MOVING, FOIt THE AN OlIDINANCE REGULATING THE CONSTRUCTION, ALTERATIOIl, REPAIR, AND DEMOLISHING OF BUILDINGS AND THE USE THEREOF, PROVIDING ISSUING OT" PEm:II~'S FOR THE SAME. SECTION 1. It shall be unlawful for any person, firm or corporation, to hereafter erect, construct, alter, repair, raise, build upon, move, demolish, maintain or use, or to cause, permit or suffer to be errected, constructed, altered, repaired, raised, built upon, moved, demolished, maintained or used, in or upon any tract of land subdivided into City lots within the City of Arcadia, and building or structure or any portion thereof, in a manner that shall violate any of the provisions of this ordinance. SECTION 2. It shall be unlawful for any person, firm or corporation, either as owner, architect or builder, to conunence or pro- ceed with the erection, construction, alteration, repair, moving or de- molishing, exceeding twenty dollars in cost (restoration of plastering or painting excepted), of any building or other structure upon any City lot in the City of Arcadia unless a pennit to do such work has first been obtained, as herein provided. Any person desiring such permit shall file with the building conunittee of this Board on a blank to be furnished by said Board, an application therefor together with a set of plans, sections, elevations, and specifications, of the work pro- posed to be done. Such application shall set forth the land upon which the proposed work is to be done, describing the same by the lot and block or other accurate description, the general demensions of the building to be constructed, altered, repaired, moved, or demolished; the number and heiehth of stories thereof, the names of the owner, the architect and the contractor or builder; and estimate of the cost of the proposed work, and purpose for which such building, alteration or repair is designed; and such other matters as the building conunittee may re- quire. There shall be appointed by the Board of Trustees annually, on the 15th. day of December of each year, from their own members, a com~ittee of three, to be known as ~~e building committee, whose powers and duties are hereinafter in this ordinance set forth. - 1 - O/W(VVtCf/nC-(.. /20. /7 SECTION 3. It shall be the duty of the Building Committee and the said Building Committee shall have power to issue building permits in accordance with this ordinance, on the payment of the fees hereinafter provided, whenever in their judgment, the proposed building to be erect- ed, constructed, altered, repaired, raised, built upon, moved, demolish- ed, maintained or used within the City of Arcadia, is of a proper character and not dangerous to health, life, limb of property, or un- sightly or liable to become a nuisance. After a permit has been granted for any purposes as aforesaid, by the Building Committee, the Committee shall report the same immediately to the Board of Tl'ustees for its action thereon, and the Board of Trustees, upon receiving the report of the Building Committee, shall act finally upon the matter within five days, and in case the Board of Trustees shall fail to confirm or reject the action of the Building Committee, said permit shall become final. SECTION 4. After a permit has been granted for the construction, alteration, repair, moving or demolishing of any building, the plans thereof, shall not be changed without notice having been given to the building committee of such changes, and the nature thereof and a permit secured from such committee or the Board of Trustees therefor. The issuance of a permit shall not be considered an approval by the Board of Trustees of the plans and specifications, unless the Board of Trustees shall fail to confirm or reject the same within five days after the granting thereof. Nothing in this ordinance contained shall apply to affect or authorize the moving of any building upon any public street, alley, or place. SECTION 5. 'The fees to be paid to the Building Committee and by the Building Committee to the Treasurer of said City, shall be in the sum of One Dollar for each permit. SECTION 6. If any person, whether as owner, architect, or builder, shall commence the erection, construction, alteration, l'epair, moving or demolishing of any building, without a pe~nit first having been obtained from the Building Committee of the Board of Trustees when required by this ordinance, he shall be required when subsequently - 2 - ONd,./1'~' /'to, 17 taking out such pernlit to pay for the same double the amount of the fee hereinbefore provided for such permit. SECTION 7. The Building Co~nittee shall keep in proper books an accurate account of all fees received under this ordinance giving the name of the party paying the same and the date and the amount, which book shall be open for public inspection. They shall pay all fees received by them into the City Treasury upon the following business day. SECTION 8. If the work authorized by said permit is not begun within ninety days from the date thereof, said permit shall be thereafter void, and before such work can be commenced a new permit shall be taken out, and the same fees as herein fixed for the original permit shall be paid. SECTION 9. If work upon any building shall be conducted in violation of any of the provisions of this ordinance, the Building Committee shall revoke the permit, and if work upon any building shall be abandoned for a period of more than ninety days, the Building Committee shall re voke the permit. SECTION 10. Whenever the Board of Trustees shall find that any strl structure, or any part thereof, is dangerous to person or property, or is unsafe for the purpose for which it is used, or is in danger of fire from any defect in its construction, or that the doors, passage ways, or stairways of any structure are insufficient for the escape of occupants in case of fire, or do not conform to the ordinances of the City of Arcadia, it shall notify the owner person in charge or occupant thereof in writing, specifying wherein such structure is dangerous, un- safe or defective, or not in conformity with said ordinances, a nd re- quiring such owner, person in charge or occupant forthwith to remove, demolish or repair the same or to make such alterations therein as may be necessary to make such structure to conform to said ordinances, and the person receiving such notice shall within forty eight hours after receiving same, begin to comply therewith, and shall complete the works so required, as soon as practicable. It shall be unlawful for any person to use or permit to the use of any such structure, or part thereof, -3 - O~{,f/t/VC<~t=" /1-0, 17 described in said notice unless the work mentioned in said notice shall have been done. SECTION 11. No permit shall be granted by the Building Committee for the erection, alteration, construction or repair of any building or portion thereof which, by reason of any part of its construction or system of construction, shall be dangerous in respect to fire. S1~TION 12. Any person, firm or corporation violating any of the provisions of this Ordinance, shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not less than Five Dollars nor more than One Hundred Dollars, or by imprisonment in the City Jail for not less than Five days nor more than Six Months, or by both such fine and imprisonment. Each such person, firm or cor- poration shall be deemed guilty of a separate offence for every day during which any building erected, constructed, altered, repaired, raised, built upon or moved by such person, firm or corporation in violation of any of the provisions of this Ordinance continues in such conditions, and for every day during Mlich any other violation of this Ordinance by such person, firm or corporation continues, and shall be punishable therefor, as herein provided. SECTION 13. This Ordinance shall be printed and posted in at least three public places in the City of Arcadia. Adopted by the Board of Trustees of the City of Arcadia, November, 25th, 1907. E. J.
