,523.99.
The terms and conditions of this project have been complied with and the required work
has been performed to staff's satisfaction for a finai cost of $557,312.31. Staff is
recommending that the City Council accept the project as complete and authorize the
fina~ payment in accordance with the approved contract documents.
BACKGROUND
Roadway analysis conducted as part of the City's pavement maintenance system
prioritized Santa Anita Avenue and Sunset Boulevard to be rehabilitated. A budget of
$821,000 consisting of $725,190 Federal Funds and $95,810 Proposition C Funds for
rehabilitation of the two streets was approved in the 2004-05 Capital Improvement
Program.
Staff prepared plans and specifications and opened bids on June 23, 2005. There were
nine (9) bidders with Alliance Streetworks, Inc. being the low bidder. On July 5, 2005,
the City Council awarded the contract to Alliance Streetworks, Inc. in the amount of
$598,836.30.

DISCUSSION
This rehabifitation of Santa Anita Avenue and 5unset Boulevard involved the typical
aspects of construction normally associated with these types of projects. This project
included curb, gutter, sidewalk, driveway approach and handicap access improvements
as well as grinding and asphalt pavement overlay. Construction began September
2005 and was substantially complete mid November 2005.
The distinguishing feature of this particular project is that the majority of the funding is
from the Federal Highway Administration (FHA). The City of Arcadia receives an
annual allocation of Surface Transportation Program-Local (STP-L) Funds. Projects
are approved and STP-L funds distributed by the MTA. Federally funded projects are
subject to more stringent standards than typical projects, and therefore, require a higher
degree of oversight. To this end, staff hired Willdan Associates to perform inspections
and materials testing during the construction phase.
Overall, the project was successful. The final construction costs were seven percent
(7%) less than the original contract and the contractor successfully fulfilled the
requirements of the plans and specifications. There were two change orders for extra
work not anticipated. One change order was to repair asphalt pavement that an
emergency vehicle drove over while it was still hot; and the other was to replace a
section of raised gutter and asphalt missed on the original plan. The total cost for these
extras was $7,209.00, and is included in the final construction cost.
FISCAL IMPACT
Surface Transportation Program-Local (STP-L) and Proposition "C" Funds in the
amount of $821,000 were appropriated for this project in the 2004-05 CIP. The original
contract amount was $598,836.30. With adjusted quantities, the final construction cost
for this project is $557,312.31. Additional costs were incurred for engineering,
inspection, contract administration and materials testing in the amount of $61,110.00
bringing the total project cost to $618,422.31. Funds are available to cover all costs.
RECOMMENDATION
That the City Council accepts all work performed by Alliance Streetworks, Inc. for
the Street Rehabilitation of Santa Anita Avenue and Sunset Boulevard Project as
complete and authorizes the final payment to be made in accordance with the
contract documents.

On December 13, 2001, the Los Angeles Regional Water Quality Control Board issued
National Pollutant Discharge Elimination System (NPDES) Stormwater Permit, Order
01-182. This permit mandate.s that the City implement and require post-construction
control requirements in the form of a Standard Urban Stormwater Mitigation Plan
(SUSMP) to reduce pollutants in storm water runoff for specific types of developments.
Currently, the City's municipal code has SUSMP requirements for developments of 5
acres or greater. The. proposed Ordinance will change this threshold, to meet more
stringent, updated requirements for 1 acre, or greater, of disturbed land.
Staff recommends that the City Council introduce Ordinance No. 2216, amending
Section 7823 of the Arcadia Municipal Code concerning the City's Stormwater and
Urban Run-off Listings for New Construction, for land disturbing activities of 1 acre or
more.
DISCUSSION
In July of 1996, the California Regional Water Quality Control Board issued a National
Pollutant Discharge Elimination System (NPDES) permit to the County of Los Angeles.
Eighty-four • incorporated cities, including the City of Arcadia, were listed as co-
permittees to this permit for the purpose of controliing and minimizing the discharge of
pollutants associated with storm water and urban runoff. Furthermore, this permit
mandates that the City implement and require post-construction control measures, in
the form of a Standard Urban Stormwater Mitigation Plan (SUSMP) to reduce poliutants
in stormwater runoff for specific types and sizes of developments. By adopting
Resolution 6215, on March 20, 2001,.the City Council adopted SUSMP regulations. On
August 6, 2002, the City Councii adopted Resolution No. 6318, further amending the
City's SUSMP regulations to be in conformance with the new December 13, 2001,
Regional Board permit.

The City of Arcadia's Municipal Code Section 7823, paragraph (c) cites construction
projects in this category as land disturbing activities of 5 acres or greater. This section
of the AMC needs to be amended to meet the current requirement of 1 acre or more of
land disturbing activities for construction projects, which went in to effect March 10,
2003. This amendment will not have a significant impact to developers on sites of this
size. Staff has been enforcing the 1-acre. requirement as stipulated in the Permit
through all routine plan-checking activities since March of 2003.
Staff recommends that the City Council introduce Ordinance No. 2216, amending
Section 7823 of the Arcadia Municipal Code concerning the City's Stormwater and
Urban Run-off Listings for New Construction, for land disturbing activities of 1 acre or
more.
FISCAL IMPACT
No impact on the General Fund. SUSMP plan checking . expenses and post-
construction related expenses are pass-through costs for the City.
RECOMMENDATION
Introduce the proposed Ordinance No. 2216, amending the City's Standard Urban
Storm Water Mitigation Plan listings for new construction projects.

ORDINANCE NO. 2216
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, AMENDING STORM WATER
AND URBAN RUNOFF CONTROLS FOR NEW
CONSTRUCTION
WHEREAS, under the provisions of the Porter-Cologne Act, the State Water
Resources Control Board (SWRCB) and nine regional water quality control boards
adopt policies and plans relaring to water quality control in the State, which
together comprise the uniform water quality guidelines for California; and
WHEREAS, in December 2001, the Regional Board adopted Order No. O1-
182, which added addirional cafegories of development piojects requiring a
Standard Urban Stormwater ~Mitigadon Plan (SUSMP) and replaced the previous
site visit with a requirement of site inspections; and
WHEREAS, on August 6, 2002, the City Council adopted additional
SUSMP requirements of the Regional Board, as required; and
WHEREAS, it is reasonable and appropriate for the City Council to amend
the Arcadia Municipal Code in order to comply with Ordei No. 01-182 adopted by
the California Regional Water Quality Control Boazd for Los Angeles County.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECT'ION 1. Article VII, Chapter 8, Secrion 7823 subsection (c) of the
Arcadia Municipal Code is amended to read in its entirety as follows:

"(c) Best Management Pracrices for New Developments and
Redevelopments. No grading pernut shall be issued for any development with a
disturbed area of one (1) acre o"r greater unless the applicant can show that (i) a
Norice of Intent to comply with the State Construcrion Activity Storm Water
Permit has been filed and (ii) a Storm Water Polludon Prevention Plan has been
prepared. The City may adopt regulations establishing controls on the volume and
rate of stormwater runoff from new developments and redevelopments of less than
one (1) acre as may be appropriate to minimize the discharge and Uransport of
pollutants. The Development Services Director may require that any developer or
construcrion contractor performing work in the City provide a Local Stormwater
Pollution Prevention Plan prior to the beginning of such work. Construction
activity does not include routine maintenance to maintain original line and grade,
hydraulic capacity, the original purpose of the facility or emergency construcrion
activities required to protect the public health and safety."
SECTION 2. The City Clerk sha11 certify to the adoprion of this
Ordinance and sha11 cause a copy or summary of same to be published in the
official newspaper of said City within fifteen (15) days of its adoption.

SUMMARY:
The purpose of this report is to provide background information so the Council may address the
matter of vacancies for unexpired terms on the Arcadia Beautiful Commission and the Planning
Commission.
DISCUSSION:
On January 31, 2006, the City Council acted to place this item on tonighYs agenda to discuss,
provide direction and/or make appointments to fill vacancies for the remaining unexpired terms
on the Arcadia Beautiful Commission and Planning Commission, Two vacancies were created
when Commissioners Peter Amundson (Arcadia Beautiful) and S. H. Wen (Planning) filed their
City Council Candidate nomination papers.
Staff has included the following documents as attachments to this report to assist the Ciry
Council on the process by which to address this matter:

The unexpired terms for each vacancy are as follows:
Arcadia Beautiful Commission Term expires 06-30-09
Planning Commission Term expires 06-30-06
If appointments are made, the new Commissioners may apply again for their Board and
Commission seat, or for any other Board or Commission seat once this partial term expires.
This interim service does not fall under the provisions of the City's adopted term limits pursuant

to City Charter Section 8~2. They would be eligible to serve two (2) additional full terms on any
Board or Commission.
FISCAL IMPACT:
There is no fiscal impact to the City Council's action on this matter.
RECOMMENDATION:
It is staff's recommendation that the City Council discuss, provide direction and/or make
appointments to address the vacancies for unexpired terms on the Arcadia Beautiful
Commission and Planning Commission.
