CADIA ESTABLISHING SET-BACK LINES ON PORTIONS OF HUNTINGTON DRIVE 2 AND FIRST AVENUE IN SAID CITY OF ARCADIA AND REPEALING ORDINANCE NO. 110 OF SA.ID CITY OF ARCADIA. 3 ~'HE BOARD OF TRUSTEES OF THE CITY OF ARCADIA DO ORDAIN 4 AS FOLLOWS: 5 SECTION 1: That it shall be unlawful for any person, fir 6 or corporation to erect, construct or locate a building or other ',u7 structure upon any Lot fronting on Hunt ington Drive between First . No. yS I 8 Avenue and Bscond Avenue, in said City of Arcadia, unless the sams 9 be set back to a line which is distant five (5) feet from and par- 10 allel to the respective property lines of said Huntington Drive. 11 That it shall be unlawful for any p.erson, firm or. cor.. 12 poration to erect, construct or locate a building or other structur o ' . z ~ li1o, upon any Lo.t fronting on Huntington Drive between Santa Anita Avenu z3~iyf( ~~; g 14 and First Avenue in said City of Arcadia, unless the same be set . Mo. :1..-3 f 22 23 24 25 26 27 28 29 30 31 32 or corporation to erect, construct or locate any building or other structure upon any Lot fronting on First Avenue between Foothill Boulevard and California Street in said City of Arcadia, except as hereinafter specified, unless the same be set back to a line which is distant ten (10) feet from and parallel to the respective pro- perty linee, of said First Avenue, excepting therefrom the Easterly side of sa:l.d First Avenue between St. Joseph Street and the North- erly line of the right of way of The Atchison, Topeka and Santa F~ Railway Con~any, providsd however, that nothing herein contained shall be so construed as to prevent the second floor or second story of any building heretofore erected or constructed on the West erly side of said First Avenue between St. Joseph Street and the Northerly line of said right of way,extend1ng beyond the set back liIfB herein established. LrJa:~' ~ 0 z 0 16 .J~z~ C:C:Cl:~O J ::E . 17 . effect, any person, firm or corporation having any interest in any land upon which a set back line is hereby established, may file with the City Clerk a protest against the same, stating briefly the groun s of objection. All such protests must be in writing and be delivered to the City Clerk before said Ordinance takes effect. At the time of eaid heari.ng or any time to which said hearing may be continued, the protestants may appear before the Board of Trustees and be heard either in person or by counsel and said Board of Trustees shall bear and pass upon said protests and its decision thereon shall be final and conclusive. SECTION 4: Any person, firm or corporation violating any of the proviuions of this Ordinance shall be deemed guilty of a mis- demeanor and upon conviction thereof shall be punished by a fine not exceeding $300.00 or by imprisonment in the City Jail of said City of Arcadia for a period not exceeding three months or by both such fine anti imprisonment. SECTION 5: That Ordinance No. 110 of said City of Arcadia entitled :nAn Ordinance of the Board of Trustees of the City of Ar- cadia establishing set back lines on portions of Huntington Drive and First Avenue in said City of Arcadian, adopted October 18, 1922, be and the same is hereby repealed. SECTION 6: The City Clerk shall certify to the adoption .iEI'L'Lw23 of this Ordinance and shall cause the same to be published once in lRO.
