The proliferation of such vehicles for advertising sign presentation and their presence on or upon public or private property and on streets and highways within the City constitutes an esthetic blight upon the community which can only be alleviated by appropriate regulation. f. Numerous alternative means exist for commercial advertising and the display and/or distribution of a variety of advertising messages. g. The provisions specified in this Ordinance are necessary to prevent the visual clutter, blight, nonaesthetic appearance ,and traffic safety hazards caused by signs which are placed on 'motor vehicles, and the cumulative effect of additional signs, if motor vehicles are allowed as an additional location for advertising. h. The purpose of this Ordinance is to mitigate the proliferation of signs that results from the usage of motor vehicles as a location for advertising signs that are placed on the vehicle in a highly visible manner. The Ordinance is not applicable to advertising that is painted or paneled on the I v~hicle and advertises the business or enterprise associated with the vehicle, or bumper stickers. The Ordinance is not intended -2- 1805 ' 209 . . to address the transient display of advertising on motor vehicles and therefore no violation shall occur unless and until at least one written warning has been issued by the Police. SECTION 4913.1. DEFINITION. MOTOR VEHICLES. Includes but is not limited to motor vehicles, boats, and trailers as defined in California Law. SECTION 4913.2. DEFINITION. ADVERTISING SIGNS. Any sign, poster, or similar item or structure built or constructed separate and apart from the motor vehicle which advertises, notices, promotes, sponsors or depicts any activity, event, product, sale, purpose, cause, political candidate, or service including anything related to the motor vehicle itself. SECTION 49l3.3. PROHIBITION. No person, corporation, partnership or other legal entity shall display, place, or permit 'to be placed advertising signs for the purpose of advertising on any motor vehicle parked upon streets and highways, public or private property visible to any person on a public street or 'public right-of-way, subsequent to the receipt of one written warning. SECTION 4913.4. EXCEPTIONS. The prohibitions of this Ordinance do not apply to (1) duly licensed and pe~mitted motor .vehicle, boat, or trailer dealers as to the businesses conducted on their lawfully approved business premises (2) advertising on buses and taxicabs (3) those items excluded pursuant to Section 4913(h) of this Ordinance. -3- 1805 210 . . The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published once in the official newspaper of said City within fifteen (l5) days upon its adoption.
