HomeMy WebLinkAbout1816 o ORDINANCE NO. 1816 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA AMENDING SECTIONS 9266.2.2.1. AND 9261.2.3. RELATING TO SIDE YARD SETBACKS IN THE M-l AND C-O ZONES. WHEREAS, a Text Amendment was initiated by the City for the consideration of amending Sections 9255.2.2.1. and 9261.2.3. of the Arcadia Municipal Code relating to side, yard setback requirements in the M-l and C-O zones, and WHEREAS, a public hearing was held on June II, 1985 before the Planning Commission at which time all interested persons were given full opportunity to be heard and to present evidence, and WHEREAS, the City Council conducted a public hearing concerning this proposal on July 2, 1985 and approved this amendment, NOW, THEREFORE, THE CITY COUNCIL OF THE 'CITY OF ARCADIA HEREBY ORDAIN AS FOLLOWS: Section 1. That Sections 9266.2.2.1. and 9261.2.3. be amended to read as follows: "9266.2.2.1. SAME. SIDE YARD. There shall be a side yard on each side of every building in accordance with the following: (a) Where the side property line abuts commercial or industrial zoned property or where the side property line abuts a dedicated alley which separates such side property line from abutting commercial or industrial zoned property, no side yard setback shall be required. (b) Where the side property line abuts residential zoned property a minimum side yard setback of ten (10) feet shall be maintained, except that no portion of any structure shall encroach through a plane projected from an angle of forty-five (45) degrees as measured at the ground level along the side prope rty 1 i ne. (c) Where the side property line abuts a dedicated alley which separates such side property line from abutting residential zoned property, the side yard shall have a minimum depth of ten (10) feet, shall be measured from the center line of said alley and the forty-five (45) degree angle of aforedescribed plane may be measured at the ground level along the center line of said alley." - 1 1816 (d) The side yard on the street side of a corner lot shall be ten (10) feet wide". "9261.2.3. SIDE YARD. Section 2. The City Clerk shall certify to the adoption of this Ordi nance and shall cause a copy of the same to be published in the official newspaper of said City within fifteen days after its adoption.
