GRIGOLLA CONSTRUCTION, INC. FOR STREET REHABILITATION WORK WITH STONE PINE TREES AS COMPLETE AND AUTHORIZE THE FINAL PAYMENT TO BE MADE IN ACCORDANCE WITH THE CONTRACT DOCUMENTS Recommendation: Approve SUMMARY On January 4 2011, the City Council awarded a contract to S.J. Grigolla Construction, Inc. in the amount of $181,700 for street rehabilitation work on streets damaged by Stone Pine tree roots. The terms and conditions of this project have been complied with and the work has been performed to staffs satisfaction for a total project cost of $172,718. This amount reflects the original contract amount of $181,700 minus quantity changes totaling $8,982 or -4.94% below the original contract amount. Staff recommends that the City Council accept all work performed by S.J. Grigolla Construction, Inc. as complete and authorize the final payment to be made in accordance with the contract documents, subject to a retention of $17,271.80. DISCUSSION The Public Works Services Department is responsible for the maintenance and repair of City streets. Annually, staff evaluates all City streets and detemiines necessary repairs and found that the streets north of Elkins Drive in the Highland Oaks area were damaged from Stone Pine trees. Over the years the health of the Stone Pine trees had been declining and their roots were causing extensive damage to the streets, curbs and gutters and private property. Staff also worked with a licensed arborist who stated that the years of cutting the tree roots to repair streets and curb and gutter and driveways, has contributed to the decline of the health of the trees and could destabilize the trees. As a result, the condition of the streets affected with tree root damage posed both potential pedestrian and driving hazards. Page 1 of 2 Mayor and City Council July 19, 2011 Page 2 On January 4, 2011, the City Council awarded a contract to S.J. Grigolla Construction, Inc. for Phases 1 and 2 for repairs to concrete and asphalt damaged by Stone Pine tree roots in the amount of $181,700. At the same time, a separate contract for the removal and replacement of the Stone Pine trees was also awarded, which was accepted by the City Council as complete on June 7, 2011. The terms and conditions of the street rehabilitation contract with S.J. Grigolla Construction, Inc. have been complied with and the work has been performed to staffs satisfaction. Therefore, staff recommends that the City Council accept all work performed by S.J. Grigolla Construction Inc. as complete and authorize the final payment to be made in accordance with the contract documents, subject to retention of $17,271.80. This amount reflects the original contract amount of $181,700 minus quantity changes totaling $8,982 or -4.94% below the original contract amount. As with most Capital Improvement projects, the original contract amount is awarded based on the project quantities from the initial engineer's estimate and the low bidder's unit bid prices. During construction it was determined that less asphalt, curb and gutter replacement was needed; as a result, there was a net savings in the overall contract cost. ENVIRONMENTAL IMPACT This road repair project is considered a Class 1 exemption as defined in Section 15301(c) of the California Environmental Quality Act since the project consists of the maintenance of existing public streets but does not involve expansion of the existing use of the streets. FISCAL IMPACT Sufficient funds are budgeted in the 2010/2011 Capital Improvement Program for this project. RECOMMENDATION 1. Accept all work performed by S.J. Grigolla Construction, Inc. for the repair of streets with Stone Pine trees as complete. 2. Authorize final payment to be made in accordance with the contract documents, subject to a retention of $17,271.80.
