DISCUSSION
Chapter 610, Statutes of 2004, requires redevelopment agencies to shift $250 million in
property tax revenue to the Education Revenue Augmentation Fund (ERAF) for the
2004-05 and 2005-06 fiscal years. The Agency has met this requirement for FY 2004-
05. For FY 2005-06, it has been determined by State of Caiifornia D+rector of Finance
that the Arcadia Redevelopment Agency's share is $354,408.21.
The Agency is again required to allocate its share to the courity auditor for deposit irrto
the ERAF on or before May 10, 2006. Unless future legislation is enaoted that would~
require additional ERAF obligations to the City or Agency, this would be the final
payment.
FISCAL IMPACT
Funds are available in the Unprogrammed Reserve, though this will negatively impact
the Agency for FY 2005-Q6.
RECOMMENDATION
It is recommended that the Agency appropriate $354,408.21 from the Unprogrammed
Reserve and make the required Redevelopment Agency ERAF payment to the Los
Mgeles County Auditor-Controller by May 10, 2006.

PROGRAM AND SCHEDULING THE PROTEST PUBLIC HEARING FOR
MARCH 7, 2006.
RECOMMENDATION: ADOPT
The Los Angeles County Agricultural Commissioner has submitted the attached 2005-2006
annual declaration list of private properties within the City of Arcadia which have been
inspected by the County, and found to contain a growth of flammable weeds, brush and/or
rubbish. Said weeds have attained such growth as to become, when dried, a fire menace to
adjacent property. If the owner does not bring the property into compliance upon notice of
dangerous conditions the County must abate the weeds.
The attached Resolution No. 6511, declares that hazardous conditions upon or in front of
certain private property are a public nuisance. Said resolution also schedules a public hearing
for March 7, 2006 at 7:00 p.m., as the date and time for the City Council to hear protests, if
any, from the affected property owners to the abatement of their property. Affected
properties are attached as Appendix A of the Resolution.
Upon adoption of the resolution the County Agricultural Commissioner will mail notices to the
affected property owners. An affidavit of mailing will be returned to the City by the County
when mailing of the notice, as provided by law, has been completed.
RECOMMENDATION
The full text of Resolution No. 6511, reads: "A Resolution of the City Council of the City of
Arcadia, California, declaring that weeds, brush, rubbish, refuse, and dirt upon or in front of
specified property in the city are a seasonal and recurrent public nuisance, and declaring its
intention to provide for the abatement thereof and to schedule a weed abatement protest
public hearing for March 7, 2006."

A RESOLUTION OF THE CITY COLJNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, DECLARING THAT WEEDS, BRUSH,
RUBBISH, REFUSE, AND DIRT UPON OR IN FRONT OF
SPECIFIED PROPERTY IN THE CITY ARE A SEASONAL AND
RECURRENT PUBLIC NUISANCE, AND DECLARING ITS
INTENTION TO PROVIDE FOR THE ABATEMENT THEREOF
AND TO SCHEDULE A WEED ABATEMENT PROTEST PUBLIC
HEARING FOR MARCH 7, 2006
THE CITY COUNCIL OF THE CITY OF ARCADIA, DOES HEREBY,
FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to the provisions of Title 4, Division 3, Part 2,
Chapter 13, Article 2, of the Califomia Government Code, Sections 39560 to
39588, inclusive, and evidence received by it, the City Council of the City of
Arcadia specifically finds:
A. That the weeds growing upon the streets, sidewalks, or provide
property are weeds which bear seeds of a wingy or downy nature or attain such
large growth as to become, when dry, a fire menace to adjacent improved property,.
or which are otherwise noxious or dangerous.
B. That the presence of dry grass, stubble, or other flammable materials
are condirions which endanger the public safety by creating a fire hazard.
C. That by reason of the foregoing facts, the weeds or dry grass, stubble,
refuse or other flammable material growing or existing upon the private property

hereinafter described, and upon the streets and sidewalks in front of said property
consritute a seasonal and recurrent public nuisance and shouid be abated as such.
D. That the private property, together with the streets and sidewalks in
front of the same herein referred to, is more particularly described as follows, to-
wit: That certain property described in Appendix "A" attached hereto and by this
reference made a part hereof as though set forth in full herein.
SECTION 2. Pursuant to the findings of fact by this Council heretofore
made, the weeds or dry grass, stubble, refuse or other flammable material in and
upon and in front of the real property hereinbefore described consritute and are
hereby declared to be a seasonal and recurrent public nuisance which should be
abated. The Agricultural Commissioner/Director of Weights and Measures,
County of Los Angeles, is hereby designated the person to give norice to destroy
said weeds or dry grass, stubble, refuse, or other flammable material and shall
cause norices to be given to each property owner by United States Mail.
SECTION 3. The Agricultural Commissioner is hereby authorized and
directed to recover its costs of inspection of the properties hereinabove described
in a manner consistent with prior action of the Board adopting a fee schedule for
such inspection. The recovery of these costs is vital to the ongoing operation
governing the identificarion and abatement of those properties that constitute a
seasonal and recurrent public nuisance and endanger the public safety.

On December 13; 2001, the Los Angeles Regional Water Quality Control Board issued
National Pollutant Discharge Elimination System (NPDES) Stormwater Permit, Order
01-182. This permit mandates that the City implement and require post-construction
control requirements in the form of a Standard Urban Stormwater Mitigation Plan
(SUSMP) to reduce pollutants. in storm water runoff for specific types of developments.
Currently, the City's municipal code has SUSMP requirements for developments of 5
acres or greater. The proposed Ordinance will change this threshold, to meet more
stringent, updated requirements for 1 acre, or greater, of disturbed land.
Staff recommends that the City Council introduce Ordinance No. 2216, amending
Section 7823 of the Arcadia Municipal Code concerning the City's Stormwater and
Urban Run-off Listings for New Construction, for land disturbing activities of 1 acre or
more.
DISCUSSION
In July of 1996, the California,Regional Water Quality Control Board issued a National
Pollutant Discharge Elimination System (NPDES) permit to the County of Los Angeles.
Eighty-four incorporated cities, including the City of Arcadia, were listed as co-
permittees to this permit for the purpose of controlling and minimizing the discharge of
pollutants associated with storm water and urban runoff. Furthermore, this permit
mandates.that the City implement and require post-construction control measures, in
the form of a Standard Urban Stormwater Mitigation Plan (SUSMP) to reduce pollutants
in stormwater runoff for specific types and sizes of developments. By adopting
Resolution 6215, on March 20, 2001, the City Council adopted SUSMP regulations. On
August 6, 2002, the City Council adopted Resolution No. 6318, further amending the
City's SUSMP regulations to be in conformance with the new December 13, 2001,
Regional Board permit.

The City of Arcadia's Municipal Code Section 7823, paragraph (c) cites construction
. projects in this category as land disturbing activities of 5 acres or greater. This section
; of the AMC needs to be amended to meet the current requirement of 1 acre or more of
~ land disturbing activities for construction projects, which went in to effect March 10,
` 2003. This amendment will not have a'significant impact to developers on sites of this
size. Staff has been enforcing the 1-acre requirement as stipulated in the Permit
through all routine plan-checking activities since March of 2003.
Staff recommends that the City Council introduce Ordinance No. 2216, amending
Section 7823 of the Arcadia Municipal Code conceming the City's Stormwater and

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, AMENDING STORM WATER
AND URBAN RUNOFF CONTROLS FOR NEW
CONSTRUCTION
WHEREAS, under the provisions of the Porter-Cologne Act, the State Water
Resources Control Board (SWRCB) and nine regional water quality control boards
adopt policies and plans relating to water quality control in the State, which
together comprise the uniform water quality guidelines for Califomia; and
WHEREAS, in December 2001, the Regional Board adopted Order No, Ol-
182, which added additional categories of development projects requiring a
Standard Urban Stormwater Mitigarion Plan (SUSMP) and replaced the previous
site visit with a requirement of site inspections; and
WHEREAS, on August 6, 2002, the City Council adopted additional
SUSMP requirements of the Regional Board, as required; and
WHEREAS, it is reasonable and appropriate for the City Council to amend
the Arcadia Municipal Code in order to comply with Order No. O 1-182 adopted by
the California Regional Water Quality Control Board for Los Angeles County.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. Article VII, Chapter 8, Section 7823 subsection (c) of the
Arcadia Municipal Code is amended to read in its entirety as follows:

"(c) Best Management Practices for New Developments and
Redevelopments. No grading permit shall be issued for any development with a
disturbed area of one (1) acre or greater unless the applicant can show that (i) a
Norice of Intent to comply with the State Construction Activity Storm Water
Pemut has been filed and (ii) a Storm Water Pollurion Prevenrion Plan has been
prepared. The City may adopt regulations establishing controls on the volume and
rate of stormwater runoff from new developments and redevelopments of less than
one (1) acre as may be appropriate to minimize the discharge and transport of
pollutants. The Development Services Director may require that any developer or
construction contractor performing work in the City provide a Local Stormwater
Pollution Prevention Plan prior to the beginning of such work. Construction
activity does not include routine maintenance to maintain original line and grade,
hydraulic capacity, the original purpose of the facility or emergency construction
acrivities required to protect the public health and safety."
SECTION 2. The City Clerk shall certify to the adoption of this
Ordinance and shall cause a copy or summary of same to be published in the
officiai newspaper of said City within fifteen (15) days of its adoption.

SUMMARY
StafF is recommending the City Council authorize the City Manager to approve
the recruitment and retention incentives for the Police Department as outlined in
this report.
BACKGROUND
On November 28, 2005, during a study session of the Arcadia City Council, the
mid-year budget review and a budget forecast was presented to City Council
members. As part of that review, the City Manager and the Police Chief provided
an overview of Police O~cer recruitment and retention issues. The City Manager
advised that the Police Department was reviewing short term and long term
alternatives/solutions and these would be presented to the City Council at a
future date.
DISCUSSION
Subsequenf to the November 28 Study Session, Police Management participated
in a meeting with the general membership of the Arcadia Police Officers'
Association. During this meeting, the Police Chief provided an overview of the
study session to the Association. A discussion of recruitment and retention
incentives was discussed among the membership and subsequently analyzed

and evaluated by City staff. As a result, staff is recommending the City Council
authorize the Crty Marrager to implemeni the following inceniives.
Si ninq Bonus and Finder's Fee
Staff is recommending the signing bonus for lateral officers be increased from
$1,500 to $3,000. Additionally, staff is recommending providing this signing
bonus for academy graduates as well (academy graduates are currently not
eligible for the bonus). The $3,000 bonus will be distributed as follows: $1,000
for the lateral officer or academy graduate at time of hire and $2,000 at the
completion of probation. Staff is also recommending a finder's fee at $1,000 to
an employee who brings the lateral or academy graduate to the Arcadia Police
Department. That fee will be paid when the lateral/academy graduate completes
his/her probationary period.
Increase Recruit Pa While in Police Academ
Currently, law enforcement recruits (LER's) are paid at a rate of $17.50 per hour.
LER's are also considered by CaIPERS as miscellaneous employees, not safety
employees, and are currently under the 2°/o at 55 retirement formula. Other law
enforcement agencies have begun offering LER's police officer pay while
attending the police academy. As a result, staff is recommending treating law
enforcement recruits attending a police academy as a hired members of the
Arcadia Police Department, at the salary range of an entry level Police Officer
(Step A is $4,351 monthly or $25.10 per hour). The signing bonus options would
apply as well. All other benefits would remain the same as currently offered. As
a result, these employees would retain the LER status, but be paid at the higher
range in hopes that this will heip with recruitment efforts.
Reserve Officer Com ensation and E ui ment
The integration of reserve police officers has been a main support pillar for law
enforcement agencies throughout the State for decades. Reserve police officers
have historically provided front-line and support law enforcement service that
augments the regular sworn complement of departments. In Arcadia, reserve
officers have provided thousands of hours of volunteer time to our community.
The Arcadia Police Reserve Officer Program was initiated in the mid-1970's anci
grew to nearly 50 members. These members attended reserve aeademies whrch
were conducted on a part-time basis, allowing participants to continue working
their regular job and receive the trainrng necessary to hold the reserve officer
position.
Currently, our Reserve Program has nine active members, eight Level I and II,
and one Level III. The numbers have been on the decfine and at current
estimation, only three of the current members will remain in the program in five

The Reserve Officer Program differs from the DepartmenYs other volunteer
programs in that they are considered police officers while on duty. They have
powers of arrest, and among other things, can directly augment the patrol and
detective staff by carrying out police functions that other volunteers are not
authorized by law to perform.
A survey of regional police agencies and the Sheriff's Department was initiated to
compare reserve programs at these agencies. Twelve agencies responded to
the survey. Of the 12 responding agencies, 11 offer some type of paid
compensation to their reserves. Of the respondenfs, which included Pasadena,
Sierra Madre, Alhambra, Anaheim, Irwindale, EI Monte, Monrovia, Azusa,
Glendora, South Pasadena, Baldwin Park and LASD, all but Arcadia and
Monrovia offer some form of paid compensation to reserve officers.
Another issue that negatively affects reserve officers is their costs associated
with participation. The City provides an annual stipend of $300.00 to reserve
officers for their participation. The cost of fuel for trips to the City, equipment
. purchases such as boots, flashlights, miscellaneous clothing; dues to the
Califomia Reseive Peace Officers' Association, and the cost of firearms
purchase, exceed the stipend provided by the City.
With the current staffing and the recruitment and retention difficulties experienced
among regular sworn members of the Department, the utilization of reserve
- police officers in specified circumstances to augment staffing needs is a valuable
resource for the Department that should be nurtured and developed to the fullest
extent possible.
The Department believes there is an opportunity for a"win-win" scenario for the
City and our reserve officers by offering a pay incentive, as well as providing
necessary equipment to reserve officers at no cost to them. Currently, the
Department utilizes the services of the Monrovia and Sierra Madre Police
Department officers for overtime assignments to the Santa Anita Race Track.
These officers are considered "at-will" part-time employees with no benefits other
than an hourly salary. On other assignments, such as movie details, outside
reimbursable overtime, patrol overtime, etc., there is a regular need for police
o~cers to work on an overtime basis. With the current shortage of officers, it is
quite frequent that officers are "forced" to work the overtime when there is a lack
of voluntary sign-up for these details.
In order to balance a fiscal incentive for reserve officer participation, provide
growth in the program, and to make the incentive attractive, the Department

For reserve officers who have achieved Level I/single-man patrol status, the City
would pay the reserve at an hourly rate equal to an "A" Step Police Officer. This
would currently equate to approximately $25.10 per hour. For reserve officers
who have not achieved single-man patrol status, the City would pay the reserve
at an hourly rate equal to the existing rate for a law enforcement recruit ($17.50
per hour; not the proposed rate in this report of $25.10 per hour).
The assignment of reserve officers would be supervised through the program
coordinators as it is currently to ensure the minimum of 20 hours per month is
achieved and that the reserve officer is a member in good standing. The
coordinators would regulate reserve officer assignments above and beyond 20
hours per month with the exception of reserve officers who have achieved single-
man patroi status. Those officers may be assigned patroi, detective, race track
posts, movie details, or outside reimbursable duties by shift or section
supervisors as a need arises.
The assignment of single-man reserve officers to patrol, detective, race track
posts, movie details, or outside reimbursable assignments would only be made
once regular officers have an opportunity to voluntarily sign-up for these details.
Prior to a force-hire situation, a qualified reserve officer may be called to work the
detail. Should a reserve officer not be available, the normal force hire situation
would apply to regular officers.
Staff is also recommending assigning reserve officers a Department owned
firearm if the reserve does not already personaliy own a suitable firearm. Upon
completion of their service as a reserve officer, the firearm would be returned to
the Department. Additionally, staff recommends providing equipment, such as
leather gear, uniforms, and boots on an as needed basis. Some of this
equipment may be assigned from existing Department stock or may be
purchased from a uniform supply company via Department voucher or
Department reimbursement of approved purchases.
Should the above recommendations be approved, there would not be a need for
the annual $300.00 stipend for Level I& II. (The City will continue to pay the
$300 stipend to the Level III reserve officer.) Also, should these
recommendations be approved, a letter of acceptance or agreement of these
recommendations should be obtained from the Arcadia Police Officers'
Association so that no conflict or misunderstanding arises between the City and
APOA as to the duties and compensation of the reserve officers. The reserve
o~cers would not be represented by the APOA, nor would their duties infringe on
the rights secured to the APOA by virtue of the APOA MOU with the City.
