AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ARCADIA, CALIFORNIA, AMENDING
ORDINANCE NO. 1806 BY ADDING SECTION
9286.4 TO THE ARCADIA MUNICIPAL CODE
REGARDING NON-CONFORMING USE OF DISH
ANTENNA
WHEREAS, to reasonably restrict and minimize detrimental
affects caused by the location and design of dish antenna, the
City of Arcadia adopted Ordinance No. 1806, and
WHEREAS, at the time of adoption concern was expressed with
regard to existing dish antenna that are inconsistent with the
provisions of Ordinance No. 1806, and
WHEREAS, a number of dish antennas have been installed which
are inconsistent with the terms of Ordinance No. 1806, and
WHEREAS, the General Plan of the City has as its objective
maintaining a residential community with the highest level of
appearance, and
WHEREAS, the City has taken numerous actions to maintain its
character as a residential community including regulations on
property maintenance and signage, requirements on architectural
review, provision of landscaped medians and other similar steps,
and
WHEREAS the existence of dish antennas that are unregulated
throughout the City can create visual blight which is offensive
to those who reside, work and travel in the City and contrary to
the City's General Plan.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 9286.4 is hereby added to the Arcadia
Municipal to read as follows:
9286.4. NON-CONFORMING USE OF DISH ANTENNA
(a) Dish antenna constructed prior to February 22, 1985,
when regulations regarding dish antenna under Ordinance 1806
became effective, which do not conform to the requirements
thereof, as set forth in Sections 9286.1 through 9286.3.5, shall
constitute a non-conforming use.
(b) No person shall maintain any dish antenna in violation
of the provisions of the referred to Section (a above) after the
expiration of one hundred and eighty (180) days of the Planning
Department giving notice to the property owner or person in
possession by mailing a notice to the property owner's address as
shown on the latest equalized assessment role that said dish
antenna shall be made conforming with requirements of Sections
9286.1 through 9286.3.5. The notice pursuant to the subsection
may be given at any time after the effective date of this
section.
(c) Whether notice is given pursuant to subsection (b) or
not, no person shall maintain or operate any dish antenna not
fully in conformity with the provisions of Ordinance No. 1806 as
referred to above after two (2) years from the effective date of
this Ordinance.

SECTION 2. The City Clerk shall certify to the adoption of
this Ordinance and shall cause a copy hereof to be published once
in the official newspaper within fifteen (15) days upon its
aaoption.
Passed, approved and adopted this 3rd day of September,
1985.
